Article 1(Purpose) #
The purpose of this Decree is to prescribe the matters mandated by the Weather Industry Promotion Act and those necessary for enforcing that Act.
Article 2(Formulation of master plans) #
(1) In order to formulate or modify a master plan for the advancement of the weather industry under Article 4 (1) (hereinafter referred to as "master plan") of the Weather Industry Promotion Act (hereinafter referred to as the "Act"), the Administrator of the Korea Meteorological Administration may request the heads of relevant central administrative agencies to submit necessary data. <Amended on Oct. 25, 2022>
(2) "Matters prescribed by Presidential Decree" in Article 4 (2) 7 of the Act means the following matters:
1. Facilitation of the use of weather information;
2. Recommendations on the expansion of the employment of holders of weather-related licenses, or qualification certificates under Article 21 of the Act.
(3) "Where it is intended to make a modification to the minor matters prescribed by Presidential Decree" in the proviso of Article 4 (3) of the Act means any of the following cases: <Amended on Oct. 25, 2022>
1. Where it is intended to make a modification to the master plan in order to reflect the content of the amendment of the Act or the enactment, amendment, or repeal of any other statute or regulation in accordance with the amendment of the Act or the enactment, amendments, or repeal of the statute or regulation;
2. Where it is intended to make a modification to the master plan in accordance with plan changes as provided in any other statute or regulation, to the extent not affecting the purpose and direction of the master plan;
3. Where it is intended to correct a simple mistake, misrepresentation, omission, or obvious error corresponding thereto in the master plan.
Article 3(Formulation of implementation plans) #
(1) Where the Administrator of the Korea Meteorological Administration intends to modify an implementation plan for the advancement of the weather industry under Article 5 (1) of the Act (hereinafter referred to as the "implementation plan"), he or she shall consult with the heads of relevant central administrative agencies thereon.
(2) The Administrator of the Korea Meteorological Administration may request the heads of relevant central administrative agencies to submit necessary data in order to formulate or modify the implementation plan.
(3) Where the Administrator of the Korea Meteorological Administration notify the heads of relevant central administrative agencies when the implementation plan is formulated or modified.
(4) The heads of relevant central administrative agencies shall submit the performance results of the previous year's implementation plan to the Administrator of the Korea Meteorological Administration by the end of February each year.
Article 4(Registration standards for weather forecasting business) #
"Personnel and facilities prescribed by Presidential Decree" in Article 6 (1) of the Act shall be as specified in Appendix 1.
Article 5(Scope of services of weather forecasting business) #
(1) The scope of services of the weather forecasting business under Article 6 (3) of the Act shall be as follows; provided, aeronautical meteorological forecasts under Article 14-2 (1) of the Weather Act shall be excluded herefrom: <Amended on Feb. 6, 2024>
1. Weather forecasts for general users: Weather forecasts provided for an unspecified number of people through media outlets, such as broadcasting and newspapers, or via the Internet website, etc.;
2. Weather forecasts for specific users: Weather forecasts that are contracted with enterprises, individuals, etc. and provided only to those contractors.
(2) The Administrator of the Korea Meteorological Administration may establish and notify weather forecast terminology that can be used in weather forecasts, and standards for the method of evaluating the accuracy of forecasts, for general users under paragraph (1) 1.
Article 5-2(Scope of Services, etc. of Weather Appraisal Business) #
(1) The scope of services of the weather appraisal business under Article 6 (3) of the Act shall be as follows:
1. Estimating meteorological phenomena at a specified point based on the results of observing meteorological phenomena, theoretical analysis, etc.;
2. Estimating the level of influence on a certain incident by meteorological phenomena and the scale of damage, etc. subsequently sustained by the incident.
(2) In order to conduct the weather appraisal business under paragraph (1), the Administrator of the Korea Meteorological Administration may determine and give public notice of necessary matters, such as procedures for conducting the weather appraisal business.

