Article 1(Purpose) #
The purpose of this Decree is to prescribe matters mandated by the Act on Restoration of Honor of Victims in Dong-Eui University Incident and Compensation Therefor and matters necessary for the enforcement thereof.
Article 2(Composition of the Committee for Deliberation on Restoration of Honor of Victims in Dong-Eui University Incident and Compensation Therefor) #
(1) The members of a Committee for Deliberation on Restoration of Honor of Victims in Dong-Eui University Incident and Compensation Therefor (hereinafter referred to as the "Committee for Restoration of Honor") under Article 3 of the Act on Restoration of Honor of Victims in Dong-Eui University Incident and Compensation Therefor (hereinafter referred to as the "Act") shall be as follows: <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017; Apr. 11, 2023; Dec. 30, 2025>
1. Persons appointed by the Prime Minister from among public officials of Grade III or higher within the Office for Government Policy Coordination, the Ministry of Finance and Economy, the Ministry of Justice, the Ministry of the Interior and Safety, the Ministry of Patriots and Veterans Affairs, the Ministry of Planning and Budget, the Ministry of Personnel Management, and the Korean National Police Agency, or from among public officials of equivalent grades, as recommended by the heads of their affiliated agencies;
2. Not more than 3 persons commissioned by the Prime Minister from among persons with abundant knowledge and experience in relevant fields.
(2) The term of office of the members under paragraph (1)2 shall be 1 year, and they may be re-appointed only once.
Article 3(Operation of the Committee for Restoration of Honor) #
(1) The chairperson of the Committee for Restoration of Honor (hereinafter referred to as the "chairperson of the Committee for Restoration of Honor") shall represent the Committee for Restoration of Honor and exercise general supervision over its affairs.
(2) The chairperson of the Committee for Restoration of Honor shall convene and preside over meetings of the Committee for Restoration of Honor.
(3) If the chairperson of the Committee for Restoration of Honor is unable to perform his or her duties due to any unavoidable reason, a member designated in advance by the chairperson shall act on his or her behalf.
(4) A majority of the members of the Committee for Restoration of Honor shall constitute a quorum, and any resolution thereof shall require the concurring vote of a majority of those present.
(5) Except as provided in paragraphs (1) through (4), matters necessary for the operation, etc. of the Committee for Restoration of Honor shall be determined by the committee's chairperson following resolution by the committee.
Article 4(Composition of the Working Committee for Restoration of Honor of Victims in Dong-Eui University Incident and Compensation Therefor) #
(1) The members of the Working Committee for Restoration of Honor of Victims in Dong-Eui University Incident and Compensation Therefor under Article 4 of the Act (hereinafter referred to as the "Working Committee") shall be the following persons: <Amended on Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017; Apr. 11, 2023; Dec. 30, 2025>
1. Persons appointed by the Commissioner General of the Korean National Police Agency from among public officials of Grade III or higher in the Office for Government Policy Coordination, the Ministry of Finance and Economy, the Ministry of Justice, the Ministry of the Interior and Safety, the Ministry of Patriots and Veterans Affairs, the Ministry of Planning and Budget, the Ministry of Personnel Management, and the Korean National Police Agency, or from among public officials of equivalent grades, as recommended by the heads of their affiliated agencies;
2. Not more than 3 persons commissioned by the Commissioner General of the Korean National Police Agency from among the representatives of bereaved family members and persons with extensive knowledge and experience in relevant fields.
(2) The term of office of the members under paragraph (1)2 shall be 1 year, and they may be re-appointed only once.
Article 5(Operation of the Working Committee) #
`Article 3 shall apply mutatis mutandis to the operation of the Working Committee. In such cases, "Committee for Restoration of Honor" shall be construed as "Working Committee" and "chairperson of the Committee for Restoration of Honor" as "chairperson of the Working Committee".
Article 6(Allowances) #
(1) Allowances may be paid to members who attend a meeting of the Committee for Restoration of Honor or the Working Committee within the budget; provided, this shall not apply where a member who is a public official attends a meeting in direct connection with his or her duties.
(2) A witness or a person for reference who has appeared before a meeting of the Committee for Restoration of Honor or the Working Committee may be reimbursed for travel expenses and actual expenses within the budget.
Article 7(Prohibition of disclosure of confidential information) #
Members of the Committee for Restoration of Honor or the Working Committee shall not disclose any confidential information acquired in the course of performing their duties.
