FIRE SERVICES ACT

Article 1(Purpose) #

The purpose of this Act is to safeguard the lives, bodies and properties of persons by preventing, being alert to, and suppressing fires and by performing relief and rescue activities in times of calamities and disaster and other emergency situations, and to thereby maintain public peace and order as well as promote public welfare. <Amended by Act No. 5756, Feb. 5, 1999>

Article 2(Definitions) #

The definitions of terms used in this Act shall be as follows: <Amended by Act No. 5756, Feb. 5, 1999>

1. The term “object of fire-prevention” means a building, a vehicle, a ship (limited to ships excluded from the application of Article 2 (1) of the Ship Safety Act and ships lying in the harbor), a dock, a forest, and any other structure or goods;

2. The term “fire-fighting systems” means the fire extinguishing apparatus, fire alarm system, evacuation facilities, fire-fighting water supply system, and other necessary equipment for fire-fighting, as prescribed by the Presidential Decree;

3. The term “fire-fighting machines and appliances, etc.” means the fire-fighting machines and devices, fire-extinguishing chemicals, fire-retardant paints, fire-retardant liquid, and such other means as pre-scribed by the Presidential Decree;

4. The term “hazardous materials” means the inflammable or combustible materials as prescribed by the Presidential Decree;

5. The term “special place” means a place of public performance, place of assembly, restaurant, sleeping accommodations, medical institution, school, factory, and any other place to which a great number of persons pay frequent visits, or in which they work, as prescribed by the Presidential Decree;

6. The term “related area” means a place in which an object of fire-prevention exists and the area adjoining thereto that is necessary for fire fighting;

7. The term “interested person” means the proprietor, manager, or occupant of an object of fire-prevention; and

8. The term “fire marshal of fire defense headquarters” means the head of the office in charge of fire-fighting, relief and rescue services for the Special Metropolitan City, the Metropolitan City or Do (herein-after referred to as the “City/ Do”).
