ENFORCEMENT DECREE OF THE ACT ON THE ESTABLISHMENT AND ADMINISTRATION OF SEOUL NATIONAL UNIVERSITY

Article 1(Purpose) #

The purpose of this Decree is to prescribe matters delegated by the Act on Establishing and Administrating Seoul National University and matters necessary for the enforcement thereof.

Article 2(Registration for incorporation) #

Matters to be included in the registration of incorporation under Article 3 (3) of the Act on Establishing and Administrating Seoul National University (hereinafter referred to as the "Act") shall be as follows:

1. Objectives;

2. Name;

3. The location of the principal office;

4. Names and addresses of executive officers;

5. Total amount of assets.

Article 3(Registration for relocation) #

Where Seoul National University, a national university corporation, relocates its principal office, it shall register the new location and the date of relocation at either the former or the new location within 3 weeks after the relocation.

Article 4(Registration of changes) #

Where any of the registration matters under the subparagraphs of Article 2 is changed (excluding cases falling under registration of relocation under Article 3), Seoul National University, a national university corporation, shall register the changes at the location of its principal office within 3 weeks after such change.

Article 5(Documents to accompany application for registration) #

Each application for registration under Articles 2 through 4 shall be accompanied by the following documents:

1. Registration for incorporation under Article 2: Articles of incorporation of Seoul National University, a national university corporation;

2. Registration of relocation under Article 3: documents certifying the relocation of the principal office;

3. Registration of changes under Article 4: documents certifying the changes.

Article 6(Calculation of period for registration) #

Where a matter to be registered under Articles 2 through 4 requires authorization or approval from the Minister of Education, the period for registration shall commence from the date on which the written authorization or approval is received. <Amended on Mar. 23, 2013>

Article 7(Grounds for disqualification) #

(1) “Grounds prescribed by Presidential Decree” in Article 14 (2) of the Act means a violation of the provisions of the Act, this Decree, or the Higher Education Act, or non-compliance with orders issued pursuant thereto.

(2) The revocation of approval for the assumption of office of an executive due to any of the grounds referred to in paragraph (1) may be made only when the executive fails to comply within 15 days from the date on which the Minister of Education demands correction on such grounds. <Amended on Mar. 23, 2013>

Article 7-2(Standards for granting permission for concurrent service as outside directors by professors) #

(1) Where the President intends to grant permission for professors, associate professors, and assistant professors to concurrently serve as outside directors pursuant to Article 15-2 (1) of the Act, the President shall undergo deliberation by the Faculty Personnel Committee under Article 53-4 (1) of the Private School Act, which applies mutatis mutandis pursuant to Article 15 (3) of the Act, and review the following matters:

1. Necessity of permission;

2. Appropriateness of period of permission;

3. The appropriateness of the enterprise subject to permission;

4. Other matters that the President deems necessary to ensure that the education and guidance of students and academic research are not hindered.

(2) Where a professor, associate professor, or assistant professor concurrently serves as an outside director, he or she shall, pursuant to Article 15-2 (2) of the Act, submit to the President a document issued by the relevant private enterprise, including the details of payments referred to in the following subparagraphs as of December 31 of the relevant year, when reporting the full amount of remuneration received from the enterprise during that year:

1. Monthly payment details of all remuneration received in the relevant year;

2. Itemized payment details including transportation expenses, meeting allowances, etc.

(3) The specific standards for granting permission for concurrent service under paragraph (1) shall be determined by the President.

Article 7-3(Establishment of appointment plans for gender equality) #

(1) The classification by academic field necessary for the formulation of a plan to implement proactive measures, including appointment plans for gender equality pursuant to the former part of Article 15-3 (3) of the Act (hereinafter referred to as “plan for gender equality measures”), shall follow the classification by academic field under Appendix 1 of the Regulations on the Establishment and Operation of Universities and Colleges.

(2) The President shall formulate a plan for gender equality measures and submit it to the Minister of Education by October 31 of the year preceding the year of implementation, and shall submit the implementation results to the Minister of Education by December 31 of each year.