Article 6(Method of concluding agreements) #
(1) Where the head of an institution or organization that has entered into an agreement under Article 9 (1) of the Act (hereinafter referred to as the "head of the lead research institute") shall, if intending to cover a portion of the expenses of the research and development project with contributions from non-governmental entities or with technology development funds (including in-kind contributions; hereinafter the same shall apply) from enterprises, he or she shall conclude a contract in advance with the party bearing such expenses.
(2) An agreement under Article 9 (1) of the Act shall include the following:
1. Research and development plan, including the scope, method of execution, and person in charge of the research and development project;
2. Matters related to the payment, use, and management of research and development expenses;
3. Matters related to reporting on research and development results;
4. Matters related to the attribution and utilization of research and development results;
5. Matters related to the collection and use of royalties according to the utilization of research and development results;
6. Matters related to the evaluation of research and development results and subsequent measures to be taken;
7. Measures to be taken against the wrongful use of research and development expenses;
8. Matters related to the modification and cancellation of the agreement;
9. Measures to be taken against the violation of the agreement;
10. Matters involving research and development, other than those specified in subparagraphs 1 through 9.
Article 6-2(Entities subject to research and development project agreement) #
"Requirements prescribed by Presidential Decree, including research personnel and facilities" in Article 9 (1) 7 of the Act means the following requirements:
1. To have at least 5 full-time research personnel with a bachelor's degree or higher in a meteorology-related discipline (including those recognized as having educational attainments equivalent to or higher than that level accordance with statutes and regulations); in such cases, at least 2 of them shall have at least 3 years of research experience in a weather-related entity, organization, or corporation after obtaining such a degree;
2. To have independent research facilities capable of performing research and development projects for the advancement of the weather industry.

Article 7(Payment and management of contributions) #
(1) Contributions under Article 9 (2) of the Act shall be paid in installments; provided, it may be paid in a lump sum, in consideration of the scale and start time of a research and development project, the financial situation of the Government, etc.
(2) The head of a lead research institute that has received contributions under paragraph (1) shall establish and manage a separate account.
Article 8(Use of contributions and reporting on performance thereof) #
(1) The head of a lead research institute, in receipt of contributions under Article 7, shall use them only for the following purposes, as determined and publicly notified by the Administrator of the Korea Meteorological Administration:
1. Researcher personnel expenses;
2. Direct expenses, including such as research equipment and material expenses, research activity expenses, and research allowances;
3. Indirect expenses, including personnel support expenses, research support expenses, and outcome utilization expenses;
4. Expenses incurred in outsourcing research and development.
(2) The head of a lead research institution shall report to the Administrator of the Korea Meteorological Administration the results of use of contributions stated in the following documents each year, within 2 months after the completion of a research and development project for the relevant year:
1. Plan for the use of research and development expenditures in the Form prescribed by the Administrator of the Korea Meteorological Administration, and the results of execution thereof;
2. Internal accounting audit opinion of the lead research institute.
(3) Where a lead research institute has used the contributions for any purpose other than the purposes specified in the subparagraphs of paragraph (1) or has used them by fraud or other improper means, the Administrator of the Korea Meteorological Administration shall recover the amount corresponding to the share of the Government contributions, out of the contributions in question, and may cancel the relevant agreement as specified by the agreement under Article 6 or restrict the lead research institution from participating in any research and development project subsidized by the Administrator of the Korea Meteorological Administration.
Article 9(Support for commercialization of research and development results) #
(1) A weather business operator, etc. that seeks to receive support for commercializing research and development results in accordance with Article 10 (1) of the Act shall submit to the Administrator of the Korea Meteorological Administration a business plan and detailed requests for support.
(2) Where some of the detailed requests for support under paragraph (1) fall under the jurisdiction of an agency or organization other than the Korea Meteorological Administration, the Administrator of the Korea Meteorological Administration may recommend the applicant to such agency or organization so that the applicant can receive support necessary for commercializing research and development outcomes if it is deemed necessary for commercialization.
(3) The Administrator of the Korea Meteorological Administration may collect royalties as specified by the agreement under Article 6 from any weather business operator, etc. that engages in commercializing research and development outcomes under Article 10 (1) of the Act.
Article 9-2(Scope of projects eligible for funding support for weather industrial bodies) #
"Projects prescribed by Presidential Decree" in Article 11-2 (2) 4 of the Act means the following projects:
1. Acquisition of international standard certification or verification for domestic meteorological technology;
2. Overseas installation and operation of meteorological equipment, its operation system, etc.

