Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Act on Prevention of Accidents at Coastal Sea and matters necessary for the enforcement thereof.
Article 2(Modification of important matters in master plans for prevention of accidents at coastal sea) #
"Important matters prescribed by Presidential Decree" in the latter part of Article 5(2) of the Act on Prevention of Accidents at Coastal Sea (hereinafter referred to as the "Act") means the following:
1. Matters related to establishing a safety system necessary to prevent accidents at coastal sea;
2. Matters related to developing and managing professional human resources to prevent accidents at coastal sea.
Article 3(Composition and functions of Central Council for Prevention of Accidents at Coastal Sea) #
(1) The Central Council for the Prevention of Accidents at Coastal Sea (hereinafter referred to as the "Central Council") under Article 8(1) of the Act shall consist of up to 35 members, including 1 chairperson. <Amended on Apr. 18, 2017; Oct. 4, 2022>
(2) The Deputy Commissioner General of the Korea Coast Guard shall serve as the chairperson of the Central Council. <Amended on Nov. 19, 2014; Jul. 20, 2015; Jul. 26, 2017; Oct. 4, 2022>
(3) Members of the Central Council shall be appointed or commissioned by the Commissioner General of the Korea Coast Guard from among the following persons: <Amended on Nov. 19, 2014; Jul. 20, 2015; Apr. 18, 2017; Jul. 26, 2017; Jun. 4, 2024; Dec. 24, 2024>
1. Public officials belonging to the Senior Executive Service of the Ministry of Education, the Ministry of National Defense, the Ministry of the Interior and Safety, the Ministry of Culture, Sports and Tourism, the Ministry of Health and Welfare, the Ministry of Gender Equality and Family, the Ministry of Oceans and Fisheries, or the National Fire Agency (including public officials in special service and extraordinary civil service equivalent thereto), who are recommended by the head of their respective agency;
2. Senior Superintendents General or Superintendents General who are in charge of preventing accidents at coastal sea from among police officials of the Korea Coast Guard;
3. Assistant Fire Commissioners or Chief Superintendents who are in charge of preventing accidents at coastal sea, from among firefighting officials of the National Fire Agency;
3-2. Public officials of Grade III or higher in general service (including public officials in special service and extraordinary civil service equivalent thereto) of Busan Metropolitan City, Incheon Metropolitan City, Ulsan Metropolitan City, Gyeonggi-do, Gangwon State, Chungcheongnam-do, Jeonbuk State, Jeollanam-do, Gyeongsangbuk-do, Gyeongsangnam-do, or Jeju Special Self-Governing Province, who are in charge of preventing accidents at coastal sea and are recommended by the head of the relevant local government;

(5) The Central Council shall hold consultations on the following matters: <Amended on Sep. 2, 2025>
1. Matters regarding the formulation of a master plan for the prevention of accidents at coastal sea under Article 5(1) of the Act and an implementation plan for the prevention of accidents at coastal sea under Article 7(1) of the Act;
2. Matters regarding the modification of a master plan for the prevention of accidents at coastal sea under Article 5(1) of the Act;
3. Matters regarding the formulation and amendment of the Safety Management Regulations for Accidents at Coastal Sea under Article 9(1) of the Act (hereinafter referred to as the "Safety Management Regulations");

5. Other matters referred by the chairperson to the Central Council for consultation in relation to the prevention of accidents at coastal sea.

Article 3-2(Dismissal of members of Central Council) #
The Commissioner General of the Korea Coast Guard may dismiss a member specified in Article 3(3)1, in any of the following cases: <Amended on Apr. 18, 2017; Jul. 26, 2017; Oct. 14, 2021; Oct. 4, 2022>
1. Where the member becomes unable to perform his or her duties due to a physical or mental disability;
2. Where the member is involved in any misconduct related to his or her duties;
3. Where the member is deemed unfit to serve due to negligence in duties, conduct prejudicial to dignity, or any other similar reason;
4. Where the member declares that it is impracticable to continue performing his or her duties.

