ACT ON THE PROMOTION OF AND SUPPORT FOR UTILIZATION OF URBAN AIR MOBILITY

CHAPTER I GENERAL PROVISIONS

Article 1(Purpose) #

The purpose of this Act is to promote and support the utilization of urban air mobility, by prescribing matters necessary for introducing and proliferating urban air mobility and creating and supporting infrastructure for the safe and efficient navigation of UAM aircraft, thereby contributing to and enhancing the people‘s right to mobility and to developing the national economy.

Article 2(Definitions) #

The terms used in this Act are defined as follows:

1. The term "urban air mobility" means systems to utilize, manage, or operate individual or organically-connected UAM aircraft, vertiport, and urban air mobility corridor for the purpose of performing activities related to transportation of people or cargo;

2. The term "UAM aircraft" means aircraft defined in subparagraph 1 of Article 2 of the Aviation Safety Act or equivalent devices suitable for operation in an urban area, which is publicly notified by the Minister of Land, Infrastructure and Transport after deliberation by the National Transport Commission established under Article 106 of the National Transport System Efficiency Act (hereinafter referred to as the "National Transport Committee");

3. The term "vertiport" means facilities prescribed by Presidential Decree, such as certain facilities and office facilities used for the takeoff, landing, and navigation of UAM aircraft, which are designated and publicly notified by the Minister of Land, Infrastructure and Transport pursuant to Article 12;

4. The term "urban air mobility corridor" means a path in a space marked in the air above the surface of a district designated by the Minister of Land, Infrastructure and Transport as suitable for the navigation of UAM aircraft;

5. The term "urban air mobility industry" means any of the following industries:

a. Industries related to the development (including the development of materials, parts, and equipment related to of fuselage of UAM aircraft) of UAM aircraft;

b. Industries related to development, construction, operation, management, utilization, etc. of urban air mobility;

6. The term "demonstration project zone" means an area designated pursuant to Article 6 as an area to which regulatory exemptions apply for the promotion of standard research and test operation related to the safety verification and operation of urban air mobility;

7. The term "pilot operation zone" means an area designated pursuant to Article 8 as an area to which regulatory exemptions apply with regards to affairs prescribed by Presidential Decree, such as transportation of people or cargo, tourist flights, flight training, search, rescue, relief, medical treatment, and emergency evacuation to promote the commercialization of urban air mobility;

8. The term "urban air mobility services" means any of the following projects:

a. Urban air mobility transport services: Project of transporting people or cargo by using UAM aircraft to meet the demand of others, which provides any of the following flights using UAM aircraft:

1) Scheduled flights: Flights of UAM aircraft operated in accordance with a regular flight plan on specific routes between vertiports;

2) Non-scheduled flights: Operation of UAM aircraft other than regular flights;

b. Urban air mobility air traffic management services: Project providing traffic management services, such as providing information necessary for safe operation of UAM aircraft, managing traffic flow, approval of flight plans, and monitoring deviations from the urban air mobility corridor;

c. Vertiport operation and management service: Project operating and managing vertiports designated and publicly notified pursuant to Article 12;

d. UAM aircraft rental services: Project other than urban mobility transport services, prescribed by Decree of the Ministry of Land, Infrastructure and Transport, such as search and rescue, medical treatment, evacuation of emergency patients, using UAM aircraft to meet the demand of others, or flight training using UAM aircraft;

e. Other projects prescribed by Presidential Decree in relation to the urban air mobility services;

9. The term "vertiport development project" means a business developing and constructing vertiports for the efficient handling of urban air mobility, such as safe takeoff, landing, and navigation of UAM aircraft, and transfer to other means of transportation, and for the construction of commercial, business, cultural, and tourism facilities, etc.;

10. The term "urban air mobility spatial data" means information necessary for urban air mobility, such as location information, weather and noise information, etc.;

11. The term "regulatory exemptions" means the relaxation or exclusion of regulations in a demonstration project zone or a pilot operation zone, which is prescribed in Articles 15 and 16.

Article 3(Relationship to other statutes) #

This Act shall prevail over other statutes regarding regulatory exemptions in demonstration project zones and pilot operation zones; provided, where more lenient provisions exist in any other statute than the regulatory exemptions prescribed in this Act, such provisions shall govern.

CHAPTER IV SUPPLEMENTARY PROVISIONS

Article 26(Hearings) #

The Minister of Land, Infrastructure and Transport shall hold a hearing to make any of the following dispositions:

1. Revocation of designation of demonstration project operators or suspension of projects under Article 7(4);

2. Revocation of permission for the vertiport development project under Article 10(2);

3. Revocation of designation of urban air mobility service providers or suspension of services under Article 14(5);

4. Revocation of designation as an institution for training specialized human resources under Article 24(5).

Article 27(Entry inspection) #

(1) If necessary for the enforcement of this Act, the Minister of Land, Infrastructure and Transport may require air mobility service providers to file the necessary report or submit materials on the relevant affairs; and may require that public officials affiliated therewith access offices or other places to inspect the relevant affairs.

(2) Public officials conducting an inspection under paragraph (1) shall carry a document indicating his or her authority for the inspection and present it to interested parties.

(3) Matters necessary for the identification under paragraph (2) shall be prescribed by Decree of the Ministry of Land, Infrastructure and Transport.

(4) No person shall refuse, interfere with, or evade an inspection or access under paragraph (1).

Article 28(Delegation of authority and entrustment of business affairs) #

(1) The Minister of Land, Infrastructure and Transport may delegate part of his or her authority vested under this Act to the head of an agency under his or her management or the Mayor/Do Governor, as prescribed by Presidential Decree.

(2) The Minister of Land, Infrastructure and Transport may entrust part of his or her duties imposed under this Act to an institution or organization related to urban air mobility, as prescribed by Presidential Decree.

Article 29(Legal fiction of public officials for purposes of applying penalty provisions) #

The executive officers and employees of the relevant institutions, organizations, etc. engaged in the duties entrusted by the Minister of Land, Infrastructure and Transport pursuant to Article 28(2) shall be deemed public officials for the purposes of Article 127 and 129 through 132 of the Criminal Act.

Article 30(Penalty provisions) #

(1) Any urban air mobility project operator who fails to purchase liability insurance and operates a UAM aircraft in violation of Article 21 shall be punished by imprisonment with labor for not more than 2 years or by a fine not exceeding 20 million won.

(2) A person who implements a vertiport development project without obtaining permission in violation of Article 9(2) shall be punished by a fine not exceeding 20 million won.

(3) A person who refuses, interferes with, or avoids an inspection or access in violation of Article 27(4) shall be punished by a fine not exceeding 5 million won.

Article 31(Administrative fines) #

(1) A person who uses a vertiport before receiving a certificate of confirmation of completion, or uses a vertiport without obtaining permission for use, in violation of Article 9(12) shall be punished by an administrative fine not exceeding 5 million won.

(2) Administrative fines under paragraph (1) shall be imposed and collected by the Minister of Land, Infrastructure and Transport, as prescribed by Presidential Decree.