Article 8(Compensation) #
(1) The amount of compensation payable to the bereaved family members of deceased police officers and auxiliary police officers under Article 6(1) of the Act shall be as specified in Appendix 1. <Amended on Nov. 20, 2015>
(2) The amount of compensation payable to wounded police officers and auxiliary police officers (including those who later died from other causes after sustaining injuries) under Article 6(2) of the Act, categorized by disability levels shall be as specified in Appendix 2. <Amended on Nov. 20, 2015>
Article 9(Application for compensation) #
(1) A bereaved family member of a victim (including the bereaved family members of an injured person who later died from other causes; hereinafter the same shall apply) or the victim himself or herself (hereinafter referred to as the "applicant") who intends to apply for compensation in accordance with Article 7 of the Act, shall submit an application for compensation in Form 1 to the Committee for Restoration of Honor, along with the following documents; provided, if the applicant is unable to directly apply for and receive the compensation due to immigration, hospitalization, imprisonment, or other unavoidable reasons, he or she may appoint an agent to apply for and receive the compensation on his or her behalf:
1. One copy of the incident report in Form 2;
2. The following documents, if the application is filed by a bereaved family member of a victim:
a. One copy of a certificate of family relations records or a certified copy of archived family relations records (limited to the bereaved family of a deceased person, where the relationship cannot be verified through a certificate of family relations records);
b. One copy each of a letter of selection of the representative of the bereaved family members in Form 3 and a certificate of seal imprint of a delegating person (applicable only where a representative of the bereaved family members is selected);
c. One copy of a signature of multiple applicants in Form 6 (limited to where at least 2 bereaved family members apply without selecting a representative);
3. One copy each of a power of attorney for receipt of compensation, etc. in Form 5 and a certificate of seal imprint of the delegating person verified by any of the following persons, if the application is filed by an agent appointed:
a. For an applicant residing overseas, the head of a diplomatic mission abroad;
b. For a hospitalized applicant, the head of the relevant medical institution;
c. For an applicant confined in a correctional institution, etc. the head of the institutional correctional facility;
d. In other cases, the head of an Eup/Myeon/Dong;
4. One copy of a medical certificate of disability issued by a police hospital, a national or public general hospital, a hospital affiliated with a medical school, or a medical institution of general hospital size or larger among the medical institutions established and operated by the Korea Workers' Compensation and Welfare Service under Article 10 of the Industrial Accident Compensation Insurance Act. 2, if the application is filed by an injured person among the victims (in the case of a person who later died from other causes, among the injured, documents showing his or her degree of disability at the time of death or other data that substantiate his or her injury status);
Article 10(Decision on compensation and service of written determinations on compensation) #
(1) Upon determining whether to pay compensation and the amount thereof under Article 8 of the Act, the Committee for Restoration of Honor shall prepare a written determination on compensation in Form 6, and the chairperson of the Committee for Restoration of Honor shall affix his or her signature, or write his or her name and affix his or her seal, thereon. In such cases, the Committee for Restoration of Honor shall retain the original copy of the determination.
(2) The original copy of the written determination on compensation under the latter part of paragraph (1) may be stored in electronic or digitized form under Article 5 of the Framework Act on Electronic Documents and Transactions. <Added on Nov. 12, 2024>
(3) Once the Committee for Restoration of Honor has determined whether to pay compensation and the amount thereof under Article 8 of the Act, it shall serve a notice of determination on compensation in Form 7 or, if the application is dismissed, a notice of determination on compensation in Form 8 (for dismissal), along with 2 authentic copies of a written determination on compensation on the applicant; provided, if the application was filed by the applicant's agent, these documents shall be served on the agent, and a copy of the determination on compensation shall also be served on the applicant. <Amended on Nov. 12, 2024>
(4) The Committee for Restoration of Honor shall prepare and maintain a list of persons who have been granted compensation under Article 8 of the Act. <Amended on Nov. 12, 2024>
Article 11(Consent and claim for payment) #
(1) If an applicant or his or her agent who has received a written determination on compensation under Article 10(3) intends to receive compensation by consenting to the decision, he or she shall submit a written claim for compensation in Form 9 to the Committee for Restoration of Honor, along with the following documents: <Amended on Nov. 12, 2024>
1. One authentic copy of the written determination on compensation;
2. One copy of the certificate of the applicant's seal imprint;
3. One copy each of the certificate of the seal imprint of bereaved family members consenting to the selection of a representative of the bereaved family members (applicable only if a representative of the bereaved family members is selected);
4. One copy each of a letter of delegation certifying the right of representation to receive compensation, and one copy each of the certificate of the seal imprint of the delegating person and the agent (applicable only if the agent intends to receive compensation).
(2) Upon receiving a written claim for compensation under paragraph (1), the Committee for Restoration of Honor shall verify a certified copy of the resident registration card of the applicant or his or her agent through administrative data matching under Article 36(1) of the Electronic Government Act; provided, if the applicant or his or her agent does not consent to the verification, the committee shall require the applicant or his or her agent to submit the document separately.
Article 12(Application for re-deliberation) #
A person who intends to apply for re-deliberation under Article 11 of the Act shall submit an application for re-deliberation in Form 10 to the Committee for Restoration of Honor, along with materials evidencing the grounds for re-deliberation.
Article 13(Institutions responsible for compensation payment) #
The Committee for Restoration of Honor may entrust the Bank of Korea (including the National Treasury Agency) with the payment of compensation under Article 12(2) of the Act.
Article 14(Public announcement) #
The chairperson shall publish the following matters relating to the application for compensation in the Official Gazette within 60 days from the date this Decree enters into force and make a public announcement of them on the Korean National Police Agency's website for at least 10 days:
1. Eligibility for compensation;
2. Qualifications of applicants;
3. Agency receiving applications;
4. Application period;
5. Deliberation and decision-making procedures;
6. Required documents;
7. Other matters necessary for the application and payment of compensation.
Article 15(Processing of sensitive information and personally identifiable information) #
The Committee for Restoration of Honor and the Working Committee may process information on health under Article 23 of the Personal Information Protection Act or data containing resident registration numbers under subparagraph 1 of Article 19 of the Enforcement Decree of that Act, if essential to perform the following affairs:
1. Payment of compensation, re-deliberation on compensation and other relevant affairs under Articles 6 through 11 of the Act;
2. Recovery of compensation and extinctive prescription under Article 16 of the Act.
Article 16(Detailed operating rule) #
Matters necessary for the enforcement of this Decree shall be determined by the chairperson of the Committee for Restoration of Honor following a resolution by the committee.