Article 3-3(Operation of Central Council) #
(1) A regular meeting of the Central Council shall be held once a year, and a special meeting shall be held if the chairperson deems it necessary.
(2) A majority of the members of the Central Council shall constitute a quorum, and any decision thereof shall require the concurring vote of a majority of those present.
(3) The Central Council shall have 1 executive secretary to handle matters subject to consultation, and the executive secretary shall be appointed by the Commissioner General of the Korea Coast Guard from among police officials of the Korea Coast Guard.
(4) If necessary for consultation on agenda items, the chairperson of the Central Council may invite relevant experts to attend a meeting and hear their opinions. <Added on Oct. 4, 2022>
(5) Except as provided in paragraphs (1) through (4), matters necessary for the operation of the Central Council shall be determined by the chairperson after resolution by the Central Council. <Amended on Oct. 4, 2022>

Article 4(Composition and functions of interregional councils for prevention of accidents at coastal sea and regional councils for prevention of accidents at coastal sea) #
(1) An interregional council for the prevention of accidents at coastal sea and a regional council for the prevention of accidents at coastal sea under Article 8(1) of the Act shall each consist of up to 20 members, including 1 chairperson. <Amended on Apr. 18, 2017; Oct. 14, 2021; Oct. 4, 2022>
(2) The Commissioner of a Regional Korea Coast Guard shall serve as the chairperson of an interregional council for the prevention of accidents at coastal sea under Article 8(1) of the Act (hereinafter referred to as "interregional council"). <Amended on Nov. 19, 2014; Jul. 20, 2015; Jul. 26, 2017; Oct. 14, 2021; Oct. 4, 2022>
(3) Members of an interregional council shall be appointed or commissioned by the Commissioner of a Regional Korea Coast Guard from among the following persons: <Amended on Nov. 19, 2014; Jul. 20, 2015; Jul. 26, 2017; Oct. 14, 2021>
1. Public officials of Grade IV or higher in general service (including public officials in special service and extraordinary civil service equivalent thereto) of a Regional Office of Oceans and Fisheries or local government within the jurisdiction of the Regional Korea Coast Guard, who are in charge of preventing accidents at coastal sea and are recommended by the head of the Regional Office of Oceans and Fisheries or the local government;
2. Military personnel (referring to those of a rank equivalent to that of public officials of Grade IV or higher in general service) belonging to any of the following military units whose jurisdiction for operations, training, or other purposes covers that of the Regional Korea Coast Guard, who are recommended by the head of their military unit:
a. Army division-level units;
b. Navy fleet-level or division-level units;
3. Police officials of the rank of Senior Superintendent or higher belonging to a Regional Korea Coast Guard, who are in charge of preventing accidents at coastal sea;

(4) The chief of a coast guard station shall serve as the chairperson of a regional council for the prevention of accidents at coastal sea under Article 8(1) of the Act (hereinafter referred to as "regional council"). <Added on Oct. 14, 2021; Oct. 4, 2022>
(5) Members of a regional council shall be appointed or commissioned by the chief of a coast guard station from among the following persons: <Added on Oct. 14, 2021>
1. Public officials of Grade V or higher in general service (including public officials in special service and extraordinary civil service equivalent thereto) of a Regional Office of Oceans and Fisheries or local government within the jurisdiction of a coast guard station, who are in charge of preventing accidents at coastal sea and are recommended by the head of the Regional Office of Oceans and Fisheries or the local government;
2. Military personnel (referring to those of a rank equivalent to that of public officials of Grade V or higher in general service) belonging to any of the following military units whose jurisdiction for operations, training, or other purposes covers that of a coast guard station, who are recommended by the head of their military unit:
a. Army regiment-level units;
b. Navy flotilla-level or squadron-level units;
3. Police officials of the rank of Superintendent or higher belonging to a coast guard station, who are in charge of preventing accidents at coastal sea;

(7) An interregional council and a regional council shall consult on the following matters under the jurisdiction of the competent Regional Korea Coast Guard or coast guard station: <Amended on Nov. 19, 2014; Jul. 26, 2017; Oct. 14, 2021>
1. Matters regarding the implementation of the Safety Management Regulations;
2. Matters regarding coastal sea experience activities;
3. Matters regarding measures to prevent accidents at coastal sea and their recurrence;
4. Other matters referred by the chairperson to the competent interregional council or regional council for consultation in relation to the prevention of accidents at coastal sea.

