Article 1(Purpose) #
The purpose of this Decree is to prescribe the matters mandated by the Act on Facilitation of Provision and Use of Agricultural Science and Technology Information Services and matters necessary for the enforcement thereof.
Article 2(Scope of agricultural science and technology information) #
“Information prescribed by Presidential Decree” in subparagraph 3 (e) of Article 2 of the Act on Facilitation of Provision and Use of Agricultural Science and Technology Information Services (hereinafter referred to as the “Act”) means the following:
1. Information on research and development projects that generate such outcomes as new theories and knowledge through research and development of science and technology related to agriculture, farmers, etc. and rural communities;
2. Information on international cooperation projects in partnership with international organizations, international research institutes, and foreign countries to globally exchange and disseminate science and technology related to agriculture, farmers, etc. and rural communities;
3. Other information necessary to facilitate the provision and use of agricultural science and technology information services, as determined and publicly notified by the Administrator of the Rural Development Administration.
Article 3(Formulation and execution of master plan and implementation plan) #
(1) An annual implementation plan referred to in Article 5 (1) of the Act (hereinafter referred to as the "implementation plan") shall include the following:
1. Evaluation of the progress of the projects and policies for the previous year;
2. Direction- and goal-setting for the projects and policies for the relevant year;
3. Details and promotion plans of major projects and policies for the relevant year;
4. Funding and budget operation plans for the projects and policies for the relevant year;
5. Other matters deemed necessary by the Administrator of the Rural Development Administration to facilitate the provision and use of agricultural science and technology information services.
(2) Where the Administrator of the Rural Development Administration intends to modify a master plan for facilitating the provision and use of agricultural science and technology information services under Article 5 (1) of the Act (hereinafter referred to as "master plan") and an implementation plan thereof, he or she shall hear from the heads of relevant central administrative agencies and the heads of local governments; provided, this shall not apply in the following cases:
1. Where modification is made to reflect changes arising from the enactment, amendment, or repeal of statutes or regulations;
2. Where modification is made to correct simple mistakes, misspellings, omissions or obvious errors equivalent thereto;
3. Where modification is made to the matters determined by the Administrator of the Rural Development Administration, which do not have a significant impact on the details of a master plan or an implementation plan.
(3) Once modification of a master plan or an implementation plan is finalized, the Administrator of the Rural Development Administration shall notify the heads of relevant central administrative agencies and the heads of local governments of the modified master plan or implementation plan.
(4) "Data prescribed by Presidential Decree, such as the current status of provision of agricultural science and technology information services" in the former part of Article 5 (5) of the Act means the following:
1. Data on the current status of provision of agricultural science and technology information services;
Article 4(Collection, management and provision of agricultural science and technology information) #
(1) When collecting, managing, or providing agricultural science and technology information pursuant to Articles 6 and 7 of the Act, the Administrator of the Rural Development Administration and the heads of local agricultural community development promotion agencies shall comply with the following:
1. Not to collect, manage, or provide agricultural science and technology information for purposes other than those prescribed by statutes or regulations;
2. To take technical, administrative, and physical measures necessary to ensure the safety of agricultural science and technology information so that such information is not forged, altered, damaged, or leaked without authorization.
(2) A person intending to request the Administrator of the Rural Development Administration to provide agricultural science and technology information under Article 7 (3) of the Act shall make such request in writing, stating the following:
1. Purpose of utilization of agricultural science and technology information;
2. Names and items of agricultural science and technology information;
3. Period of utilization of agricultural science and technology information;
4. Matters regarding measures to ensure the safety of agricultural science and technology information;
5. Matters regarding confidentiality.
Article 5(Establishment and operation of agricultural science and technology information platform) #
(1) The Administrator of the Rural Development Administration may implement the following projects in order to efficiently establish and operate the agricultural science and technology information platform pursuant to Article 8 (1) of the Act:
1. Maintenance, management and upgrading of the agricultural science and technology information platform;
2. Monitoring of the operation status of the agricultural science and technology information platform;
3. Establishment of a joint utilization system for the agricultural science and technology information platform;
4. Standardization of agricultural science and technology information services and quality control and management thereof;
5. Other projects deemed necessary by the Administrator of the Rural Development Administration for efficiently establishing and operating the agricultural science and technology information platform.