(3) When evaluating the plan for gender equality measures and its implementation results pursuant to Article 15-3 (4) of the Act, the Minister of Education shall, in principle, conduct a document-based evaluation, but may also conduct on-site evaluations if necessary.

Article 8(Property directly used for education and research) #

“Property directly used for education and research prescribed by Presidential Decree” in Article 20 (2) of the Act means the following property:

1. School buildings and school sites under articles 4 (1) and 5 (2) of the Regulations on the Establishment and Operation of Universities and Colleges (hereinafter referred to as "school buildings and school sites");

2. Other facilities, equipment, and teaching materials directly used for education and research.

Article 9(Management and protection of property) #

(1) “Any property prescribed by Presidential Decree” in the main clause of Article 21 (1) of the Act means property used for education and research, excluding school buildings and school sites.

(2) “Minor matters, considering value, area, or scale as prescribed by Presidential Decree” in the proviso of Article 21 (1) of the Act means any of the following matters:

1. Disposal through consultation or expropriation under the Act on Acquisition of and Compensation for Land for Public Works Projects;

2. Sale, donation, exchange, change of purpose, or provision of collateral within the value limit of less than 1 billion won.

(3) School buildings and school sites shall not be sold, donated, or provided as collateral pursuant to Article 21 (2) of the Act; provided, where they cannot be used for educational or research purposes due to unavoidable reasons such as school relocation or facility deterioration, they may be exchanged or their purpose changed with the approval of the Minister of Education. <Amended on Mar. 23, 2013>

Article 10(Entrustment of management of national heritage and financial support) #

(1) The Administrator of the Korea Heritage Service may delegate the management of national heritage, which belonged to the state and was managed by the former Seoul National University (hereinafter referred to as “former Seoul National University”) at the time of the establishment of Seoul National University, a national university corporation if it is deemed necessary for education and research. <Amended on May 7, 2024>

(2) The State may subsidize the necessary expenses within the budgetary limits to ensure that Seoul National University, a national university corporation, can smoothly perform the management duties referred to in paragraph (1).

Article 11(Gratuitous transfer of State or public property) #

(1) Pursuant to Article 22 (1) of the Act, the national property and commodities to be gratuitously transferred to Seoul National University, a national university corporation, shall be those that were being used, as of December 28, 2011, for education, research, social services, industry-academia cooperation, and the welfare of students, faculty, and staff members, or for which specific plans for such use had been formulated.

(2) When engaging in consultation pursuant to the latter part of Article 22 (1) of the Act, the Minister of Education shall, no later than 3 months prior to the date of registration of incorporation of Seoul National University, a national university corporation, present the following matters to the Minister of Economy and Finance for consultation: <Amended on Mar. 23, 2013>

1. Description, quantity, value, current status, and use of State property and commodities;

2. Purpose or grounds for gratuitous transfer;

3. In the case of national property and commodities for which plans have been formulated pursuant to paragraph (1) for use in education, research, social services, industry-academia cooperation, and the welfare of students, faculty, and staff members, matters concerning funding, including the project plan and budget;

4. Other matters related to gratuitous transfer.

(3) Where the State or a local government gratuitously transfers national property and commodities or public property and commodities to Seoul National University, a national university corporation, pursuant to Article 22 (1) through (3) of the Act, the value of such property and commodities shall be based on the ledger price.

(4) Gratuitous transfer, lease, or permission for use pursuant to Article 22 (3) of the Act shall be conducted under a contract for transfer, lease, or use entered into with Seoul National University, a national university corporation, after the Minister of Education clarifies the description, quantity, value, current status, and use of State property and commodities and consults in advance with the Minister of Economy and Finance. <Amended on Mar. 23, 2013>

(5) Gratuitous lease or permission for use of public property and commodities pursuant to Article 22 (4) of the Act shall be conducted under a lease or use contract entered into between the relevant local government and Seoul National University, a national university corporation.

Article 12(Application of the State Property Act) #

(1) Except as otherwise expressly provided for in this Decree, the provisions of the State Property Act, the Act on Restriction on Special Cases concerning State Property, or the Commodity Management Act shall apply to the procedures for the gratuitous transfer, gratuitous lease, or gratuitous use of State property and commodities under Article 22 (1) and (3) of the Act.