Article 4-2(Dismissal of members of interregional councils and regional councils) #

Article 5(Coastal sea experience activities requiring insurance coverage) #
Coastal sea experience activities for which the operator of coastal sea experience activities under Article 11(2) of the Act (hereinafter referred to as the "operator of coastal sea experience activities") is required to obtain insurance or mutual aid coverage under Article 13(1) of the Act (hereinafter referred to as "insurance, etc.") shall be those conducted on or under water. <Amended on Oct. 17, 2017; Sep. 2, 2025>

Article 6(Insurance coverage amount) #
The amount of insurance, etc. that an operator of coastal sea experience activities is required to purchase under Article 13(1) of the Act shall be at least the amount prescribed in Article 3(1) of the Enforcement Decree of the Compulsory Motor Vehicle Liability Security Act. <Amended on Oct. 17, 2017; Oct. 14, 2021>

Article 6-2(Provision of information on purchase of insurance) #
(1) An operator of coastal sea experience activities shall post information on the policy period, coverage, amount, and other relevant details of insurance, etc. under Article 13- 2(1) of the Act in a conspicuous place within the place of business.
(2) Except as provided in paragraph (1), matters necessary for providing information on the purchase of insurance, etc. shall be prescribed by Decree of the Ministry of Oceans and Fisheries.

Article 7(Restrictions on coastal sea experience activities) #
"Cases prescribed by Presidential Decree" in Article 14(1)4 of the Act means any of the following cases: <Amended on Nov. 19, 2014; Jan. 22, 2016; Jul. 26, 2017>
1. Where a death or disappearance occurs during coastal sea experience activities;
2. Where a distress incident under subparagraph 5 of Article 2 of the Act on the Search and Rescue in Waters or a marine accident under subparagraph 1 of Article 2 of the Act on the Investigation of and Inquiry into Marine Accidents occurs near a coastal sea area where coastal sea experience activities are conducted, and restrictions are necessary for managing such incident or accident;
3. When there is heavy maritime traffic in a coastal sea area where coastal sea experience activities are conducted;
4. Where the chief of a coast guard station deems it necessary to restrict coastal sea experience activities in order to prevent accidents at coastal sea.
Article 8(Qualifications of coastal patrol officers) #
A coastal patrol officer under Article 16(2) of the Act (hereinafter referred to as "coastal patrol officer") shall be a police official of the Korea Coast Guard or its affiliated agencies (hereinafter referred to as "Korea Coast Guard official") who holds the qualifications of a life guard under Article 26(1)1 of the Enforcement Decree of the Water-Related Leisure Activities Safety Act, and meets all of the following requirements: <Amended on Nov. 19, 2014; Jan. 22, 2016; Jul. 26, 2017; Oct. 14, 2021; Jun. 7, 2023>
1. A person shall fall under any of the following categories:
a. A person who has served for at least 2 years at a Korea Coast Guard substation or branch that has jurisdiction over the area to which the person is to be assigned as a coastal patrol officer;
b. A person who has served for at least 2 years as a member of a Korea Coast Guard rescue team under Article 16(1)1 of the Enforcement Decree of the Act on the Search and Rescue in Waters, which has jurisdiction over the area to which the person is to be assigned as a coastal patrol officer;
c. A person who has served for at least 2 years on a Korea Coast Guard vessel of less than 100 tons;
d. A person who holds the qualification of an emergency medical technician under Article 36 of the Emergency Medical Service Act;
2. A person shall hold any of the following licenses:
a. A Class 1 driver's license for large or ordinary motor vehicles under Article 80(2)1 of the Road Traffic Act;
b. A general operator license under Article 5(2)1 of the Water-Related Leisure Activities Safety Act.

