Article 1(Purpose) #
The purpose of this Act is to contribute to the promotion of public health by comprehensively formulating and implementing policies for injury prevention and control so as to reduce personal pain and damage, as well as the social burden, caused by injuries.
Article 2(Definitions) #
The terms used in this Act are defined as follows:
1. The term “injury” means a physical or mental health problem or its sequelae caused by external risk factors such as various accidents, disasters, or poisoning, excluding diseases;
2. The term “injury control” means all activities aimed at preventing and managing injuries by identifying and controlling health-related risk factors that cause injuries.
Article 3(Responsibilities of the State) #
(1) The State and local governments shall endeavor actively to prevent injuries and ensure that injured patients are provided with appropriate medical services by implementing and supporting a project for injury control (hereinafter referred to as “injury control project”).
(2) Medical personnel and the heads of medical institutions under the Medical Service Act shall actively cooperate with injury control projects implemented by the State and local governments.
Article 4(Injury Prevention Day) #
(1) In order to raise public awareness of injury prevention and build a national consensus for injury prevention, November 1 each year shall be designated as Injury Prevention Day.
(2) The State and local governments shall implement events, education, and promotional projects consistent with the purpose of Injury Prevention Day.
Article 5(Relationship to other statutes) #
Except as otherwise provided in other statutes, injury control shall be governed by this Act.
Article 6(Formulation of the comprehensive plan for injury control) #
(1) The Commissioner of the Korea Disease Control and Prevention Agency shall formulate a comprehensive plan for injury control (hereinafter referred to as the “comprehensive plan”) every 5 years after deliberation by the National Injury Prevention and Control Committee under Article 7. The same shall apply where important matters prescribed by Presidential Decree are modified in the comprehensive plan.
(2) The comprehensive plan shall include the following matters:
1. Basic goals and directions of injury control projects;
2. Implementation plans and methods for injury control projects;
3. Plans for training specialized human resources necessary for injury control;
4. Plans for managing statistics and information on injuries;
5. Other matters necessary for injury control.
(3) When the Commissioner of the Korea Disease Control and Prevention Agency formulates or changes the comprehensive plan under paragraph (1), they shall notify the heads of the relevant central administrative agencies and the Special Metropolitan Mayor, Metropolitan Mayors, Special Self-Governing City Mayor, Do Governors, and Special Self-Governing Province Governors (hereinafter referred to as “Mayor/Do Governor”).
(4) The heads of the relevant central administrative agencies and the Mayors/Do Governors shall formulate, implement, and evaluate annual implementation plans (hereinafter referred to as “implementation plan”) in accordance with the comprehensive plan.
(5) If necessary for the formulation of the comprehensive plan or the formulation, implementation, and evaluation of an implementation plan, the Commissioner of the Korea Disease Control and Prevention Agency, the heads of the relevant central administrative agencies, and the Mayors/Do Governors may request the provision of data and cooperation in business affairs from relevant institutions, organizations, and facilities. In such cases, the relevant institutions, etc., in receipt of such requests shall comply therewith in the absence of good cause.
(6) Matters necessary for the formulation or modification of the comprehensive plan and the formulation, implementation, and evaluation of implementation plans shall be prescribed by Presidential Decree.
Article 7(National Injury Prevention and Control Committee) #
(1) The National Injury Prevention and Control Committee (hereinafter referred to as the “Committee”) shall be established under the Korea Disease Control and Prevention Agency to deliberate on the following matters:
1. National injury control systems and institutions;
2. Formulation, modification, and evaluation of a comprehensive plan;
3. Annual implmentation plans;
4. Budget for injury control projects;
5. Other important matters regarding injury control projects referred to the Committee by the chairperson for deliberation.
(2) The Committee shall be comprised of up to 15 members, including 1 chairperson, who shall be the Commissioner of the Korea Disease Control and Prevention Agency.
