Article 1(Purpose) #
The purpose of this Decree is to prescribe matters necessary for the enforcement of the Public Health and Environment Research Institute Act (hereinafter referred to as the "Act").
Article 2(Establishment of branch institutes) #
If the Mayor of the Seoul Metropolitan Government, the Mayor of a directly-administered city, or a Do Governor (hereinafter referred to as the "Mayor/Do Governor") intends to establish a branch institute of the Public Health and Environment Research Institute (hereinafter referred to as the "Institute") under Article 3 of the Act, he or she shall have a prior consultation with the Minister of Climate, Energy and Environment and the Commissioner of the Korea Disease Control and Prevention Agency. <Amended on Dec. 23, 1994; Feb. 29, 2008; Mar. 15, 2010; Sep. 11, 2020; Oct. 1, 2025>
Article 3(Public officials) #
(1) The president of the Institute under Article 6 (2) of the Act shall be a person who has at least 8 years' work experience in research, testing, or inspection in the field of health and the environment or administrative affairs related to health and the environment.
(2) The head of a branch institute under Article 6 (4) of the Act shall be a person who has at least 5 years' work experience in research, testing, or inspection in the field of health and the environment, or administrative affairs related to health and the environment.
(3) The job grades and the quota of public officials to be assigned to the Institute and its branch institutes shall be prescribed by the rules of the relevant local government.
Article 4(Subsidies from National treasury) #
(1) Subsidies from the National Treasury under Article 9 of the Act shall account for up to 2/3 of the expenses in cases of the expenses incurred in the establishment of the Institute and its branch institutes, and incidental expenses and research expenses thereof, and up to 1/2 of operating expenses each year in cases of operating expenses.
(2) Subsidies from the National Treasury under paragraph (1) shall be granted to Mayors/Do Governors by the Minister of Climate, Energy and Environment, the Minister of Food and Drug Safety, or the Commissioner of Korea Disease Control and Prevention Agency. <Amended on Dec. 23, 1994; Feb. 28, 1998; Mar. 29, 2008; Mar. 15, 2010; Mar. 23, 2013; Sep. 11, 2020; Oct. 1, 2025>
Article 5(Guidance) #
In order to provide technical guidance under Article 10 of the Act, the Minister of Food and Drug Safety, the Commissioner of the Korea Disease Control and Prevention Agency, and the President of the National Institute of Environmental Research shall take necessary measures, such as giving guidance on inspection standards, inspection methods, and inspection skills, on-site technical guidance, and technical training for the staff of the Institute and its branch institutes, respectively, under his or her jurisdiction. <Amended on Feb. 28, 1998; Dec. 18, 2003; Jul. 22, 2005; Mar. 23, 2013; Sep. 11, 2020>
Article 6(Reporting on business performance) #
(1) The President of the Institute shall report the results of business performance of the Institute for the first half of each year by July 31 and annual business performance of the Institute by the end of February of the following year to the Minister of Food and Drug Safety and the Commissioner of the Korea Disease Control and Prevention Agency and the President of the National Institute of Environmental Research through the competent Mayor/Do Governor in regard of business affairs under their respective jurisdiction. <Amended on Feb. 28, 1998; Dec. 18, 2003; Jul. 22, 2005; Mar. 23, 2013; Sep. 11, 2020>
(2) The President of the National Institute of Environmental Research shall analyze and evaluate the business performance of the Institute each year and report it to the Minister of Climate, Energy and Environment. <Amended on Sep. 11, 2020; Oct. 1, 2025>
