Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Act on the Promotion and Support of the Beekeeping Industry and matters necessary for the enforcement thereof.
Article 2(By-Products of Beekeeping) #
"Beekeeping by-products prescribed by Presidential Decree" in subparagraph 1 (b) of Article 2 of the Act on the Promotion and Support of the Beekeeping Industry (hereinafter referred to as the "Act") means any of the following:
1. Honeybee hives;
2. Larvae and adults of honeybees and pupae of honeybees other than drone bees.
Article 3(Formulation and Implementation of Master Plan and Implementation Plan) #
(1) Where the Minister of Agriculture, Food and Rural Affairs formulates a master plan for fostering and supporting the beekeeping industry (hereinafter referred to as "master plan") and an implementation plan (hereinafter referred to as "implementation plan") pursuant to Article 5 (1) and (3) of the Act, he or she shall notify the heads of relevant central administrative agencies, the Special Metropolitan City Mayor, Metropolitan City Mayors, Do Governors (hereinafter referred to as "Mayors/Do Governors"), Special Self-Governing City Mayors, and Special Self-Governing Province Governors of the details thereof.
(2) The evaluation items of performance results under Article 5 (3) of the Act shall be as follows:
1. Level of achievement of goals in the master plan and the implementation plan;
2. The appropriateness of the implementation system and the financing and allocation of resources.
(3) The Minister of Agriculture, Food and Rural Affairs shall evaluate the performance results of implementation plans for the evaluation items under the subparagraphs of paragraph (2) and reflect such results in the implementation plans for the following year pursuant to Article 5 (3) of the Act.
Article 4(Scope and Methods of Fact-Finding Survey) #
(1) The scope of fact-finding surveys on the current status, etc. of the beekeeping industry under Article 6 (1) of the Act (hereinafter referred to as “fact-finding survey”) shall be as follows:
1. Current status of raising and selling honeybees in bee farms;
2. Production volume, sales volume, and sales amount of beekeeping products and by-products of bee farms;
3. Current status of production, processing, distribution, and sales of beekeeping products and by-products;
4. Distribution status of bee plants by region and type;
5. Other matters necessary for the formulation and implementation of master plans and implementation plans.
(2) The fact-finding survey shall be conducted pursuant to the following classification:
1. Regular survey: It shall be conducted every 5 years, but shall be conducted in the year in which a master plan is formulated;
2. Occasional survey: It shall be conducted when deemed necessary by the Minister of Agriculture, Food and Rural Affairs.
Article 5(Designation of Institutions for Training Specialized Human Resources) #
(1) The requirements for designation of an institution for training specialized human resources under Article 7 (2) of the Act shall be as specified in attached Table 1.
(2) A person who intends to be designated as an institution for training specialized human resources under Article 7 (2) of the Act shall submit an application for designation prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs to the Minister of Agriculture, Food and Rural Affairs, a Mayor/Do Governor, a Special Self-Governing City Mayor, a Special Self-Governing Province Governor, or the head of a Si/Gun/Gu (referring to the head of an autonomous Gu; hereinafter referred to as "head of a Si/Gun/Gu"), along with the following documents:
1. Education plan including the curriculum thereof;
2. Current status of holding educational facilities and equipment;
3. Current status of securing exclusive faculty members;
4. A plan to finance operating expenses.
(3) Where the Minister of Agriculture, Food and Rural Affairs, a Mayor/Do Governor, or the head of a Si/Gun/Gu designates an institution for training specialized human resources pursuant to Article 7 (2) of the Act, he or she shall issue a certificate of designation prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs and post the fact on the website of the Ministry of Agriculture, Food and Rural Affairs, the relevant City/Do, or Si/Gun/Gu.
(4) Items for which the Minister of Agriculture, Food and Rural Affairs, a Mayor/Do Governor, or the head of a Si/Gun/Gu may fully or partially subsidize expenses pursuant to Article 7 (3) of the Act shall be as follows:
1. Lecture fees, travel expenses, manuscript fees, and training allowances;
2. Expenses incurred in producing teaching materials and purchasing equipment and materials for practice;
3. Other items deemed necessary for education and training.
Article 6(Revocation of Designation of Institutions for Training Specialized Human Resources) #
(1) "Other cases prescribed by Presidential Decree" in Article 7 (4) 5 of the Act means any of the following cases:
1. Where it has used the subsidized expenses for other purposes;
2. Where it fails to comply with corrective orders under the main sentence of Article 7 (4) of the Act.
(2) Where the Minister of Agriculture, Food and Rural Affairs, the Mayor/Do Governor, or the head of a Si/Gun/Gu issues an order to take corrective measures pursuant to the main sentence of Article 7 (4) of the Act, he or she shall do so in writing stating the following matters:
1. Violations of the Act;
2. Details of corrective orders;
3. Deadline for performance of corrective orders;
4. Measures in cases of failing to comply with corrective orders.
(3) The criteria for the revocation of designation and corrective orders under Article 7 (4) of the Act shall be as specified in attached Table 2.
(4) Where the Minister of Agriculture, Food and Rural Affairs, a Mayor/Do Governor, or the head of a Si/Gun/Gu revokes the designation of an institution for training specialized human resources pursuant to Article 7 (4) of the Act, he or she shall notify the head of the institution for training specialized human resources of the fact without delay and post it on the website of the Ministry of Agriculture, Food and Rural Affairs, the relevant City/Do, or Si/Gun/Gu.
Article 7(Delegation of Authority) #
(1) The Minister of Agriculture, Food and Rural Affairs shall delegate the following authorities to the Administrator of the Rural Development Administration pursuant to Article 18 (1) of the Act:
1. Conducting of fact-finding surveys and request for relevant data under Article 6 (1) and (2) of the Act (excluding the forest sector);
2. Designation of institutions for training specialized human resources, subsidization of expenses, revocation of designation, or corrective orders under Article 7 (2) through (4) of the Act (excluding the forest sector);
3. Research and technology development under Article 9 of the Act (excluding the forest sector).
(2) The Minister of Agriculture, Food and Rural Affairs shall delegate the following authorities to the Minister of the Korea Forest Service pursuant to Article 18 (1) of the Act:
1. Conducting of fact-finding surveys and request for relevant data under Article 6 (1) and (2) of the Act (limited to the forest sector);
2. Designation of institutions for training specialized human resources, subsidization of expenses, revocation of designation, or corrective orders under Article 7 (2) through (4) of the Act (limited to the forest sector);
3. Research and technology development under Article 9 of the Act (limited to the forest sector);
4. Expansion of bee plants (limited to trees) under Article 10 (1) of the Act.
Article 8(Handling of Personally Identifiable Information) #
If it is deemed inevitable for carrying out the following administrative affairs, the head of a Si/Gun/Gu may handle materials containing a resident registration number under subparagraph 1 of Article 19 of the Enforcement Decree of the Personal Information Protection Act:
1. Affairs concerning the registration of bee farms and reporting on modification thereof under Article 13 of the Act;
2. Affairs of reporting on succession of the status of a business operator under Article 14 of the Act.
Article 9(Standards for Imposition of Administrative Fines) #
The criteria for imposing administrative fines under Article 20 (1) of the Act shall be as specified in attached Table 3.