Article 9-3(Scope of and procedures for fact-finding surveys) #
(1) The scope of fact-finding surveys on the weather industry under Article 12 (1) of the Act (hereinafter referred to as "fact-finding survey") shall be as follows:
1. General status, including the names and locations of weather industrial bodies (referring to business operators that are engaged in the weather industry; hereinafter the same shall apply);
2. Sales performance and export and import status of weather industrial bodies;
3. Status of workforce in the weather industry;
4. Status of research and development related to the weather industry;
5. Other matters deemed by the Administrator of the Korea Meteorological Administration requiring fact-finding surveys for the advancement of the weather industry.
(2) A fact-finding survey shall be conducted every year.
(3) Where the Administrator of the Korea Meteorological Administration conducts a fact-finding survey, he or she shall formulate a fact-finding survey plan in advance, including the survey period, purpose, personnel and content.
(4) The Administrator of the Korea Meteorological Administration may request an institution or organization with expertise and personnel in the weather industry to conduct a fact-finding survey.
(5) Upon conducting a fact-finding survey, the Administrator of the Korea Meteorological Administration shall announce the results of the survey on the website of the Korea Meteorological Administration.

Article 10(Designation of weather information support institute) #
(1) "Personnel and facilities prescribed by Presidential Decree" in Article 16 (1) of the Act shall be as specified in Appendix 2.
(2) Where the Administrator of the Korea Meteorological Administration intends to designate a weather information support institute under Article 16 of the Act, they shall publicly announce the method, period, etc. of application for designation in the Official Gazette or daily newspapers or on its website.
Article 10-2(Designation of graduate school specialized in covergence analysis of weather and climate Data) #
(1) A person who seeks to be designated as a graduate school specialized in convergence and analysis of meteorological and climate data under Article 16-2 (1) of the Act (hereinafter referred to as "specialized graduate school") shall meet the following standards for designation:
1. It is required to open and operate courses determined and publicly notified by the Administrator of the Korea Meteorological Administration, among courses in the fields related to the convergence, analysis, and utilization of weather and climate data;
2. It is required to open at least 5 kinds of courses specified in subparagraph 1.
(2) A person that seeks to be designated as a specialized graduate school shall apply for designation to the Administrator of the Korea Meteorological Administration as prescribed by Decree of the Ministry of Environment.
(3) The content of the support under Article 16-2 (2) of the Act shall be as follows:
1. Financial support for expenses incurred in fostering professionals necessary for the promotion of the weather industry;
2. Financial support for expenses necessary for research on convergence analysis of weather and climate data.
(4) Except as provided in paragraphs (1) and (2), detailed matters necessary for standards and procedures for the designation of specialized graduate schools shall be determined and publicly notified by the Administrator of the Korea Meteorological Administration.

Article 11(Projects of Korea Meteorological Institute) #
"Projects prescribed by Presidential Decree" in Article 17 (5) 13 of the Act means the following projects:
1. Fact-finding surveys, analysis, and improvement of weather information to ensure its use, distribution, and promotion;
2. Support for domestic and international cooperation in the field of meteorology;
3. Support for enterprises, organizations, etc. utilizing weather information.