(3) The members shall be appointed or commissioned by the chairperson from among the following persons:
1. Public officials of Grade III or higher belonging to a relevant central administrative agency prescribed by Presidential Decree, or public officials belonging to the Senior Civil Service;
2. Medical personnel or persons engaged in medical services related to injury control;
3. Other persons with extensive knowledge of and experience in injury control.
(4) Matters necessary for the composition and operation of the Committee shall be prescribed by Presidential Decree.
Article 8(Injury research projects) #
(1) The Commissioner of the Korea Disease Control and Prevention Agency shall implement a research and development project (hereinafter referred to as "injury research project") to identify the risk factors causing injuries, and to advance injury prevention and control technologies.
(2) The Commissioner of the Korea Disease Control and Prevention Agency may give priority support to joint research projects among academia, research institutions, and industry when promoting injury research projects.
(3) The Commissioner of the Korea Disease Control and Prevention Agency shall endeavor to promote international cooperation regarding injury research projects.
(4) Matters necessary for the procedures and methods for implementing injury research projects shall be prescribed by Presidential Decree.
Article 9(Injury survey and statistics projects) #
(1) The Commissioner of the Korea Disease Control and Prevention Agency shall continuously and systematically collect and analyze data on risk factors for the occurrence of injuries and on the occurrence, treatment, and rehabilitation of injuries, and shall implement a survey and statistics project (hereinafter referred to as “injury survey and statistics project”) to produce injury-related statistics, such as injury incidence rates, mortality rates from injuries, and disability occurrence rates due to injuries. In such cases, the Statistical Act shall apply mutatis mutandis to the collection of statistical data and the compilation of statistics.
(2) The Commissioner of the Korea Disease Control and Prevention Agency may require any of the following persons or entities to submit materials or state opinions necessary for the injury survey and statistics projects. In such cases, any person or entity requested to submit materials or state opinions shall comply therewith in the absence of good cause:
1. Medical personnel or medical institutions under the Medical Service Act who diagnose or treat injured patients;
2. The National Health Insurance Service and the Health Insurance Review and Assessment Service under the National Health Insurance Act;
3. Corporations, agencies, or organizations conducting injury control projects.
(3) Matters necessary for the timing and subjects of the injury survey and statistics projects shall be prescribed by Presidential Decree.
Article 10(Injury prevention projects) #
(1) The Commissioner of the Korea Disease Control and Prevention Agency and the Mayor/Do Governor shall implement the following projects to prevent injuries (hereinafter referred to as “injury prevention project”):
1. Collecting various information on injuries, and establishing and managing databases;
2. Providing information and counseling on injury prevention;
3. Developing educational materials on injury prevention, and providing education and publicity;
4. Training and fostering counseling personnel related to injury prevention;
5. Other projects the Commissioner of the Korea Disease Control and Prevention Agency deems necessary for injury prevention.
(2) Matters necessary for the methods and procedures for injury prevention projects shall be prescribed by Presidential Decree.
Article 11(Injury cause investigations) #
(1) Where the Commissioner of the Korea Disease Control and Prevention Agency deems it necessary to identify the risk factors for the occurrence of injuries, they may conduct an investigation into the causes of injuries (hereinafter referred to as “injury cause investigation”).
(2) Matters necessary for the methods and procedures for the injury cause investigations shall be prescribed by Presidential Decree.
Article 12(Central injury control center) #
(1) The Commissioner of the Korea Disease Control and Prevention Agency may establish and operate a central injury control center for effective injury control.
