Article 1(Establishment of military academies) #
(1) A military academy shall be established in each of the Army, Navy, and Air Force to provide the necessary education to those who will become regular officers in the Army, Navy, and Air Force.
(2) A graduate school of science and engineering (hereinafter referred to as the “graduate school”) may be established in each military academy to promote the development of military science and technology and enhance the qualities of officers.

Article 2(Academic years) #
(1) The academic years of a military academy shall be 4 years.
(2) The academic years of a graduate school shall be 2 years.

Article 3(Eligibility for admission) #
(1) A person who intends to enter a military academy shall meet all of the following requirements: <Amended on Apr. 13, 2021>
1. The person shall be unmarried and at least 17 years of age but under 21 years of age; provided, the upper age limit for admission shall be extended as prescribed by Presidential Decree in the case of a discharged soldier under Article 16 (1) and (2) of the Support for Veterans Act;
2. The person shall not fall under any of the grounds for disqualification under Article 10 (2) of the Military Personnel Management Act;
3. The person shall have the academic background prescribed in Article 33 (1) of the Higher Education Act;
4. The person shall meet the physical standards prescribed by the school regulations.
(2) A person eligible for admission to a graduate school shall be a person who has the academic background prescribed in Article 33 (2) of the Higher Education Act and falls under any of the following cases:
1. An active-duty officer of the rank of major or below;
2. An employee of an institution or organization prescribed by Presidential Decree.

Article 4(Curricula) #
(1) The curricula of military academies shall be divided into a military science curriculum and a general academic curriculum; the matters concerning the military science curriculum shall be determined by the Minister of National Defense, and the matters concerning the general academic curriculum shall be determined by the Minister of National Defense in consultation with the Minister of Education. <Amended on Mar. 23, 2013>
(2) The curriculum shall be sufficient to confer degrees.
(3) The provisions concerning universities under the Higher Education Act shall apply mutatis mutandis to the general academic curriculum and related facilities.
(4) The curriculum of the master’s program in the graduate school shall be designed for academic research in military science and technology and shall be determined by the Minister of National Defense in consultation with the Minister of Education. <Amended on Mar. 23, 2013>

Article 5(Appointment of superintendent and public officials) #
(1) Each military academy shall have such public officials, military personnel and civilian military employees (hereinafter referred to as “public officials”) as may be necessary in addition to the superintendent, as prescribed by Presidential Decree.
(2) The commandant shall be appointed by the President from among general-grade officers of each military service upon the recommendation of the Chief of Staff of the relevant military service through the Minister of National Defense. <Amended on Mar. 21, 2017>
(3) The dean of the graduate school shall be appointed by the Minister of National Defense with the consent of the Minister of Education from among those who meet the qualifications under Article 16 of the Higher Education Act. <Amended on Mar. 23, 2013>

Article 6(Qualifications and appointment of teaching staff) #
(1) With respect to the types and qualifications of public officials responsible for education in the general academic curriculum and the master’s program of the graduate school, Article 16 of the Higher Education Act shall apply mutatis mutandis.
(2) Among those responsible for education in the general academic curriculum and the master’s program of the graduate school under paragraph (1), professors and associate professors shall be appointed by the President upon the recommendation of the Minister of National Defense; assistant professors shall be appointed by the Minister of National Defense upon the recommendation of the superintendent; and teaching assistants shall be appointed by the superintendent. <Amended on Jul. 21, 2011>
(3) The President may delegate the authority to appoint professors and associate professors under paragraph (2) to the Minister of National Defense as prescribed by Presidential Decree.

Article 6-2(Mutatis mutandis application of the Educational Officials Act) #
A person who is responsible for education in the general academic curriculum or in the master’s program of a graduate school and who is neither military personnel nor a civilian military employee shall be a public official in a special service; and with respect to their term of appointment, Article 11-3 of the Educational Officials Act shall apply mutatis mutandis; and with respect to remuneration, training, status security, disciplinary actions, and appeals, the Educational Officials Act and the Special Act on the Improvement of Teachers’ Status and the Protection of Their Educational Activities shall apply mutatis mutandis, respectively. <Amended on Feb. 3, 2016>

Article 7(Appointment of graduates) #
A person who has completed the full 4-year course of a military academy and graduated shall be commissioned as a second lieutenant of the relevant military service.

Article 8(Conferral of degrees) #
(1) A military academy shall be regarded as a 4-year university under Article 31 of the Higher Education Act with respect to qualifications, and shall confer a bachelor’s degree on graduates. In such cases, the types of degrees and other matters necessary for the conferral of bachelor’s degrees shall be prescribed by Presidential Decree.
(2) A person who has completed the prescribed curriculum of the graduate school and passed a prescribed examination shall be awarded a master’s degree; in such cases, the type, conferral procedures, and registration of such degrees shall be governed by the Higher Education Act.
