Article 1(Purpose) #
The purpose of this Decree is to prescribe matters delegated by the Local Education Autonomy Act and matters necessary for its enforcement.
Article 2(Legislative council) #
(1) Where the superintendent of education of a Special City, Metropolitan City, Special Self-Governing City, Do, or Special Self-Governing Province (hereinafter referred to as "City/Do") intends to enact, amend, repeal, or promulgate ordinances or education rules concerning education and art, a legislative council (hereinafter referred to as the "Council" in this Article) shall be established under the jurisdiction of the superintendent of education to deliberate thereon. <Amended on Jun. 11, 2014; Dec. 13, 2016>
(2) The Council shall deliberate on the following matters: <Added on Jun. 11, 2014>
1. Draft ordinances concerning education and art submitted by the superintendent of education to the City/Do Council;
2. Draft ordinances concerning education and art promulgated after being resolved by the City/Do Council; the draft ordinances concerning education and art submitted by the superintendent of education to the City/Do Council and resolved in their original form shall be excluded;
3. Deleted; <Aug. 9, 2022>
4. Draft education rules that the superintendent of education intends to enact, amend, or repeal;
5. Other matters concerning education and art among agendas submitted to the City/Do Council which the superintendent of education deems necessary for deliberation by the Council.
(3) The chairperson of the Council shall be the vice-superintendent of education. In such cases, in a City/Do that has 2 vice-superintendents of education, the first vice-superintendent of education shall be the chairperson. <Amended on Jun. 11, 2014; Aug. 9, 2022>
(4) Members of the Council shall be appointed by the superintendent of education from among public officials belonging to the superintendent of education. <Amended on Aug. 9, 2022>

(6) The Council shall convene with the attendance of a majority of the registered members, including the chairperson, and shall resolve with the concurrent vote of a majority of those present. <Amended on Jun. 11, 2014>

(8) Except as provided in this Decree, matters necessary for the composition and operation of the Committee shall be determined by the education rules of each City/Do. <Amended on Jun. 11, 2014>
Article 3(Promulgation procedure for education rules) #
(1) A preamble shall be attached to the promulgation of education rules under Article 25(2) of the Local Education Autonomy Act (hereinafter referred to as the "Act"). <Amended on Jan. 30, 2009; Aug. 2, 2016>
(2) The preamble to the promulgation of education rules under paragraph (1) shall state the intent to enact, amend, or repeal the rules, and the superintendent of education shall sign it, affix an official seal, and write the date. <Amended on Aug. 2, 2016>

(4) Education rules shall be promulgated by publishing them in the official gazette of the City/Do or a daily newspaper, or by posting them on the bulletin board of the City/Do Office of Education and simultaneously posting them on the website of the relevant Office of Education.
(5) The date of promulgation of education rules under paragraph (1) shall be the date on which the official gazette or daily newspaper carrying the education rules is issued, or the date on which they are posted on the bulletin board. <Amended on Aug. 2, 2016>

Article 4(Pre-emptive disposition) #
"Matters urgently necessary for the safety of students and the protection of property of educational institutions" in Article 29(1)2 of the Act means any of the following: <Amended on Jan. 30, 2009>
1. Recovery from and relief for damage caused by natural disasters or large-scale fires;
2. Other matters that are likely to cause significant damage to the safety of students and the property of educational institutions unless a disposition is taken urgently.
Article 4-2(Scope of office of vice-superintendent of education) #
In the case of a City/Do that has 2 vice-superintendents of education under Article 30(1) of the Act, the division of duties for each vice-superintendent of education shall be as shown in Appendix 1; provided, the superintendent of education may determine the division of duties for each vice-superintendent of education differently for some duties deemed necessary for the efficiency of educational administrative work and the convenience of residents. <Amended on June 29, 2012>

Article 5(Name, location, and jurisdiction of office of education support) #
(1) The names, locations, and jurisdictions of the offices of education support under Article 34(1) and (2) of the Act shall be as prescribed in Appendix 2.
(2) Notwithstanding the jurisdictions of each office of education support under paragraph (1) and Appendix 2, the superintendent of education may, where necessary for the effective support of school education, designate a specific office of education support to handle part of the duties of other offices of education support as determined by education rules.
(3) The superintendent of education may request the Minister of Education to merge the offices of education support under his or her jurisdiction where necessary for the effective support of school education and the efficient operation of the offices of education support.
(4) The Minister of Education may provide administrative and financial support to the relevant City/Do Office of Education in cases of merging the offices of education support by reflecting the request under paragraph (3).

Article 6(Scope of office of head of office of education) #
The scope of guidance and supervision for the operation and management of schools at each level delegated to and handled by the head of the office of education under Article 35(1) of the Act shall be as follows:
1. Matters concerning the operation of curricula, such as teaching and learning activities, career guidance, and securing and management of instructors;
2. Matters concerning the promotion of science and technology education;
3. Matters concerning educational welfare, such as special education, education for students maladjusted to school, and support for students from low-income families;
4. Matters concerning the safety and health of students, such as school physical education, health, meals, and cleanup of school environments;
5. Matters concerning school commuting zones;
6. Matters concerning parents' participation in school, training and counseling, and the operation of school management committees;
7. Matters concerning the promotion of education and art, such as lifelong education;
8. Other matters concerning the guidance and supervision for the operation and management of schools at each level, such as the formulation and execution of draft budgets, tuition, and admission fees.

Article 8(Report on establishment of consultative body of superintendents of education) #
(1) Where superintendents of education establish a nationwide consultative body under Article 42 of the Act, they shall report the following matters to the Minister of Education; the same shall apply where any reported matters are changed: <Amended on Feb. 29, 2008; Mar. 23, 2013>
1. Purpose of establishment;
2. Name of the consultative body;
3. Location of the office of the consultative body;
4. Names of the representative, executives, and members;
5. Matters concerning the organization and operation of the consultative body.
(2) A report under paragraph (1) shall be in the attached form, and the following documents shall be attached:
1. A statement of the purpose of establishment;
2. Documents describing the organization and operation of the consultative body;
3. Minutes of the inaugural general meeting;
4. A register of members stating the names and addresses of the representative, executives, and members.
Article 9(Establishment and operation of transition committee for superintendent of education) #
(1) The transition committee for the superintendent of education under Article 50-2(1) of the Act (hereinafter referred to as the "Transition Committee" in this Article) shall be established after the elected superintendent of education is determined.
(2) The Transition Committee shall continue to exist until the time determined by the superintendent of education whose new term begins, within the period under Article 50-2(2) of the Act.
(3) The superintendent of education shall designate a person in charge from among public officials under his or her jurisdiction and have him or her consult with the Transition Committee to help the elected superintendent of education understand the duties.
(4) The superintendent of education shall support the expenses necessary for the establishment and operation of the Transition Committee from the reserve funds of the City/Do Office of Education.
(5) Allowances, travel expenses, and other necessary expenses may be paid to the chairperson, vice-chairperson, and members commissioned by the superintendent of education under Article 50-2(5) of the Act within the limits of the budget.
(6) Except as provided in paragraphs (1) through (5), matters necessary for the organization and operation of the Transition Committee shall be determined by ordinances of the relevant City/Do.
