Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Act on Encouragement of Bicycle Riding and matters necessary for the enforcement thereof.

Article 2(Definition of Facilities for Bicycle Riding) #
"Facilities prescribed by Presidential Decree" in subparagraph 2 of Article 2 of the Act on Encouragement of Bicycle Riding (hereinafter referred to as the "Act") means the following facilities:
1. Bicycle crosswalks, bicycle signals, and bicycle traffic safety signs (referring to signs indicating caution, regulation, instruction, guidance, etc. necessary for the traffic safety of bicycles and road signs such as symbols, letters and lines displayed on the road floor);
2. Facilities for the safety of bicycle riders, such as protective fences and protective bicycle ridges;
3. Facilities for parking and locking bicycles (hereinafter referred to as "bicycle racks");
4. Facilities for the convenience of bicycle riders, such as resting places or camping sites for bicycle riders.

Article 2-2(Standards for Designation of Bicycle Priority Lane) #
"Road that has a motor vehicle traffic volume less than that prescribed by Presidential Decree" in subparagraph 4 of Article 3 of the Act means a road whose daily traffic volume is less than 2,000; provided, in any of the following cases and where consultations with the commissioner of a City/Do police agency or the chief of a police station are made, a road whose daily traffic volume is at least 2,000 shall be included: <Amended on Dec. 31, 2020>
1. Where necessary for preventing disconnection of bicycle lanes under subparagraphs 1 through 3 of Article 3 of the Act;
2. Where particularly necessary for the safety of bicycle riders.

Article 2-3(Designation and Commemoration of Bicycle Day) #
(1) April 22 of each year shall be designated as Bicycle Day pursuant to Article 4-2 of the Act.
(2) The head of a local government may hold various events to encourage bicycle riding on Bicycle Day and the week in which that day falls.
(3) The Government may support events under paragraph (2).

Article 3(Formulation of Encouragement Plans) #
Where the Special Metropolitan City Mayor, a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, a Special Self-Governing Province Governor (hereinafter referred to as "Mayor/Do Governor"), or the head of a Si/Gun/autonomous Gu (hereinafter referred to as "head of a Si/Gun/Gu") formulates a plan to encourage bicycle riding (hereinafter referred to as "encouragement plan") pursuant to Article 5 (1) of the Act, the Mayor/Do Governor shall seek, in writing, the opinions of the commissioner of the City/Do police agency, and the head of the regional office of construction management in advance, and the head of a Si/Gun/Gu shall seek, in writing, the opinions of the chief of the police station and the head of the regional office of construction management in advance. <Amended on Dec. 31, 2020>

Article 4(Modifications to Encouragement Plans) #
"Modification to important matters prescribed by Presidential Decree" in the latter part of Article 5 (1) of the Act means the following:
1. Basic directions for the maintenance of facilities for bicycle riding under Article 5 (3) 1 of the Act;
2. Annual encouragement plans under Article 5 (3) 2 of the Act;
3. Plans for financing project expenses under subparagraph 5 of Article 4.

Article 5(Reflection of Encouragement Plans) #
"Matters prescribed by Presidential Decree" in Article 5 (3) 4 of the Act means the following:
1. Priority analysis to promote projects for encouraging bicycle riding (hereinafter referred to as "projects for encouraging bicycle riding");
2. Connectivity between facilities for bicycle riding, such as bicycle lane networks;
3. Connectivity with public transportation facilities, such as railroad stations, urban railroad stations, and bus terminals;
4. Plans for bicycle lanes on major traffic routes, such as school routes and commuting routes;
5. Annual plans to promote projects for encouraging bicycle riding and plans for financing project expenses;
6. Methods of implementing projects for encouraging bicycle riding;
7. Measures for connecting plans for the new construction, expansion and rearrangement of roads with projects to develop housing sites, industrial complexes, tourist complexes, etc.;
8. Analysis of effects of projects for encouraging bicycle riding;
9. Plans for providing bicycle safety education.

