Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by Article 33 of the Act on the Organization and Operation of National Police and Autonomous Police and matters necessary for the enforcement thereof. <Amended on Dec. 31, 2020>
Article 2(Relationship to other statutes or regulations) #
Except as provided in this Decree, matters relating to the promotion of science and technology in public security, management of contributions, etc. shall be governed by the National Research and Development Innovation Act. <Amended on Dec. 29, 2020>
Article 3(Formulation of comprehensive and action plans for promotion of science and technology in public security) #
(1) The Commissioner General of the Korean National Police Agency shall formulate a comprehensive plan to promote science and technology in public security (hereafter in this Article referred to as the "comprehensive plan") every 5 years as part of policy measure to promote science and technology in public security under Article 33 (1) of the Act on the Organization and Operation of National Police and Autonomous Police (hereinafter referred to as the "Act"). <Amended on Dec. 31, 2020>
(3) The comprehensive plan shall include the following:
1. The current status and future prospects of science and technology in public security;
2. Development direction and goals for science and technology in public security;
3. Analysis of domestic and international science and technology landscape in public security and policy measures for strengthening competitiveness;
4. Strategies for developing key technologies in science and technology in public security;
5. Plans for training specialized human resources in science and technology in public security;
6. A mid- to long-term investment plan for the promotion of science and technology in public security;
7. Other matters deemed necessary by the Commissioner General of the Korean National Police Agency for the promotion of science and technology in public security.
(3) The Commissioner General of the Korean National Police Agency shall formulate and implement an annual action plan (hereafter in this Article referred to as the "action plan") in accordance with the comprehensive plan.
(4) The action plan shall include the following:
1.The direction of science and technology development, etc. in public security in the relevant year;
2. A detailed sectoral plan for the promotion of science and technology in public security;
3. An investment plan for each major science and technology research and development project in public security;
4. Other matters deemed necessary by the Commissioner General of the Korean National Police Agency for the promotion of science and technology in public security.
(5) Except as provided in paragraphs (1) through (4), the Commissioner General of the Korean National Police Agency shall determine matters necessary for the formulation and implementation of the comprehensive and action plans.
Article 4(Conclusion of agreements) #
(1) An agreement under Article 33 (2) of the Act shall be concluded between the Commissioner General of the Korean National Police Agency and the head of an institution, organization, etc. (hereinafter referred to as "supervising research institute") that supervises and conducts the relevant research from among the institutions falling under any of the subparagraphs of that paragraph. <Amended on Dec. 31, 2020>
(2) If expenses incurred in conducting research include contributions from entities other than the Government or the technology development expenses from enterprises (including in-kind contribution), the head of the supervising research institute shall enter into a prior contract with the entity bearing the costs before concluding the agreement under paragraph (1).
(3) The agreement referred to in paragraph (1) shall include the matters referred to in the subparagraphs of Article 11 (1) of the National Research and Development Innovation Act. In such cases, the research and development plan referred to in Article 9 (2) of the Enforcement Decree of the National Research and Development Innovation Act shall include the scope of research tasks, methods of performing those tasks, and matters relating to the person in charge of the research. <Amended on Dec. 29, 2020>
Article 5(Scope of research institutes and organizations eligible for agreements) #
The institutions or organizations that conduct research, investigations, technology development, etc. related to public security pursuant to Article 33 (2) 7 of the Act shall be as follows: <Amended on Dec. 31, 2020; Oct. 19, 2021>
1. Public institutions under Article 4 of the Act on the Management of Public Institutions;
2. Industrial technology research cooperatives under the Industrial Technology Research Cooperatives Support Act;
3. Specialized research business entities reported pursuant to Article 6 (1) of the Research Industry Promotion Act;
4. Medical corporations under Article 14 (1) 6 of the Basic Research Promotion and Technology Development Support Act;
5. Domestic and foreign research institutes or organizations that meet all of the following requirements:
(a) They shall employ at least 5 dedicated researchers with at least 3 years of research experience in the relevant field after obtaining a bachelor's degree or higher in science and technology;
(b) They shall possess research facilities and equipment necessary for conducting research, investigations, technology development, etc. related to public security.
Article 6(Payment and management of contributions) #
(1) If the Commissioner General of the Korean National Police Agency pays contributions pursuant to Article 33 (3) of the Act to a supervising research institute that has concluded an agreement under Article 4 (1), he or she may make the payment in a lump sum or in installments, taking into consideration the scale of the research and development project, the timing of commencement of the project, the Government’s financial conditions, etc. <Amended on Dec. 31, 2020>
(2) Upon receiving contributions under paragraph (1), the head of a supervising research institute shall manage the contributions by opening a separate account and shall keep evidentiary materials when using the contribution.
(3) Interest accrued from the contributions disbursed pursuant to paragraph (1) shall be used for the purposes determined by the Commissioner General of the Korean National Police Agency, such as re-investment in research and development.
Article 7(Use of contributions and performance reporting) #
(1) Upon receiving contributions under Article 6 (1), the head of a supervising research institute shall use the contributions exclusively for the following purposes:
1. Personnel expenses for researchers;
2. Direct expenses such as research equipment and materials expenses, research activity expenses, and research allowances;
3. Indirect expenses, such as support for human resources, research support, utilization of research outcomes, and expenses for application for and registration of intellectual property rights;
4. Expenses for commissioned research and development.
(2) The head of a supervising research institute shall submit a report on the use of contributions to the Commissioner General of the Korean National Police Agency within 3 months after the end of the agreement period (referring to the agreement period for the relevant year in cases of a multi-year agreement task).
(3) If a supervising research institute falls under any of the following cases, the Commissioner General of the Korean National Police Agency shall recover an amount equivalent to the Government’s contributions from the relevant amount. In such cases, the Commissioner General of the Korean National Police Agency may terminate the agreement with the relevant research institute or may restrict its participation in a research and development project supported by the Commissioner General, in accordance with the agreement under Article 4 (1):
1. Where the institute uses the contributions for any purpose other than those referred to in paragraph (1) without good cause;
2. Where the institute uses the contributions by fraud or other improper means.
