Article 1(Purpose) #
The purpose of this Act is to promote the purveyance of military supplies by guiding and furthering the purveyance of the military supply business in a sound way.
Article 2(Definitions) #
For the purpose of this Act, the definitions of terms shall be as follows:
1. The term “purveyance of military supplies” means the acts of selling goods to, receiving construction work orders from, and providing services to the Armed Forces of the United Nations and other foreign military agencies stationed in the Republic of Korea; and
2. The term “purveyor of military supplies” means one who is operating the business of purveyance of military supplies.
Article 3(Administrative Authority) #
Matters on the purveyance of military supplies business shall be governed by the Minister of Trade, Industry and Energy. <Amended by Act No. 4541, Mar. 6, 1993; Act No. 5454, Dec. 13, 1997>
Article 4(Registration) #
(1) Any person who intends to operate the purveyance of military supplies business shall register with the Ministry of Trade, Industry and Energy in compliance with the provisions of the Presidential Decree. <Amended by Act No. 4541, Mar. 6, 1993; Act No. 5454, Dec. 13, 1997>
(2) Any person who has not registered under paragraph (1) shall not be permitted to operate the purveyance of military supplies business.
(3) Any person who is applying for registration of the purveyance of military supplies business pursuant to paragraph (1) shall pay fees in accordance with the provisions of the Ordinance of the Ministry of Trade, Industry and Energy. <Amended by Act No. 4541, Mar. 6, 1993; Act No. 5454, Dec. 13, 1997>
Article 5(Cancellation of Registration) #
(1) When a purveyor of military supplies falls under any of the following subparagraphs, the Minister of Trade, Industry and Energy shall order the cancellation of the registration of the purveyance of military supplies business, or the suspension of the purveyance of military supplies business for a specified period not exceeding six months: <Amended by Act No. 4541, Mar. 6, 1993; Act No. 5454, Dec. 13, 1997>
1. Where he has registered for the purveyance of military supplies business through the means of fraud or other illegitimate methods;

3. Where he violated this Act, or orders and dispositions pursuant to this Act.

(3) Any person whose registration is canceled in accordance with the provisions of paragraph (1) shall not register for the purveyance of military supplies business again within one year from the date of cancellation of registration.
Article 5-2(Hearing) #
Where the Minister of Trade, Industry and Energy intends to cancel the registration of the purveyance of military supplies business pursuant to Article 5 (1), he shall hold a hearing.

Article 6(Establishment of Association of Purveyors of Military Supplies) #
(1) The purveyors of military supplies may, for the purpose of promoting the purveyance of military supplies and of assuring the mutual benefits of the purveyors of military supplies, establish an association of the purveyors of military supplies upon authorization by the Minister of Trade, Industry and Energy. <Amended by Act No. 4541, Mar. 6, 1993; Act No. 5454, Dec. 13, 1997>
(2) The association of the purveyors of military supplies shall be a juristic person.
(3) The provisions of the Civil Act relevant to the corporate juristic person shall apply mutatis mutandis to the matters necessary for the establishment of the association of the purveyors of military supplies.
Article 7(Collection of Payment for Military Supplies Purveyed) #
(1) The purveyors of military supplies shall, after the purveyance of military supplies, collect payment for the military supplies purveyed through the method of settlement of account in accordance with the provisions of Acts and subordinate statutes related to foreign exchange control.

Article 8(Security Confirmation) #
In the purveyance of military supplies, any person who has made the registration of purveyance of military supply business shall obtain a security check by the pertinent agency for the purpose of maintaining security as determined by the Presidential Decree.

Article 9(Maintenance of Order of Purveyance of Military Supplies) #
The Minister of Trade, Industry and Energy may, when deemed necessary to establish the order of the purveyance of military supplies and to maintain their credibility in transactions of the purveyance of military supplies, order adjustment in advance to the purveyors of military supplies and also may, when they do not comply with such adjustment, issue orders or take other measures necessary for the maintenance of order of the purveyance of military supplies. <Amended by Act No. 4541, Mar. 6, 1993; Act No. 5454, Dec. 13, 1997>
Article 10(Report) #
The Minister of Trade, Industry and Energy may request that the purveyors of military supplies submit necessary reports on their business activities. <Amended by Act No. 4541, Mar. 6, 1993; Act No. 5454, Dec. 13, 1997>
Article 11(Delegation of Authority) #
The Minister of Trade, Industry and Energy may, in accordance with the provisions of the Presidential Decree, delegate part of his authority under this Act to Special Metropolitan City Mayor, Metropolitan City Mayors and Do governors. <Amended by Act No. 4541, Mar. 6, 1993; Act No. 5454, Dec. 13, 1997>
Article 12(Enforcement Decree) #
Matters necessary for the enforcement of this Act shall be provided by the Presidential Decree.
