Article 1(Purpose) #
The purpose of this Act is to contribute to the creation and development of national culture by protecting and fostering the Academy of Korean Studies, a non-profit foundation established to promote Korean studies through in-depth research and education on Korean culture.

Article 2(Contributions) #
(1) The State or a local government may provide contributions to the Academy of Korean Studies (hereinafter referred to as the "Academy") to cover expenses necessary for its basic facilities, equipment, and operations.
(2) Matters necessary for the provision, use, and management of contributions under paragraph (1) shall be prescribed by Presidential Decree.
(3) Any individual, corporation, or organization may contribute money or other property to the Academy to support its projects.

Article 3(Loan of State-owned and public property) #
(1) The State or a local government may, notwithstanding the State Property Act or the Public Property and Commodity Management Act, lend or transfer State-owned or public property to the Academy without consideration, or permit the Academy to use or profit from such property without consideration, for the establishment and fostering of the Academy.
(2) Matters necessary for the details, conditions, and procedures, etc. for the gratuitous loan, transfer, or use of and profiting from State-owned or public property under paragraph (1) shall be prescribed by Presidential Decree.

Article 4(Secondment of research personnel) #
(1) Where particularly necessary to achieve its purposes, the Academy may request the State, a local government, an educational institution, or a research organization to second research personnel, etc. to the Academy via the Minister of Education. <Amended on Mar. 23, 2013>
(2) The head of an institution or organization requested under paragraph (1) may second its members to the Academy in consultation with the Academy.
(3) A person seconded to the Academy under paragraph (2) shall be deemed to serve in his or her original institution during the period of secondment, and shall not be subject to any disadvantageous treatment in terms of his or her status on the ground of such secondment.

Article 5(Provision of materials) #
(1) The Academy may request the State, a public organization, an educational institution, or a research organization to distribute publications, such as research papers, survey reports, and reports related to humanities and social sciences, and other materials. In such cases, the institution requested shall comply with the request unless there is a special reason. <Amended on May 29, 2016>
(2) The Academy may request a person who possesses rare materials necessary for research, such as classics, etc., to allow the reading or copying of such materials. In such cases, the person requested shall comply with the request unless there is a special reason.
(3) Where a person who has provided materials under paragraphs (1) and (2) so requests, the Academy shall pay just compensation.
(4) Materials provided to the Academy under paragraphs (1) and (2) shall not be used for any purpose other than research purposes.

Article 6(Establishment of graduate schools) #
(1) The Academy may establish a graduate school within the Academy with authorization from the Minister of Education to cultivate leading human resources who study the essence of Korean culture. <Amended on Mar. 23, 2013>
(2) The qualifications for admission, faculty, curricula, and conferment of degrees of the graduate school established under paragraph (1) shall be governed by the Higher Education Act and its subordinate statutes. In such cases, "President" shall be deemed "President of the Academy."

Article 7(Project plans) #
The Academy shall prepare a project plan and a budget for each fiscal year and submit them to the Minister of Education. The same shall also apply where it intends to change them. <Amended on Mar. 23, 2013>

Article 8(Settlement reports) #
The Academy shall submit a statement of accounts for revenues and expenditures for each fiscal year, accompanied by the performance of project execution for the relevant year, to the Minister of Education by the end of March of the following year. <Amended on Mar. 23, 2013>

Article 9(Prohibition of use of similar names) #
No person other than the Academy shall use the name "Academy of Korean Studies" or any name similar thereto.

Article 10(Use of facilities of the Academy) #
(1) The Academy may permit the State, a public organization, an educational institution, or a research organization, etc. to use its facilities, etc. for research, education, training, or practical exercises, to the extent that it does not interfere with its projects.
(2) Where the facilities, etc. of the Academy are used under paragraph (1), the Academy may be deemed an education and training institution, a research institution, or any other training institution under other statutes, etc.

Article 11(Administrative fines) #
(1) A person who violates Article 9 shall be subject to an administrative fine not exceeding 5 million won. <Amended on Aug. 20, 2019>
(2) Administrative fines under paragraph (1) shall be imposed and collected by the Minister of Education, as prescribed by Presidential Decree. <Amended on Mar. 23, 2013>
