PROTECTION OF MINIMUM LIVING STANDARDS ACT

CHAPTER Ⅰ GENERAL PROVISIONS

Article 1(Purpose) #

The purpose of this Act is to contribute to the improvement of social welfare by providing necessary assistance to persons who are unable to or find it difficult to maintain minimum living standards, in order to guarantee a minimum standard of living and to promote self-sufficiency.

Article 2(Definitions) #

Terms used in this Act shall be defined as follows: <Amended by Act No. 5360, Aug. 22, 1997>

1. The term “ward” shall mean a person receiving assistance under this Act;

2. The term “assistance funds or items” shall mean money or products given or lent to a ward under this Act;

3. The term “assistance agency” shall mean the State or local governments which conduct assistance activities under this Act;

4. The term “person responsible for support” shall mean a person responsible for supporting the person to receive assistance under the provisions of Article 3 who is a lineal blood relative, spouse, or relative within the second degree of kinship who lives with the person to receive assistance; and

5. The term “minimum standard of living” shall mean the amount announced each year by the Minister of Health and Welfare as the minimum amount of money necessary for a citizen to maintain a healthy and cultured life.

Article 3(Scope of Persons to Receive Assistance) #

(1) A person to receive assistance under this Act shall be a person who has no responsible supporter, has a responsible supporter who is incapable of providing support or is unable to receive support even if he or she has a responsible supporter, who meets the criteria for assistance eligibility set each year by the Minister of Health and Welfare based on income and property and in consideration of the minimum standard of living, and who falls under any one of the following subparagraphs:

1. Senior citizens over the age of 65;

2. Minors under the age of 18;