(2) Except as otherwise expressly provided for in this Decree, the provisions of the Public Property and Commodity Management Act shall apply to the procedures for the gratuitous transfer, gratuitous lease, or gratuitous use of public property and commodities under Article 22 (2) and (4) of the Act.

Article 13(Long-term borrowing and issuance of school bonds) #

Where Seoul National University, a national university corporation, intends to obtain long-term borrowings with a repayment period of at least 1 year or issue school bonds pursuant to Article 25 (1) of the Act, it shall obtain approval from the Minister of Education in advance by undergoing a resolution of the board of directors and preparing the following documents: <Amended on Mar. 23, 2013>

1. A document stating the amount, source, and reason for the borrowing (applicable only in the case of long-term borrowing);

2. A document stating the issuance limit, target subscribers, and reason for issuance of the school bonds (applicable only in the case of school bond issuance);

3. A document stating the method and plan for repayment;

4. A copy of the minutes of the board of directors meeting.

Article 14(Submission of budget draft and settlement of accounts) #

(1) Pursuant to Article 26 (1) of the Act, the President shall submit the draft revenue and expenditure budget to the Minister of Education no later than 5 days before the beginning of each fiscal year, accompanied by the following documents: <Amended on Mar. 23, 2013>

1. General provisions of the budget;

2. A table of remuneration for staff members (including allowances);

3. A table of organization and fixed number of personnel;

4. A copy of the minutes of the board of directors meeting.

(2) The President shall submit the settlement of accounts to the Minister of Education pursuant to Article 26 (2) of the Act, accompanied by the following documents: <Amended on Mar. 23, 2013>

1. Financial statements, including the statement of operations and the statement of financial position for the relevant year;

2. Comparative table of a business plan for the relevant year and the result of the execution thereof;

3. A letter of opinion and audit report issued by the accounting firm that conducted the audit for the relevant year;

4. A copy of the minutes of the board of directors meeting;

5. Other documents that can verify the settlement details.

Article 14-2(Items and timing of public announcement of budget) #

(1) When publicly announcing the details of the budget of the corporate accounting pursuant to Article 26 (3) of the Act, the President shall disclose the draft revenue and expenditure budget, including budget annexes prescribed by the Decree of the Ministry of Education, such as a detailed statement of tuition fees and a detailed statement of labor costs.

(2) When publicly announcing the details of the budget of the corporate accounting pursuant to Article 26 (3) of the Act, the President shall do so no later than 5 days before the beginning of each fiscal year. In such cases, the period of public announcement shall be 1 year.

(3) When publicly announcing the details of the budget of the corporate accounting pursuant to Article 26 (3) of the Act, the President shall do so by posting them on the website of Seoul National University, a national university corporation.

Article 14-3(Items and timing of public announcement of settlement of accounts) #

(1) When publicly announcing the details of the settlement of accounts of the corporate accounting pursuant to Article 26 (3) of the Act, the President shall disclose the settlement of accounts, including settlement annexes prescribed by the Ordinance of the Ministry of Education, such as a detailed statement of notes receivable and a detailed statement of fixed assets, along with the audit report under Article 14 (2) 3 (including the letter of opinion).

(2) When publicly announcing the details of the settlement of accounts of the corporate accounting pursuant to Article 26 (3) of the Act, the President shall do so within 3 months after the end of each fiscal year. In such cases, the period of public announcement shall be 1 year.

(3) When publicly announcing the details of the settlement of accounts of the corporate accounting pursuant to Article 26 (3) of the Act, the President shall do so by posting them on the website of Seoul National University, a national university corporation.

