ENFORCEMENT DECREE OF THE COMPOSITE CABLE BROADCASTING ACT

Article 1(Purpose) #

The purpose of this Decree is to provide for matters delegated by the Composite Cable Broadcasting Act and other matters necessary to implement the delegated matters.

Article 2(Scope of Restrictions on Side Business) #

(1) Composite cable broadcasting stations, suppliers of programs, or operators of transmission networks, in case they fall under each of the following subparagraphs, are prohibited from carrying on the side business (including holding stocks or equities) under Article 4 (1) of the Composite Cable Broadcasting Act (hereinafter referred to as the “Act”):

1. Where a composite cable broadcasting station carries on the side business of supplying programs in excess of 1/5 of the total programs provided by the entire suppliers;

2. Where a program supplier operates a cable broadcasting station as a side business in an area in excess of 1/10 of the total areas covered by the entire cable broadcasting stations; and

3. Where the operator of a transmission network (limited to governmentinvested institutions under Article 2 of the Framework Act on the Management of Government-Invested Institutions and corporations subject to the provisions of Article 2 of the Act on the Improvement of Managerial Structure and Privatization of Public Enterprises) operates a composite cable broadcasting station as a side business in an area in excess of 1/10 of the total areas covered by the entire composite cable broadcasting stations.

(2) A composite cable broadcasting station, in case it falls under each of the following subparagraphs, shall be prohibited from operating another composite cable broadcasting station under the former sentence of Article 4 (2) of the Act:

1. Where the composite cable broadcasting station is operated as a side business in an area in excess of 1/10 of the total areas covered by the entire composite cable broadcasting stations; and

2. Where the composite cable broadcasting station is operated in an area in excess of 1/2 of the total areas of the entire composite cable broadcasting stations in the Special Metropolitan City, one Metropolitan City, or one Do (hereinafter referred to as the “Si/ Do”): Provided, That the same shall not apply to the case where not more than 4 composite cable broadcasting stations exist in one Si /Do.”