Article 9(Duties of coastal patrol officers) #
(1) The duties of coastal patrol officers shall be as follows: <Amended on Sep. 2, 2025>
1. Implementation of the Safety Management Regulations, such as patrolling coastal sea areas and engaging in prevention of accidents at coastal sea;
2. Management of access-controlled areas under Article 10 of the Act;
3. Prohibition or restriction of coastal sea experience activities under Article 14 of the Act;
4. Safety inspections of coastal sea experience activities under Article 15 of the Act;
5. Emergency rescue and other relief measures in the event of accidents at coastal sea;
6. Other duties related to the prevention of accidents at coastal sea.
(2) When performing the duties under paragraph (1), a coastal patrol officer shall wear the uniform of a Korea Coast Guard official, unless there is a compelling reason not to do so. <Amended on Nov. 19, 2014; Jul. 26, 2017; Sep. 2, 2025>
(3) Matters necessary for the duty methods, preparation of duty logs, shift arrangements, and other details for coastal patrol officers shall be prescribed by the Commissioner of the Korea Coast Guard. <Amended on Nov. 19, 2014; Jul. 26, 2017; Sep. 2, 2025>
Article 10(Coastal Safety Day and Safety Inspection Week) #
(1) Coastal Safety Day under Article 20(1) of the Act shall be observed annually on July 18. <Amended on Apr. 18, 2017>
(2) Safety Inspection Week under Article 20(1) of the Act shall be observed annually during the third week of July. <Amended on Apr. 18, 2017>
(3) The Commissioner General of the Korea Coast Guard or the head of a relevant administrative agency may hold the following events during the Safety Inspection Week under paragraph (2): <Amended on Nov. 19, 2014; Jul. 26, 2017; Sep. 2, 2025>
1. Events to raise public awareness related to the prevention of accidents at coastal sea;
2. Education and commemorative events to raise safety awareness among participants in coastal sea experience activities and operators of coastal sea experience activities under Article 11(2) of the Act;
3. Safety inspections of facilities, etc. in coastal sea areas and drills for the prevention of accidents at sea.
Article 11(Delegation and entrustment of authority) #
(1) The Commissioner General of the Korea Coast Guard shall delegate the authority over the following to the chief of a coast guard station under Article 22(1) of the Act: <Amended on Nov. 19, 2014; Jul. 20, 2015; Jul. 26, 2017; Oct. 14, 2021>
1. Access control under Article 10(1) of the Act;
2. Formation and operation of a coastal patrol unit under Article 16(1) of the Act;
3. Imposition and collection of administrative fines under Article 25(1) and (2) of the Act.
(2) The Commissioner General of the Korea Coast Guard may entrust the provision of safety education under Article 11-2(2) of the Act to a school specified in Article 2 of the Higher Education Act, which operates departments or faculties, etc. related to leisure sports, in accordance with Article 22(2) of the Act. <Amended on Nov. 19, 2014; Jul. 26, 2017; Oct. 14, 2021>
(3) Where the Commissioner General of the Korea Coast Guard entrusts the task under paragraph (2), the Commissioner General shall publicly notify the name of the school to which the task is entrusted, the scope of the entrusted task, and other related matters. <Amended on Nov. 19, 2014; Jul. 26, 2017; Sep. 2, 2025>

Article 12(Management of personally identifiable information) #
The Commissioner General of the Korea Coast Guard (including a person entrusted with the task of the Commissioner General under Article 11(2)), the Commissioner of a Regional Korea Coast Guard, or the chief of a coast guard station may manage data containing resident registration numbers or foreign registration numbers referred to in subparagraph 1 or 4 of Article 19 of the Enforcement Decree of the Personal Information Protection Act, if it is inevitable to perform the following: <Amended on Nov. 19, 2014; Jul. 20, 2015; Jul. 26, 2017; Oct. 17, 2017; Oct. 14, 2021>
1. Tasks related to the provision of safety education under Article 11-2(2) of the Act;

Article 14(Criteria for imposition of administrative fines) #
The criteria for the imposition of administrative fines under Article 25(1) and (2) of the Act shall be as specified in the Appendix.