(2) A central injury control center shall conduct the following projects:
1. Research on risk factors for the occurrence of injuries and on injury prevention and control technologies;
2. Collecting, analyzing, and providing information and statistics related to injuries;
3. Education and publicity on injury prevention;
4. Training human resources specialized in injury control;
5. Supporting regional injury control centers under Article 13;
6. Other projects necessary for injury control, as prescribed by Decree of the Ministry of Health and Welfare.
(3) The Commissioner of the Korea Disease Control and Prevention Agency may entrust the establishment and operation of the central injury control center under paragraph (1) to any of the following institutions, corporations, or organizations that have the specialized human resources and facilities necessary for such work:
1. Hospital-level medical institutions under Article 3 (2) 3 of the Medical Service Act;
2. National or public research institutions or government-funded research institutions under the Act on the Establishment, Operation and Fostering of Government-Funded Research Institutions;
3. Non-profit corporations or organizations related to injury control established under the Civil Act or any other statute;
4. Other institutions or organizations prescribed by Presidential Decree.
(4) Matters necessary for the establishment and operation of the central injury control center under paragraph (1), the entrustment under paragraph (3), and other relevant matters shall be prescribed by Decree of the Ministry of Health and Welfare.
Article 13(Regional injury control centers) #
(1) The Mayor/Do Governor may, in consultation with the Commissioner of the Korea Disease Control and Prevention Agency, establish and operate a regional injury control center to perform the following duties related to injury control:
1. Supporting injury research projects and injury survey and statistics projects;
2. Identifying, monitoring, and controlling injury risk factors within their jurisdiction;
3. Education and publicity on injury prevention;
4. Supporting injury cause investigations;
5. Education and training for human resources specialized in injury control;
6. Other duties that the Mayor/Do Governor deems necessary for damage control.
(2) The Mayor/Do Governor may entrust the establishment and operation of the regional injury control center to any of the following institutions, corporations, or organizations that have the specialized human resources and facilities necessary for such work:
1. Hospital-level medical institutions under Article 3 (2) 3 of the Medical Service Act;
2. National or public research institutions or government-funded research institutions under the Act on the Establishment, Operation and Fostering of Government-Funded Research Institutions;
3. Non-profit corporations or organizations related to injury control established under the Civil Act or any other statute;
4. Other institutions or organizations prescribed by Presidential Decree.
(3) Matters necessary for the establishment and operation of the regional injury control center under paragraph (1), the entrustment under paragraph (2), and other relevant matters shall be prescribed by ordinance of the relevant local government, as prescribed by Decree of the Ministry of Health and Welfare.
Article 14(Support for expenses) #
The State and local governments may subsidize all or part of the expenses falling under the following subparagraphs for persons engaged in injury control projects:
1. Expenses incurred in conducting injury research projects, injury survey and statistics projects, injury prevention projects, and injury cause investigations;
2. Expenses incurred in establishing and operating central injury control centers and regional injury control centers;
3. Expenses incurred by corporations or organizations entrusted with injury control projects in performing such entrusted duties.
Article 15(Guidance and supervision) #
(1) The Commissioner of the Korea Disease Control and Prevention Agency or the Mayor/Do Governor may provide guidance and supervision with respect to the duties of persons engaged in injury control-related work under their jurisdiction, and if necessary, may require such persons to report on such duties or to submit relevant documents, or may have their public officials question relevant persons about such duties or inspect relevant documents.
(2) Any public official conducting an inspection under paragraph (1) shall carry identification verifying their authority and present it to the relevant persons.
Article 16(Delegation and entrustment) #
(1) The Commissioner of the Korea Disease Control and Prevention Agency may delegate part of their authority or duties under this Act to the head of an affiliated agency or to the Mayor/Do Governor, or entrust such authority or duties to a corporation or organization related to injury control, as prescribed by Presidential Decree.
(2) The Mayor/Do Governor may delegate part of their authority or duties under this Act to the head of a Si/Gun/Gu (referring to the head of an autonomous Gu) or entrust such authority or duties to a corporation or organization related to injury control, as prescribed by Presidential Decree.
Article 17(Duty of confidentiality) #
No person who is or was engaged in injury control projects under this Act shall divulge any confidential information obtained in the course of their duties or use it for any other purpose.
Article 18(Penalty provisions) #
Any person who divulges any confidential information or uses it for any other purpose, in violation of Article 17, shall be punished by imprisonment with labor for not more than 3 years or by a fine not exceeding 30 million won.