(2) Where the Administrator of the Rural Development Administration deems it necessary for the efficient establishment and operation of the agricultural science and technology information platform, he or she may request the heads of the relevant administrative agencies and public institutions to take necessary measures, such as correction of errors in agricultural science and technology information.
(3) Except as provided in paragraphs (1) and (2), matters necessary for establishing and operating the agricultural science and technology information platform shall be determined by the Administrator of the Rural Development Administration.
Article 6(Composition and operation of technology dissemination and proliferation support group) #
(1) A support group for the dissemination and proliferation of technology under Article 11 (1) of the Act (hereinafter referred to as "technology dissemination and proliferation support group") shall be comprised of not more than 30 members, including a director.
(2) The Administrator of the Rural Development Administration and the heads of local agricultural development promotion agencies may organize and operate a working group, if necessary to provide administrative support for the technology dissemination and proliferation support group in its administrative affairs.
(3) The Administrator of the Rural Development Administration and the heads of local agricultural development promotion agencies may request relevant institutions, corporations, organizations, etc. to provide necessary cooperation, if it is deemed necessary for the efficient operation of the technology dissemination and proliferation support group.
(4) Except as provided in paragraphs (1) through (3), matters necessary for the composition and operation of the technology dissemination and proliferation support group shall be determined by the Administrator of the Rural Development Administration or the head of the relevant local government.
Article 7(Support for projects utilizing technology dissemination and proliferation support group) #
(1) The Administrator of the Rural Development Administration may provide the following support to the heads of local agricultural community development promotion agencies pursuant to Article 12 (2) of the Act:
1. Provision of information on the projects referred to in the subparagraphs of Article 12 (1) of the Act and consulting thereon;
2. Education on analysis and utilization of agricultural science and technology information;
3. Establishment of a cooperation system between technology dissemination and proliferation support groups;
4. Other matters deemed by the Administrator of the Rural Development Administration to be necessary for the promotion of projects utilizing a technology dissemination and proliferation support group.
(2) A project implementation plan referred to in Article 12 (3) of the Act shall include the following:
1. Goals and strategies of the project;
2. Project details and promotion methods;
3. Project costs and funding plans;
4. Other matters deemed necessary by the Administrator of the Rural Development Administration to examine the appropriateness and feasibility of the project.
(3) Upon receipt of a project implementation plan under Article 12 (3) of the Act, the Administrator of the Rural Development Administration shall examine such plan and notify the head of a local agricultural community development promotion agency of whether to provide financial and technical support and the details of support.
(4) Except as provided in paragraphs (1) through (3), the details of financial and technical support and details necessary for the submission and review of a project implementation plan shall be determined by the Administrator of the Rural Development Administration.
Article 8(Support for local agricultural community development promotion agencies) #
(1) The contents of education and training under Article 13 (1) of the Act shall be as follows:
1. Matters regarding facility management and equipment utilization for agricultural science and technology information;
2. Matters regarding the utilization of the agricultural science and technology information platform;
3. Other matters deemed necessary by the Administrator of the Rural Development Administration for research, dissemination, and proliferation of agricultural science and technology information.
(2) In order to efficiently support local agricultural community development promotion agencies in terms of facilities, equipment, etc. pursuant to Article 13 (2) of the Act, the Administrator of the Rural Development Administration may inspect the performance of facilities, equipment, etc. in their possession or provide consulting services on the introduction and utilization thereof.
(3) If necessary for providing support under Article 13 (2) of the Act, the Administrator of the Rural Development Administration may investigate the current status of facilities and equipment related to agricultural science and technology information possessed and used by local agricultural community development promotion agencies. In such cases, he or she shall formulate an investigation plan including the criteria for selecting the subject of investigation, the date and time of investigation, the method of investigation, etc. and shall notify the relevant local agricultural community development promotion agency thereof in advance.