Article 12(Meteorological Qualifications) #
A person who seeks to acquire a license for weather forecaster or meteorological appraiser under Article 18 (1) of the Act shall obtain the following relevant meteorological qualification under the National Technical Qualifications Act:
1. Weather forecaster: Weather forecasting professional engineer forecaster or meteorological engineer;
2. Meteorological appraiser: Meteorological appraising engineer.
Article 13(Weather-related fields) #
"Weather-related fields prescribed by Presidential Decree" in Article 18 (1) 2 of the Act means business involving meteorological observation, weather forecasting, applied meteorology or meteorological research, which is performed by the Korea Meteorological Administration, a national or public research institute, the Armed Forces under the Act on the Organization of National Armed Forces, a university or college defined in subparagraph 1 of Article 2 of the Higher Education Act, a weather business operator (excluding persons that have filed for registration for the meteorological equipment business), a weather information support institute under Article 16 of the Act (hereinafter referred to as "weather information support institute"), or by the Korea Meteorological Institute under Article 17 (1) of the Act. <Amended on Jun. 27, 2017>
Article 14(Educational curriculum for licensure) #
(1) "Educational course prescribed by Presidential Decree" in Article 18 (1) 3 of the Act means an educational course provided by an educational institution designated under Article 35-3 (1) of the Weather Act. <Amended on Apr. 17, 2018>
(2) The content and hours of the educational course under paragraph (1) shall be prescribed by Decree of the Ministry of Environment.
Article 15(Acquisition of licenses) #
(1) A person who seeks to acquire a license for weather forecaster or meteorological appraiser in accordance with Article 18 (1) of the Act shall apply to the Administrator of the Korea Meteorological Administration as prescribed by Ministerial Decree of the Environment.
(2) If a person who has applied for a license under paragraph (1) falls under any of the subparagraphs of Article 18 (1) of the Act, the Administrator of the Korea Meteorological Administration shall state the fact in the register of licenses and then issue a license as prescribed by Decree of the Ministry of Environment.
Article 16(Reissuance of licenses) #
(1) A person who has been issued a license under Article 15 shall be reissued a license as prescribed by Decree of the Ministry of Environment if they falls under any of the following:
1. When the license is lost;
2. When the license is damaged and becomes unusable;
3. When information on the license has changed.
(2) A person who falls under paragraph (1) 2 or 3 and thus intends to be reissued a license shall return the previously issued license to the Administrator of the Korea Meteorological Administration. The same shall also apply when a person reissued a license in accordance with paragraph (1) 1 finds their lost license.
Article 17(License fees) #
(1) A person who intends to be issued or reissued a license under Article 15 or 16 shall pay a fee in the amount prescribed by Decree of the Ministry of Environment.
(2) Fees under paragraph (1) may be paid by means of revenue stamps, electronic money, electronic payment, etc. through information and communications networks. <Amended on Mar. 29, 2011>
Article 17-2(Return of license certificates) #
A weather forecaster or a meteorological appraiser shall return their license to the Administrator of the Korea Meteorological Administration within 10 days when their license is revoked or the validity of their license is suspended under Article 20 (1) of the Act.

Article 18(Submission of data) #
(1) The Administrator of the Korea Meteorological Administration may request a weather business operator or a weather information support institute to submit the following data within a specified period in accordance with Article 22 (1) of the Act:
1. Data regarding weather information, such as weather forecasting and weather observation data provided to users within the last 3 years;
2. Data to verify whether the standards for personnel and facilities are met for registration as a weather business operator under Article 6 (1) of the Act or the designation as a weather information support institute under Article 16 (1) of the Act.
(2) Except as provided for in paragraph (1), matters necessary for submission of data shall be determined and publicly notified by the Administrator of the Korea Meteorological Administration. <Amended on Oct. 25, 2022>

Article 19(Access and inspection) #
A public official who intends to conduct an inspection under Article 22 (1) of the Act shall notify the person to be inspected of the inspection plan, including the date and time, purpose, and content of the inspection, at least 7 days before the inspection; provided, this shall not apply where an urgent inspection is required or where the purpose of an inspection is not deemed achievable if prior notification thereof is given.
Article 19-2(Management of personally identifiable information) #
The Administrator of the Korea Meteorological Administration may process data containing resident registration numbers under subparagraph 1 of Article 19 of the Enforcement Decree of the Personal Information Protection Act, if it is unavoidable to manage such data for performing business affairs related to verification of the grounds for disqualification referred to in Articles 7 and 19 of the Act.

Article 20(Criteria for imposition of administrative fines) #
The criteria for imposing administrative fines under Article 28 (1) of the Act shall be as specified in Appendix 3.
