Article 1(Purpose) #
The purpose of this Rule is to regulate matters mandated by the Support for Multicultural Families Act and the Enforcement Decree of the Support for Multicultural Families Act and matters necessary for their enforcement.
Article 2(Scope and Method of Investigation on Multicultural Families, etc.) #
(1) Pursuant to Article 4 of the Support for Multicultural Families Act (hereinafter referred to as the "Act"), the Minister of Health, Welfare and Family Affairs shall conduct investigation (hereinafter referred to as the “investigation") on multicultural families, of which subject shall be marriage immigrants, etc. and their Korean spouses and children, etc.
(2) For the purpose of conducting the investigation prescribed in paragraph (1), the Minister of Health, Welfare and Family Affairs may hire a research institute or corporation that has expertise in multicultural families, manpower, and equipment.
(3) The investigation prescribed in paragraph (1) shall cover each of the following dimensions:
1. Information related to general features of family members such as sex, age, education level, employment status, etc.;
2. Information related to the financial standing of the family such as income, expenditure, assets, etc.;
3. Information related to family behaviors and relations such as fostering of children, supporting of family members, etc.;
4. Information related to lifestyle such as food/clothing/shelter, consumption, leisure activities, use of information, etc.;
5. Information related to family issues such as trouble among family members, etc.;
6. Information related to demand for services such as education/counseling related to support for multicultural families, etc.; and
7. Other information specified by the Minister of Health, Welfare and Family Affairs required for understanding the current status and actual conditions of multicultural families.
(4) When an additional investigation is required due to reasons such as a drastic change in social environment, the Minister of Health, Welfare and Family Affairs may conduct a provisional investigation in addition to the one prescribed in paragraph (1) for complementary purposes.
Article 3(Criteria for Professional Human Resources of Multicultural Family Support Centers) #
A multicultural family support center prescribed in Article 12 (1) of the Act (hereinafter referred to as the "support center") shall have, pursuant to Article 12 (3) of the Act, at least one professional who falls under one of the following categories:
1. A qualified healthy family specialist prescribed by Article 35 of the Framework Act on Healthy Families Article
2. A qualified social welfare worker prescribed in Article 11 of the Social Welfare Services Act; or
3. A professional of other related fields recognized by the Minister of Health, Welfare and Family Affairs.
Article 4(Request for Designation of Multicultural Family Support Center, etc.) #
(1) A person who desires to be designated as a support center as prescribed by Article 3 (1) of the Enforcement Decree of the Support for Multicultural Families Act (hereinafter referred to as the "Decree") shall make the request to the special metropolitan city mayor/metropolitan city mayor/province governor/special self-governing province governor by submitting each of the following documents along with the Request for Designation of Multicultural Family Support Center (Form 1):
1. A business plan; and
2. Documents that demonstrate that the applicant meets the facility and manpower requirements prescribed in Article 3 (1) of the Decree.
(2) The examination committee prescribed in Article 3 (2) of the Decree shall have at least 5 members including academics, private experts, and public officials whose area of expertise is related to supporting multicultural families.
(3) When designating a support center, the special metropolitan city mayor/metropolitan city mayor/province governor/special self-governing province governor shall issue a Letter of Designation as Multicultural Family Support Center (Form 2) as prescribed by Article 3 (3) of the Decree, and shall announce such designation by such means as posting it on a website.
