Article 1(Purpose) #
The purpose of this Decree is to prescribe matters necessary for the efficient management of national intelligence data and the establishment of a system for joint use of national intelligence data to enhance the efficiency of the establishment and implementation of national intelligence policies.
Article 2(Definitions) #
The terms used in this Decree are defined as follows: <Amended on Jun. 13, 1996>
1. The term "national intelligence data" means data containing basic intelligence of each field, such as domestic and overseas politics, economy, society, culture, military affairs, science, regional geography, and communications, which may contribute to the formulation of national intelligence policies, and details of personnel and material intelligence, etc. that may affect each field;
2. The term "exclusive management agency" means an agency that comprehensively manages data in a specific field among national intelligence data;
3. The term "agencies of various levels" means central administrative agencies (including agencies under the direct control of the President) under Article 2 of the Government Organization Act.
Article 3(National Intelligence Data Management Council) #
(1) A National Intelligence Data Management Council (hereinafter referred to as the "Council") shall be established within the National Intelligence Service (hereinafter referred to as the "National Intelligence Service") to deliberate on matters necessary for the efficient management and joint utilization of national intelligence data. <Amended on Mar. 31, 1999>
(2) The Council shall deliberate on the following matters:
1. Improvement of the national intelligence data management system;
2. Selection or change of an exclusive management agency;
3. Definition of the scope of national intelligence data subject to management by an exclusive management agency;
4. Joint use of national intelligence data;
5. Other matters for cooperation among agencies of various levels.
(3) The Council shall be comprised of up to 25 members, including 1 chairperson; and the head of the Planning and Coordination Office of the National Intelligence Service shall serve as the chairperson; and members shall consist of the staff of the National Intelligence Service and 1 member each appointed or commissioned by the Commissioner of the National Intelligence Service upon the recommendation of agencies of various levels designated by the Director of the National Intelligence Service (hereinafter referred to as the "Director of the National Intelligence Service") from among public officials at the director-general level or higher of such agencies; provided, an agency deemed necessary by the Commissioner of the National Intelligence Service may commission up to 2 members. <Amended on Feb. 1, 1991; Jun. 13, 1996; Mar. 31, 1999>
(4) The chairperson shall convene and preside over meetings of the Council, and exercise overall control over the business affairs of the meetings of the Council.
(5) A meeting of the Council shall be convened when the chairperson deems it necessary or at the request of a member of the Council. <Amended on Jun. 13, 1996>
(6) A quorum for meetings of the Council shall be at least 2/3 of the members, and any resolution thereof shall require the concurring vote of a majority of those present, but the chairperson shall have a casting vote in the event of a tie.
(7) The Council shall have 1 executive secretary who shall be appointed by the chairperson from among directors of the divisions of the National Intelligence Service. <Amended on Mar. 31, 1999>
Article 4(Working-level council) #
(1) A working-level council may be established in the Council to preliminarily deliberate on matters under the jurisdiction of the Council or to handle matters delegated by the Council.
(2) A working-level council shall be comprised of division director-level staff in charge of the management of national intelligence data of the agencies to which the members of the Council belong, and the chairperson shall be appointed by the Director of the National Intelligence Service from among the members of the Council. <Amended on Mar. 31, 1999>
(3) Matters necessary for the establishment and operation of the working-level council shall be determined by the chairperson of the Council subject to resolution by the Council.
Article 5(Principles of data management) #
(1) National intelligence data shall be systematically managed so that agencies of various levels can jointly utilize such data.
(2) National intelligence data shall be managed so as not to be damaged or contaminated, and the details thereof shall not be arbitrarily modified or added without specifying the grounds therefor.
Article 6(Exclusive management of data) #
(1) An exclusive management agency and the scope of national intelligence data to be comprehensively managed by the relevant exclusive management agency shall be determined by the Commissioner of the National Intelligence Service, subject to deliberation by the Council. <Amended on Mar. 31, 1999>
(2) An exclusive management agency shall manage national intelligence data under its jurisdiction so that it can be preserved for a long time by such means as converting the original into files or microfilming or computerizing the data, and shall manufacture duplicates in case of an emergency, and shall disperse such duplicates in safe areas.
(3) When the heads of agencies of various levels produce or collect national intelligence data subject to exclusive management, they shall, without delay, provide them to the competent exclusive management agency, and the head of an exclusive management agency may request the agencies of various levels to provide national intelligence data in their possession.
(4) The heads of agencies of various levels shall, when any matter requiring addition, deletion, or correction of the details of national intelligence data provided to an exclusive management agency arises, notify the exclusive management agency thereof without delay.
(5) The head of an exclusive management agency shall determine and implement detailed rules for the efficient management of national intelligence data under his or her jurisdiction and the joint use of such data between agencies of various levels. In such cases, he or she shall have a prior consultation with the Commissioner of the National Intelligence Service on the content of the detailed rules. <Amended on Mar. 31, 1999>
(6) The head of an exclusive management agency may determine and specify matters necessary for the efficient management of data subject to exclusive management held by a government-invested institution or government-funded institution under his or her jurisdiction and the joint utilization of such data among the agencies of various levels in the detailed rules under paragraph (5) and implement such rules. <Newly Inserted on Jun. 13, 1996>
Article 7(Wartime data management plans) #
(1) The head of an exclusive management agency shall formulate and implement a wartime national intelligence data management plan with respect to matters necessary for the efficient management of data subject to exclusive management under his or her jurisdiction and the joint utilization among agencies of various levels in wartime or other emergencies.
(2) The management plan referred to in paragraph (1) shall include the following matters:
1. Scope of data subject to intensive wartime management;
2. Scope of data subject to joint utilization and methods of shared utilization during wartime;
3. The scope of data subject to dispersion, the places of dispersion, the timing and method of dispersion;
4. Scope of data subject to destruction, and the timing and method of destruction.

Article 8(Perusal and support of data) #
(1) The heads of agencies of various levels or other government agencies may, if deemed necessary for the performance of official duties, request the perusal or support of national intelligence data held by other agencies.
(2) The head of an agency in receipt of a request for perusal or support under paragraph (1) shall allow or support the relevant data to be perused or supported, except where the relevant data is subject to a high degree of control for the maintenance of security.
Article 9(Detailed operating rule) #
Details necessary for the enforcement of this Decree shall be determined by the Director of the National Intelligence Service. <Amended on Mar. 31, 1999>