Article 5-2(Surveys on bicycle danger zones) #
(1) A Mayor/Do Governor or the head of a Si/Gun/Gu who conducts surveys on zones that are especially dangerous for bicycle travel (hereinafter referred to as "bicycle danger zone") under Article 5-2 of the Act shall consider the following:
1. Frequency of bicycle accidents;
2. Traffic volume by other means of transportation and pedestrians;
3. Topographical, structural, and physical characteristics of bicycle lanes;
4. Other matters prescribed by ordinance of the relevant local government, which are related to the safety of bicycle riders.
(2) A Mayor/Do Governor or the head of a Si/Gun/Gu who conducts surveys of a bicycle danger zone shall inspect and evaluate the current status of the installation and operation of facilities for bicycle riding under subparagraphs 1 and 2 of Article 2.
(3) If deemed necessary for efficient surveys of bicycle danger zones, a Mayor/Do Governor or the head of a Si/Gun/Gu may request that the relevant administrative agencies, public institutions, corporations, organizations or experts provide necessary cooperation, such as submission of data or opinions.
(4) Except as provided in paragraphs (1) through (3), details necessary for surveys of bicycle danger zones shall be prescribed by ordinance of the relevant local government.

Article 6(Consultation on Encouragement Plans) #
A Mayor/Do Governor or the head of a Si/Gun/Gu who formulates an encouragement plan shall consult with the heads of neighboring local governments pursuant to Article 5 (4) of the Act on the following:
1. Matters regarding connecting sections of bicycle lanes, timing for connection, connection methods, etc.;
2. Matters regarding the structure of bicycle lanes, the scale of the facilities, etc.;
3. Matters regarding the bearing of installation expenses;
4. Matters necessary for promoting projects for encouraging bicycle riding, such as project implementation methods.

Article 6-2(Reflection in Si/Gun Plans) #
The head of an administrative agency who formulates a plan falling under any subparagraph of Article 8 of the Act shall examine the following matters and reflect the results therein:
1. Creation of bicycle lanes;
2. Bicycle parking spaces, charging stations for electric bicycles, and convenience facilities for bicycle riders;
3. Plans for connecting facilities for bicycle riding with public transportation, etc.;
4. Other matters regarding policies for encouraging bicycle riding.

Article 6-3(Public Bicycle Leasing Services) #
Ordinance under Article 10-2 (2) of the Act shall include the following:
1. Matters regarding the methods of operating public bicycle leasing services;
2. Matters regarding usage fees for public bicycles and the reduction or exemption thereof;
3. Other matters regarding the installation, maintenance, management, etc. of facilities necessary for the operation of public bicycles.

Article 7(Installation of Bicycle Parking Spaces) #
(1) Where bicycle parking spaces are installed pursuant to Article 11 (1) of the Act, the main clause of paragraph (2) of that Article, and paragraph (3) of that Article, the standards for such installation shall be as specified in Appendix 1; provided, a local government may relax or strengthen such standards by ordinance of the relevant local government within the limit of 1/2 of the standards for installing bicycle parking spaces in Appendix 1. <Amended on Dec. 29, 2017>

(3) Bicycle rack equipment shall be installed to ensure the safe and convenient use of bicycle racks for bicycle riders.

Article 8(Exclusion from Installation of Bicycle Parking Spaces) #
"Off-road parking lot ... prescribed by Presidential Decree" in the proviso of Article 11 (2) of the Act means any of the following:
1. Off-road parking lots established in areas connected only by motorways (including national expressways) or in urban central areas, etc. on which bicycle riding is deemed inadequate by a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu;
2. Off-road parking lots established in areas where bicycle riding is difficult, such as steep slopes;
3. Mechanical off-road parking lots and underground off-road parking lots;
4. Off-road parking lots established by the private sector, the floor area of which is less than 330 square meters.

Article 9(Operation of Bicycle Parking Spaces) #
Ordinance under Article 11 (4) of the Act shall include the following:
1. Matters regarding the installation, maintenance and management of bicycle parking spaces;
2. Matters regarding bicycle parking rates;
3. Matters regarding methods, etc. of operating bicycle parking spaces.

