CHAPTER I GENERAL PROVISIONS

Article 1(Purpose) #

The purpose of this Act is to contribute to the sound development of the health and medical industry and the promotion of national health by prescribing matters concerning the establishment of a master plan for the promotion of health and medical technology, the implementation of health and medical technology research and development projects, the certification of new health technology, and health and medical information, and by establishing the National Evidence-based Healthcare Collaborating Agency to perform duties such as analyzing health and medical technology and the National Dental Research Institute to perform duties such as industrial promotion through dental research. <Amended on Jan. 23, 2024>

Article 2(Definitions) #

(1) The terms used in this Act are defined as follows: <Amended on Jan. 18, 2010; Jul. 30, 2013; Jan. 16, 2024>

1. "Health and medical technology" means any technology falling under the following:

a. Technology related to medical science, dental surgery, oriental medicine, medical engineering and medical information science, etc.;

b. Technology related to developing and improving the efficiency of drugs, medical devices, foods, cosmetic and herbal medicine, etc.;

c. Other technologies related to health and medical care related to the goods and services necessary for preservation and improvement of the health and life of the human body;

2. "Drugs" means those defined in subparagraphs 4 and 7 of Article 2 of the Pharmaceutical Affairs Act;

3. "Medical device" means any device defined in Article 2(1) of the Medical Devices Act;

4. "Foods" means those defined in subparagraph 1 of Article 2 of the Food Sanitation Act;

5. "Cosmetic" means that defined in subparagraph 1 of Article 2 of the Cosmetics Act;

6. "Herbal medicine" means those defined in subparagraphs 5 and 6 of Article 2 of the Pharmaceutical Affairs Act;

7. "New health technology" means health and medical technology newly developed in Korea for the first time or newly created by improving existing technology, which has been certified by the Minister of Health and Welfare;
