Article 1(Purpose) #
The purpose of this Decree is to prescribe matters delegated by the Act on the Promotion of Taekwondo and Creation of Taekwondo Park and matters necessary for the enforcement thereof.
Article 2(Formulation of master plans for promotion of Taekwondo) #
(1) The Minister of Culture, Sports and Tourism shall formulate a master plan for the promotion of Taekwondo pursuant to Article 5 (1) of the Act on the Promotion of Taekwondo and Creation of Taekwondo Park (hereinafter referred to as the "Act") every 5 years.
(2) "Matters prescribed by Presidential Decree" in Article 5 (2) 8 of the Act means the following:
1. Matters concerning holding of domestic events related to Taekwondo;
2. Matters concerning creation and operation of Taekwondo park;
3. Matters concerning promotion of lifelong education of Taekwondo;
4. Matters concerning fostering Taekwondo-related industries.
Article 3(Taekwondo Day) #
(1) The State, local governments, Taekwondo organizations, etc. may hold the following events on Taekwondo Day under Article 7 of the Act:
1. Taekwondo matches (including model matches);
2. Academic events, such as Taekwondo-related seminars and forums;
3. Rewards for persons of distinguished service to Taekwondo;
4. Other events concerning the dissemination and promotion of Taekwondo.
(2) The State and local governments may support Taekwondo organizations, etc. when they hold events under paragraph (1).
Article 4(Approval of master plan for park development) #
(1) A person who intends to obtain approval of a master plan for the development of a park (hereinafter referred to as "master plan") or a park development plan (hereinafter referred to as "development plan") or any amendment thereto pursuant to Article 11 (1) and (2) of the Act shall file an application for approval of a master plan or development plan or any amendment thereto with the Minister of Culture, Sports and Tourism or the Jeonbuk Special Self-Governing Province Governor, along with the documents prescribed by Decree of the Ministry of Culture, Sports and Tourism, respectively. <Amended on Dec. 24, 2024>
(2) "Modification to insignificant matters prescribed by Presidential Decree" in the latter part of Article 11 (1) and the latter part of paragraph (2) of the Act means any of the following cases:
1. Increase or decrease by up to 10/100 of the total project cost;
2. Increase or decrease by up to 10/100 of the total project area;
3. Increase or decrease by not more than 10/100 of the installation area of approved facilities and equipment;
4. Alteration of the location and structure of facilities in a project zone approved for relocation due to extenuating circumstances, such as geographical or geological conditions;
5. Alteration of the name and address of the implementer (in cases of a corporation, the name and address of the corporation and the name of its representative).
(3) Where the Taekwondo Promotion Foundation, the head of a local government, or the head of a private business entity makes any change falling under any subparagraph of paragraph (2) in the master plan or development plan, the Taekwondo Promotion Foundation, the head of the local government, or the private business entity shall notify the Minister of Culture, Sports and Tourism or the Governor of Jeonbuk Special Self-Governing Province of such fact without delay. <Amended on Dec. 24, 2024>
(4) "Other matters prescribed by Presidential Decree" in Article 11 (3) 8 of the Act means the following:
1. A drawing prepared by specifying each plan in detail on a topographical map or a cadastral map;
2. Where it is intended to expropriate or use land, goods, or rights under Article 14 (1) of the Act, the grounds therefor;
3. Where there exist deemed matters, such as permission, etc. under the subparagraphs of Article 15 (1) of the Act, the details thereof and documents necessary for consultation with the heads of relevant administrative agencies under paragraph (2) of that Article;
4. A plan for operating facilities (limited to persons who formulate development plans).
(5) The Minister of Culture, Sports and Tourism or the Jeonbuk Special Self-Governing Province Governor shall notify the applicant of whether to grant approval or approval for modification, or of whether to extend the processing period under the statutes or regulations related to the processing of civil petitions, within 180 days from the date of receipt of an application for approval or approval for modification of a master plan or development plan under paragraph (1). <Added on Feb. 7, 2017; Dec. 24, 2024>
(6) When the Minister of Culture, Sports and Tourism and the Jeonbuk Special Self-Governing Province Governor publicly notifies a master plan or a development plan pursuant to Article 11 (5) of the Act, he or she shall clarify the following matters in detail: <Amended on Feb. 7, 2017; Dec. 24, 2024>
1. The name and address of the project implementer (in cases of a corporation, the name and address of the corporation and the name of its representative);
2. The name, location, and area of the project zone;
3. The implementation period of the project;
4. An outline of the project;
5. A detailed list of land, goods, or rights under Article 14 (1) of the Act, where it is intended to expropriate or use such land, goods, or rights;
