Article 1(Purpose) #
The purpose of this Decree is to provide the legal basis for allowing police officials and employees of the National Police Agency and the Korea Coast Guard to process personal information under Articles 23, 24, and 24-2 of the Personal Information Protection Act, where necessary for the performance of their duties.
Article 2(Processing of sensitive information by police officials) #
Police officials and employees of the National Police Agency and the Korea Coast Guard may process data containing sensitive information under Article 23 of the Personal Information Protection Act, personally identifiable information under Article 24 of that Act, and resident registration numbers under Article 24-2 of that Act, if it is unavoidable for performing any of the following business affairs:
1. Duties of police officers under Article 2 of the Act on the Performance of Duties by Police Officers;
2. Investigation into suspects, criminal facts, and relevant evidence under the Criminal Procedure Act;
3. Business affairs regarding the collection, use, and protection of DNA identification information, including the collection of DNA analysis samples, the request for a warrant to collect DNA analysis samples, the recording and management of DNA identification information, the retrieval and provision of such information, its deletion, and the disposal of DNA analysis samples under the Act on the Use and Protection of DNA Identification Information;
4. Business affairs regarding the management, retrieval, and comparison of applications for the issuance of resident registration cards under the statutes or regulations related to resident registration;
5. Business affairs for handling personnel administration, including the preparation, maintenance, modification, and storage of personnel records of police officials and employees of the National Police Agency and the Korea Coast Guard; the verification of qualifications and requirements necessary for appointments; and other matters related to examinations and appointments;
6. Business affairs regarding the operation and management of information and communications networks, including internal information systems of the National Police Agency or the Korea Coast Guard;
7. Business affairs that is incidental to and necessary for performing those specified in subparagraphs 1 through 6.
Article 3(Processing of sensitive information by persons other than employees of the National Police Agency or the Korea Coast Guard) #
A person who is not an employee of the National Police Agency or the Korea Coast Guard but performs any of the business affairs specified in the subparagraphs of Article 2 under statutes or regulations, including a member of the committee for deliberation on compensation for loss under the Act on the Performance of Duties by Police Officers, may process data containing sensitive information under Article 23 of the Personal Information Protection Act, personally identifiable information under Article 24 of that Act; or resident registration numbers under Article 24-2 of that Act , if it is unavoidable for performing such business affairs.
