Article 1(Purpose) #
The purpose of this Decree is to prescribed matters mandated by the KoRoad Act and matters necessary for the enforcement thereof.
Article 2(Registration of establishment) #
Matters to be registered for the establishment of the Korea Road Traffic Authority (hereinafter referred to as the "KoRoad") under Article 3 of the KoRoad Act shall be as follows:
1. Objectives;
2. Name;
3. Location of its main office;
4. Names and address of executive officers;
5. Matters relating to assets;
6. Method of public announcement.
Article 3(Registration of establishment of branch offices) #
If the KoROAD has established a branch office, a sub-branch office, a research institute, a traffic accident analysis center, an educational institution, a traffic broadcasting station, a driver's license test center, etc. (hereinafter referred to as "branch office, etc.") under Article 4 of the KoROAD Act (hereinafter referred to as the "Act"), it shall register the name, location, and the date of establishment of the branch office, etc. established at the location of its main office within 3 weeks after such establishment.

Article 4(Registration of relocation) #
(1) If the KoRoad relocates its main office, it shall register the new location and the date of relocation at the former or new location within 3 weeks after relocation.
(2) If the KoRoad relocates its branch offices, etc., it shall register the new location and the date of relocation at the location of its main office within 3 weeks after relocation.

Article 5(Registration of change) #
If any change occurs to the matters to be registered under each subparagraph of Article 2 or 3 (excluding cases falling under registration of relocation under Article 4), the KoROAD shall register such change at the location of its main office within 3 weeks after the change.

Article 6(Documents attached to application for registration) #
An application for registration under Articles 2 through 5 shall be accompanied by the documents classified as follows:
1. For the registration of establishment under Article 2: The articles of association, and documents relating to assets and certifying qualifications of executive officers;
2. For the registration of establishment of a branch office, etc. under Article 3; Documents certifying the establishment of the branch office, etc.;
3. Registration of relocation under Article 4: Documents certifying the relocation of the main office or branch offices, etc.;
4. For the registration of change under Article 5: Documents certifying the change.
Article 7(Computation of registration period) #
If any matter to be registered under this Decree requires authorization or approval from the Commissioner General of the Korean National Police Agency, the registration period shall be counted from the date documents relating to such authorization or approval reach the applicant.
Article 8(Execution of entrusted tasks) #
(1) The KoRoad may be entrusted with the following road traffic safety-related tasks by the State or a local government under subparagraph 13 of Article 6 of the Act:
1. Research for the development of policies for road traffic safety;
2. Appraisal of road traffic accidents;
3. Installation and management of traffic signals and safety signs;
4. Education and training of those engaged in road traffic safety including training of drivers;
5. Collection, analysis, and furnishing of various information to facilitate road traffic flow;
6. Operation and management of unmanned traffic enforcement equipment;
7. Other tasks relating to road traffic safety.
(2) The State or a local government may, when entrusting the KoRoad with the tasks referred to in paragraph (1), bear expenses incurred in handling those tasks.
Article 9(KoROAD’s incidental projects) #
Education on driving motor vehicles (referring to written test education, skill training, and on-road driving training under Article 60 (3) of the Enforcement Decree of the Road Traffic Act) that the KoRoad may conduct as an incidental business under subparagraph 15 of Article 6 of the Act shall include the following:
1. Support for motor vehicle driving education conducted in facilities falling under subparagraph 32 (d) through (f) of Article 2 of the Road Traffic Act;
2. Motor vehicle driving education conducted in facilities of a driver's license test site for any of the following persons:
a. A recipient defined in subparagraph 2 of Article 2 of the National Basic Living Security Act;
b. A person eligible for support under Article 5 or 5-2 of the Single-Parent Family Support Act;
c. A person with a disability who is issued a registration certificate for a person with a disability under Article 32 (1) of the Act on Welfare of Persons with Disabilities;
d. A person who has been assigned a disability rating under Article 6-4 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State.
Article 10(Provision of contributions) #
(1) If the Government intends to provide a contribution to the KoRoad under Article 12 (1) 1 of the Act, the Commissioner General of the Korean National Police Agency shall allocate the necessary funds in the budget and disburse the contribution accordingly.
(2) When the budget for the contribution under paragraph (1) is finalized, the Commissioner General of the Korean National Police Agency shall notify the KoRoad of such fact.
(3) If the KoRoad intends to receive contributions under paragraph (1), it shall submit an application for such contributions to the Commissioner General of the Korean National Police Agency, accompanied by a business plan and a budget execution plan.
(4) Upon receiving an application for contributions under paragraph (3), the Commissioner General of the Korean National Police Agency shall provide the contributions if he or she deems that the business plan and the budget execution plan are reasonable.
(5) If a local government or any other person intends to make a contribution or donation to the KoROAD, the method of such contribution, donation, etc. may be determined by consultation between the contributor or donor and the Commissioner General of the Korean National Police Agency.
Article 11(Approval for subsidies, loans, or borrowings) #
(1) A subsidy or a loan under Article 12 (1) 4 of the Act may be used exclusively for the projects specified in Article 6 of the Act.
(2) Before using any subsidy or a loan under paragraph (1), the KoROAD shall submit a plan for the use of such subsidy or loan to the Commissioner General of the Korean National Policy Agency and obtain approval thereof.
(3) If the Authority intends to appropriate funds necessary to operate the KoROAD and to undertake projects related to road traffic safety from borrowings under Article 12 (1) 4 of the Act, it shall submit an application for approval, including the following matters, to the Commissioner General of the Korean National Police Agency and obtain approval for such appropriation:
1. The reason for borrowing and the name of the lender;
2. The amount of borrowing, and its terms and conditions;
3. The method and period of repayment;
4. A business plan including the intended use of the borrowed funds, relevant procedures, etc.;
5. Other matters necessary for the borrowing and repayment of the loan.
Article 12(Investment) #
If the KoROAD intends to make an investment or a contribution under Article 13 of the Act, it shall submit an application for approval to the Commissioner General of the Korean National Police Agency, including the following, and obtain approval for such investment or contribution:
1. The necessity of the investment or contribution;
2. The type and amount of assets to be invested or contributed;
3. A business plan;
4. Other matters necessary for investment or contribution.
Article 13(Processing of personally identifiable information) #
If unavoidable to conduct affairs relating to authorization for amendment to the articles of association under Article 5 (2) of the Act, the Commissioner General of the Korean National Police Agency may process data containing resident registration numbers under subparagraph 1 of Article 19 of the Enforcement Decree of the Personal Information Protection Act and alien registration numbers under subparagraph 4 of that Article.
