Article 1(Purpose) #
The purpose of this Decree is to prescribe matters relating to the selection of public officials setting an example to other public officials by faithfully performing their duties, and personnel privileges afforded to them.

Article 2(Eligibility for selection) #
(1) Public officials under Article 1 (hereinafter referred to as "exemplary public officials") shall be selected from among public officials of Grade VI or lower in general service and other public officials equivalent thereto.
(2) A person who has already been selected as an exemplary public official may not be re-selected as an exemplary public official.

Article 3(Recommendation) #
(1) The head of a central administrative agency (including the heads of agencies under the direct control of the President and the heads of agencies under the direct control of the Prime Minister) and the Mayor of Seoul Metropolitan Government shall recommend exemplary public officials.
(2) When recommending an exemplary public official pursuant to paragraph (1), a letter of recommendation shall be submitted to the Minister of the Interior and Safety, along with a merit report after a merit examination by the Merit Examination Committee under Article 2 of the Enforcement Decree of the Awards and Decorations Act. <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>

Article 4(Selection) #

Article 5(Badge) #
A person selected as an exemplary public official shall be awarded the exemplary public official badge as specified in the Appendix and the exemplary public official certificate as specified in the Form as documents verifying the selection.

Article 6(Methods of wearing badge) #
The exemplary public official badge shall be worn on the left chest.

Article 7(Re-issuance of badge) #
(1) When a person who has been awarded the exemplary public official badge loses or damages it, he or she may have one re-issued.
(2) If a person selected as an exemplary public official intends to have the exemplary public official badge re-issued under paragraph (1), he or she shall submit an application for re-issuance to the Minister of the Interior and Safety. In such cases, Form 6 in the Enforcement Decree of the Awards and Decorations Act shall apply mutatis mutandis to the form of an application for re-issuance (including an application in electronic form), and Article 31 (2) of that Decree shall apply mutatis mutandis to the cost of producing the badge. <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
(3) An exemplary public official certificate shall not be re-issued.
(4) The Minister of the Interior and Safety may issue a certificate of conferment of an exemplary public official certificate upon application of the person himself or herself, his or her bereaved family member, or representative. In such cases, Form 7 in the Enforcement Decree of the Awards and Decorations Act shall apply mutatis mutandis to the form of an application for issuance of a certificate of conferment, and Form 8 in that Enforcement Decree shall apply mutatis mutandis to the form of a certificate of conferment of an exemplary public official certificate. <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>

Article 8-2(Allowances for exemplary public officials) #
(1) A person selected as an exemplary public official shall receive an allowance for exemplary public officials of 50,000 won per month within the budget, and the payment period shall be 3 years from the month immediately following the month in which the selection is made as an exemplary public official; provided, if any of the following events occurs, the allowance shall not be paid from the month immediately following the month in which such event occurs:
1. When he or she retires or is dismissed;
2. Where he or she is subject to disciplinary action;
3. When he or she is subject to release from his or her position.
(2) A public official who takes a leave of absence shall receive allowances for exemplary public officials as follows:
1. A public official who takes a leave of absence due to falling under any of the following items shall receive allowances for exemplary public officials during the leave period:
(a) Article 71 (1) 1 of the State Public Officials Act;
(b) Article 63 (1) 1 of the Local Public Officials Act;
(c) Article 44 (1) 1 of the Educational Officials Act;
2. No allowance for exemplary public officials shall be paid to a public official who takes a leave of absence for any of the following reasons beginning in the month immediately following the month in which he or she takes a leave of absence, and the remaining allowances shall be paid monthly beginning in the month of reinstatement:
(a) Article 71 (1) 3 through 6 and 71 (2) of the State Public Officials Act;
(b) Article 63 (1) 2 through 5 and 63 (2) of the State Public Officials Act;
(c) Article 44 (1) 2 through 7, 7-2, 8 through 11, and (2), and (3) of the Educational Officials Act.

Article 9(Keeping of record books) #
(1) The Minister of the Interior and Safety shall prepare and manage a record book of exemplary public officials relating to persons selected as exemplary public officials. <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
(2) The record books referred to in paragraph (1) shall be prepared and managed in a way that can be electronically processed, unless there is a compelling reason not to do so.