Article 15(Submission of budget request for contributions) #

(1) Pursuant to Article 30 (4) of the Act, the President shall submit the budget request for contributions for the following year to the Minister of Education by April 30 of each year, accompanied by the following documents: <Amended on Mar. 23, 2013>

1. The project plan for the following year;

2. Documents necessary to clarify the details of the budget request for contributions.

(2) Where the Minister of Education deems the contents of the request for contributions under paragraph (1) to be reasonable, the Minister shall reflect such contents in the budget, and upon finalizing the contribution budget, shall notify the President thereof. <Amended on Mar. 23, 2013>

Article 16(Payment of contributions) #

(1) To receive contributions, the President shall submit an application for payment to the Minister of Education, accompanied by the project plan for the relevant year and the quarterly budget execution plan. <Amended on Mar. 23, 2013>

(2) Upon receipt of the application for payment under paragraph (1), the Minister of Education shall provide the contributions on a quarterly basis if the project plan and quarterly budget execution plan are deemed reasonable. <Amended on Mar. 23, 2013>

Article 17(Support for and fostering of basic academics) #

(1) The Basic Academics Promoting Committee shall be established within Seoul National University, a national university corporation, to formulate plans for the support and promotion of essential fields, including basic academic disciplines, pursuant to Article 31 (1) of the Act.

(2) The Basic Academics Promoting Committee shall be comprised of not more than 15 experts in related fields within and outside Seoul National University, a national university corporation.

(3) The Basic Academics Promoting Committee shall deliberate on the following matters:

1. Matters concerning the formulation and implementation of plans for the support and promotion of necessary fields including basic academics;

2. Matters concerning the expansion and execution of financial resources for implementing plans for the support and promotion of necessary fields including basic academics;

3. Matters concerning the evaluation of implementation of plans for the support and promotion of necessary fields including basic academics;

4. Other matters deemed necessary by the Basic Academics Promoting Committee for the support and promotion of necessary fields including basic academics.

(4) The Basic Academics Promoting Committee shall deliver the results of the deliberation under paragraph (3) to the President, and the President shall take necessary measures in accordance with the articles of incorporation.

(5) Matters necessary for the composition, operation, and deliberation of the Basic Academics Promoting Committee, other than those provided for in paragraphs (1) through (4), shall be prescribed by the articles of incorporation.

(6) Where the President intends to receive financial support under Article 31 (2) of the Act from the State, the President shall request the Minister of Education to provide financial support, specifying the following matters: <Amended on Mar. 23, 2013>

1. Objectives and effects of support and promotion projects;

2. Fields of support and promotion and implementation plans;

3. Expenses incurred in support and promotion projects and amount to be supported.

Article 18(Scholarships and welfare for students) #

(1) The Scholarship and Welfare Committee shall be established within Seoul National University, a national university corporation, to formulate policies for scholarships and welfare for students pursuant to Article 31 (3) of the Act.

(2) The Scholarship and Welfare Committee shall be comprised of not more than 15 experts in related fields within and outside Seoul National University, a national university corporation.

(3) The Scholarship and Welfare Committee shall deliberate on the following matters:

1. Matters concerning establishment and implementation of scholarship and welfare policies for students;

2. Matters concerning the expansion and execution of financial resources for implementing scholarship and welfare policies for students;

3. Matters concerning the evaluation of scholarship and welfare policies for students;

4. Other matters deemed necessary by the Scholarship and Welfare Committee to promote scholarship and welfare for students.

(4) The Scholarship and Welfare Committee shall deliver the results of the deliberation under paragraph (3) to the President, and the President shall take necessary measures in accordance with the articles of incorporation.

(5) Matters necessary for the composition, operation, and deliberation of the Scholarship and Welfare Committee, other than those provided for in paragraphs (1) through (4), shall be prescribed by the articles of incorporation.

Article 19(Expansion of self-financing resources) #

(1) Pursuant to Article 31 (4) of the Act, Seoul National University, a national university corporation, shall formulate and implement an annual implementation plan to expand self-financing resources.

(2) The State may provide administrative support to implement an annual implementation plan under paragraph (1).

Article 20(Affiliated schools) #

(4) Detailed matters concerning the organization, operation, etc. of affiliated schools under Article 33 (1) and (2) of the Act shall be prescribed by the articles of incorporation. <Amended on Jan. 21, 2014>

(7) The President may, through an agreement with the Superintendent of the Seoul Metropolitan Office of Education, designate and operate high schools established and managed by the Seoul Metropolitan Government as affiliated schools of the College of Education at Seoul National University, a national university corporation.