Article 10(Exemption from Installation of Facilities for Bicycle Riding by Public Project Implementers) #
(1) "Grounds prescribed by Presidential Decree" in the proviso of Article 12 of the Act means any of the following:
1. Where the road slope of an area is deemed unsuitable for bicycle ride;
2. Where the passage of bicycles is prohibited under road traffic-related statutes or regulations;
3. Where a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu deems it necessary to restrict bicycle ride.
(2) Areas referred to in paragraph (1) 1 shall be prescribed by joint ordinance under Article 9 of the Act.

Article 10-2(Preparation and Publication of Bicycle-Related Statistics) #
(1) The Minister of the Interior and Safety shall prepare bicycle-related statistics under Article 14-3 (1) of the Act (hereinafter referred to as "bicycle-related statistics") every 2 years; provided, matters under Article 14-3 (1) 2 of the Act may be prepared every 5 years. <Amended on Jul. 26, 2017>
(2) Bicycle-related statistics shall be prepared by any of the following methods: <Amended on Jul. 26, 2017>
1. Collection and utilization of statistical data under subparagraph 4 of Article 3 of the Statistics Act and administrative data under subparagraph 7 of Article 3 of that Act;
2. Questionnaire surveys;
3. Other methods deemed necessary by the Minister of the Interior and Safety to prepare bicycle-related statistics.
(2) Bicycle-related statistics shall be published by any of the following methods:
1. Provision of news releases to the press;
2. Issuance of statistical publications;
3. Posting on the website.

Article 11(Disposal of Bicycles Abandoned without Permission) #
(1) A Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu shall move and store abandoned bicycles which obstruct passage at a public place for at least 10 days in accordance with Article 20 (2) of the Act and shall publicly announce the following matters on the bulletin boards of the relevant Special Self-Governing City, Special Self-Governing Province, and Si/Gun/Gu and the website for 14 days from such date, and prepare and keep a ledger to enable relevant persons to inspect it. In such cases, a bicycle registered under Article 22 of the Act shall be notified in writing to a registrant:
1. Types, shapes, and number of bicycles stored, and names of their manufacturers;
2. Places where the bicycles are abandoned, and dates and time when they are moved and stored;
3. Places where the bicycles are stored;
4. Meaning that if the bicycle owners fail to retrieve their bicycles even after the expiration of the period of public announcement, the following methods will apply:
(a) The proceeds from the sale shall be kept, and such proceeds shall be reverted to the treasury of the relevant local government after 1 year has elapsed from the date of public announcement;
(b) The bicycles shall be donated, utilized for public bicycle leasing services under Article 10-2 of the Act, or disposed of by other methods prescribed by ordinance of a local government.
(2) Where a bicycle owner fails to retrieve the bicycle even after the expiration of the period of public announcement under paragraph (1), the Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu may dispose of the bicycle by any of the following methods: <Amended on Nov. 19, 2014; Jul. 26, 2017>
1. Sale; In such cases, the examples of the sale of general property under the Public Property and Commodity Management Act shall apply, but bicycles with a value not exceeding the value prescribed by Ministerial Decree of the the Interior and Safety may be sold under a private contract, and the proceeds from the sale shall revert to the treasury of the relevant local government after the passage of 1 year;
2. Donation;
3. Utilization for public bicycle leasing services under Article 10-2 of the Act;
4. Other methods prescribed by ordinance of a local government.
Article 12(Re-Examination of Regulation) #
The Minister of the Interior and Safety shall examine the appropriateness of the standards for installation of bicycle parking spaces under Article 7 (1) and Appendix 1 every 3 years, counting from January 1, 2025 (referring to the period that ends on the day before January 1 of every 3rd year) and shall take measures, such as making improvements. <Amended on Mar. 12, 2025>

Article 13(Standards for Imposition of Administrative Fines) #
The standards for imposing administrative fines under Article 25 (1) of the Act shall be as specified in Appendix 2.
