Article 1(Purpose) #
The purpose of this Decree is to prescribe matters necessary for the operation of the State Council pursuant to Article 12 (4) of the Government Organization Act.

Article 2(Operation of Council) #
(1) The State Council shall be operated in such manner that important national policies can be sufficiently deliberated on at the entire government level.
(2) Meetings of the State Council shall be classified into regular or extraordinary meetings, and regular State Council meetings shall be convened once a week, and extraordinary State Council meetings shall be convened as necessary.

Article 3(Submission of bills) #
(1) The President, the Prime Minister, or a member of the State Council shall submit matters subject to deliberation by the State Council prescribed in Article 89 of the Constitution of the Republic of Korea and statutes or regulations as bills.
(2) When a bill for a statute or regulation necessary for implementing an important policy is to be submitted, materials to deliberate on the details of the policy shall be submitted together, or a bill to deliberate on the details of the policy shall be submitted in advance.
(3) With respect to important matters to be deliberated on intensively at a meeting of the State Council, the relevant bill shall be submitted clearly stating the review opinions, etc. necessary for deliberation.
(4) A bill shall be prepared by classifying matters subject to resolution and matters subject to reporting, and be submitted to the Ministry of the Interior and Safety at least 3 days prior to the scheduled date of a meeting of the Vice Ministers’ Council to which the bill is to be presented; provided, this shall not apply to a bill for a statute to be promulgated, a bill regarding matters prescribed in subparagraph 16 of Article 89 of the Constitution of the Republic of Korea, and an urgent bill. <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
(5) The Minister of the Interior and Safety shall distribute a bill deliberated upon by the Vice Ministers’ Council to the President, the Prime Minister, members of the State Council, and attendees under Article 8, along with the agenda at least 2 days before the scheduled date of the meeting of the State Council; provided, this shall not apply where a bill is presented at an extraordinary meeting of the State Council or an urgent bill is presented. <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
(6) Any of the following matters shall be reported to the State Council from time to time, insofar as they are related to important policies: <Amended on Jul. 26, 2017>
1. The status of analysis of important domestic and international information;
2. The current status of the progress of the Government's key projects;
3. The current status of the progress of important policies affecting the life of citizens;
4. Important matters needed to be actively publicized to the public;
5. Matters requiring cooperation between Ministries;
6. Matters instructed by the President or the Prime Minister.

Article 4(Agreement) #
A bill to be presented to the State Council, which is related to 2 or more Ministries, shall be submitted after the relevant Ministries reach a prior agreement thereon; provided, if a prior agreement is not made, the bill may be presented to the State Council, clearly stating the grounds therefor.

Article 5(Deliberation on bills) #
(1) A bill submitted to the State Council shall first undergo deliberation by the Vice Ministers’ Council; provided, this shall not apply to urgent bills.
(2) The State Council may instruct the Vice Ministers' Council to deliberate on and report specific matters, if deemed necessary.

Article 6(Quorum for proceedings and quorum for resolution) #
A majority of the members of the State Council shall constitute a quorum, and any resolution thereof shall require the concurring vote of at least 2/3 of those present.
(2) The State Council may hold a meeting by means of a remote video conference in which its members appear at different places equipped with devices that can simultaneously transmit and receive video and audio. In such cases, the members of the State Council shall be deemed to have appeared in the same conference room.

Article 7(Attendance by proxy) #
(1) If a member of the State Council is unable to attend a meeting of the State Council, the Vice Minister of each Department (in the case of disaster and safety management affairs of the Ministry of the Interior and Safety, including the Deputy Minister in charge of such business affairs) shall attend the meeting on behalf of such member. <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
(2) The Vice Minister who attends such meeting on behalf of a member of the State Council may make statements regarding the relevant bill, but may not participate in voting.

Article 8(Attendance) #
(1) The Minister of the Presidential Secretariat, the Minister of the Office of National Security, the Minister of the Policy Office of the President, the Minister of the Office for Government Policy Coordination, the Minister of Personnel Management, the Minister of Government Legislation, the Minister of Food and Drug Safety, the Chairperson of the Fair Trade Commission, the Chairperson of the Financial Services Commission, the Chairperson of the Science and Technology Innovation Headquarters, the Director of the Trade Negotiation Headquarters, and the Mayor of Seoul Metropolitan Government shall attend a meeting of the State Council; provided, if the chairperson deems it necessary, he or she may have public officials in important positions attend the meeting. <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017; Apr. 11, 2023>
(2) When the Speaker deems it necessary, he or she may require the administrator of a central administrative agency to attend a meeting of the State Council to make a statement regarding the business affairs under his or her jurisdiction or have relevant experts attend such meeting to hear their opinions.

Article 9(Supplementary explanation) #
When a supplementary explanation is required with respect to a bill, a public official of Grade II or a public official in general service belonging to the Senior Executive Service of a Ministry that has submitted the bill may be required to explain such bill.

Article 10(Executive secretary) #
(1) The State Council shall have 1 executive secretary to handle administrative affairs of the State Council.

Article 11(Meeting minutes of State Council) #
(1) The executive secretary shall prepare the meeting minutes of the State Council.
(2) The Minister of the Interior and Safety shall report the meeting minutes of the State Council prepared pursuant to paragraph (1) to the President, and send them to the Prime Minister, members of the State Council, and attendees under Article 8. <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017>
