Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Act on Assistance to and Commemorative Programs for Miners, Nurses and Practical Nurses Sent to Germany and matters necessary for the enforcement thereof.
Article 2(Assistance to eligible persons) #
The Minister of Employment and Labor may provide assistance, such as the provision of information about social services and statutes or regulations governing people’s everyday lives, and educational materials through its official website, etc., to persons eligible for assistance (hereinafter referred to as “persons eligible for assistance”) under Article 2 of the Act on Assistance to and Commemorative Programs for Miners, Nurses and Practical Nurses Sent to Germany (hereinafter referred to as the “Act”), in accordance with Article 3 (1) of the Act.
Article 3(Hearing opinions on commemorative programs) #
The Minister of Employment and Labor may hear opinions from entities or organizations related to persons eligible for assistance, relevant experts, etc., if necessary to efficiently implement programs under the subparagraphs of Article 4 (1) of the Act.
Article 4(Subsidization of expenses) #
“Corporation or an organization that meets the requirements prescribed by Presidential Decree” in Article 5 of the Act means a corporation or organization that meets all of the following requirements:
1. It shall be a corporation or organization established for the purpose of operating programs prescribed in Article 4 (1) 1 through 4 of the Act or a corporation or organization with a track record of operating programs related thereto;
2. It shall be any of the following corporations or organizations:
a. A public institution under Article 4 of the Act on the Management of Public Institutions;
b. A public interest corporation under Article 2 of the Act on the Establishment and Operation of Public Interest Corporations;
c. A non-profit corporation under Article 32 of the Civil Act;
d. A non-profit, non-governmental organization defined in Article 2 of the Assistance for Non-Profit, Non-Governmental Organizations Act.
Article 5(Cooperation from relevant entities) #
The Minister of Employment and Labor may, if necessary to perform the business affairs prescribed in Articles 3 through 5 of the Act, request the heads of relevant central administrative agencies to provide necessary cooperation. In such cases, the heads of the relevant central administrative agencies requested to provide cooperation shall comply therewith, unless there is a compelling reason not to do so.
Article 6(Entrustment of business affairs) #
In accordance with Article 6 of the Act, the Minister of Employment and Labor shall entrust the following business affairs to the Human Resources Development Service of Korea established under the Human Resources Development Service of Korea Act:
1. Providing assistance to persons eligible for assistance under Article 3 of the Act;
2. Implementing programs, such as commemorative programs under Article 4 of the Act.
Article 7(Processing of personally identifiable information) #
The Minister of Employment and Labor (including persons entrusted with the affairs of the Minister of Employment and Labor under Article 6 of the Act) may process data containing resident registration numbers, passport numbers, or alien registration numbers under subparagraph 1, 2, or 4 of Article 19 of the Enforcement Decree of the Personal Information Protection Act, if unavoidable to perform the following affairs:
1. Provision of assistance to persons eligible for assistance under Article 3 of the Act;
2. Implementation of programs, such as commemorative programs under Article 4 of the Act;
3. Subsidization of expenses under Article 5 of the Act.
