ACT ON SUPPORT FOR THE ASSOCIATION OF WORLD ELECTION BODIES

Article 1(Purpose) #

The purpose of this Act is to support the activities and operation of the Association of World Election Bodies, which was established with the participation of election management agencies from various countries and international election-related organizations to promote a free and fair election culture around the world, thereby promoting the smooth operation of the Association of World Election Bodies and contributing to the development of democracy in the international community.

Article 2(Legal personality) #

The Association of World Election Bodies (hereinafter referred to as the "Association") shall be a corporation.

Article 3(Offices) #

The Association’s main office shall be located in the Republic of Korea.

Article 4(Registration) #

(1) Matters to be registered for incorporation of the Association shall be as follows:

1. Objective;

2. Name;

3. Address of the Association’s office;

4. Names and addresses of executive officers.

(2) Except as provided in this Act, the provisions of the Civil Act governing incorporated associations shall apply mutatis mutandis to the Association. In such cases, "articles of incorporation" shall be construed as "Charter of the Association".

Article 5(Business affairs) #

The Association shall perform the following business affairs:

1. Engaging in international election observation to ensure open and transparent elections;

2. Providing support for the establishment of an election law system that conforms to the internationally recognized election management principles;

3. Facilitating the exchange of research results and technical information on the electoral system;

4. Other matters determined by resolution at a general meeting and of the executive board of directors in accordance with the Charter of the Association.

Article 6(Cooperation with the Association) #

(1) Cooperation between the Republic of Korea and the Association shall be supervised by the Chairperson of the National Election Commission (hereafter in this Article referred to as the "Chairperson").

(2) The Chairperson may formulate and implement comprehensive policy measures to strengthen cooperation with the Association or to support its activities.

(3) If the policy measures formulated under paragraph (2) are related to other central administrative agencies and local governments, the Chairperson may request cooperation from the heads of the relevant central administrative agencies and local governments.

Article 7(Support from the State and local governments) #

The State and local governments may provide administrative and financial support necessary for the activities and operation of the Association.

Article 8(Request for secondment of public officials) #

The Association may, if necessary for the performance of its duties, request relevant administrative agencies and local governments to second public officials under Article 2 of the State Public Officials Act and Article 2 of the Local Public Officials Act.

Article 9(Request for provision of data) #

The Association may request relevant administrative agencies, local governments, public or educational institutions, research organizations, etc. to provide data, such as survey reports and research papers related to the election system.

Article 10(Submission of details of budget execution) #

(1) If the Association receives financial support, such as contributions, it shall transparently execute such support.

(2) When the State has provided administrative and financial support to the Association, the National Assembly may, if necessary, request the Association to submit a business plan or a report on settlement of accounts for the relevant year through the National Election Commission.