6. In cases of approval for modification, the details of previously approved matters and modified matters.
Article 5(Approval of implementation plans) #
(1) A person who intends to obtain approval of an implementation plan or approval for modification of an implementation plan in accordance with a master plan or a development plan (hereinafter referred to as "implementation plan") pursuant to Article 12 (1) of the Act shall submit an application for approval of an implementation plan or approval for modification to the Minister of Culture, Sports and Tourism or the Governor of Jeonbuk Special Self-Governing Province, respectively, along with documents prescribed by Decree of the Ministry of Culture, Sports and Tourism. <Amended on Dec. 24, 2024>
(2) "Modifications to insignificant matters prescribed by Presidential Decree" in the latter part of Article 12 (1) of the Act means cases falling under any subparagraph of Article 4 (2).
(3) Where the Taekwondo Promotion Foundation, the head of a local government, or the head of a private business entity makes any change falling under any subparagraph of Article 4 (2) in the implementation plan, the Taekwondo Promotion Foundation, the head of the local government, or the private business entity shall notify the Minister of Culture, Sports and Tourism or the Governor of Jeonbuk Special Self-Governing Province of such fact without delay. <Amended on Dec. 24, 2024>
(4) "Other matters prescribed by Presidential Decree" in Article 12 (2) 5 of the Act means the following:
1. Where the Minister of Land, Infrastructure and Transport intends to expropriate or use land, goods, or rights pursuant to Article 14 (1) of the Act, measures for relocating residents under Article 14 of the Act on Acquisition of and Compensation for Land for Public Works Projects;
2. The Detailed operational plan for each facility (only applicable to a person who formulates a development plan).
(5) The Minister of Culture, Sports and Tourism or the Jeonbuk Special Self-Governing Province Governor shall notify the applicant of whether to grant approval or approval for modification of an implementation plan or of whether to extend the processing period under the statutes or regulations related to the processing of civil petitions within 60 days from the date of receipt of an application for approval of an implementation plan or modification thereof under paragraph (1). <Added on Feb. 7, 2017; Dec. 24, 2024>
(6) When the Minister of Culture, Sports and Tourism and the Jeonbuk Special Self-Governing Province Governor publicly notifies an implementation plan pursuant to Article 12 (4) of the Act, he or she shall clarify the following matters in detail: <Amended on Feb. 7, 2017; Dec. 24, 2024>
1. The name and address of the project implementer (in cases of a corporation, the name and address of the corporation and the name of its representative);
2. The name, location, and area of the project zone;
3. The implementation period of the project (including the scheduled date of commencement and completion of construction);
4. An outline of the project;
5. In cases of approval for modification, the details of previously approved matters and modified matters.
Article 6(Preferential installation of public facilities) #
"Public facilities prescribed by Presidential Decree" in the main clause of Article 18 of the Act shall be as follows: <Amended on Jan. 26, 2017; Nov. 29, 2022>
1. Telecommunications facilities and equipment under the Framework Act on Telecommunications;
2. Gas supply facilities and gas-using facilities under the Urban Gas Business Act;
3. Firefighting water supply systems under the Framework Act on Firefighting Services;
4. Firefighting systems under the Act on Installation and Management of Firefighting Systems.
Article 7(Insignia business) #
(1) A person who intends to obtain approval from the Taekwondo Promotion Foundation or Kukkiwon under Article 21 (1) and (2) of the Act shall submit a business plan including the following matters to the chairperson of the Taekwondo Promotion Foundation or the president of Kukkiwon:
1. Name of insignia business;
2. The name and address of the project implementer (in cases of a corporation, the name and address of the corporation and the name of its representative);
3. The project period;
4. An outline of the project;
(2) When the Taekwondo Promotion Foundation and Kukkiwon Institute impose a user fee pursuant to Article 21 (3) of the Act, it shall determine the amount thereof and obtain approval from the Minister of Culture, Sports and Tourism.
Article 7-2(Standards for designation of Taekwondo grandmasters) #
(1) "Requirements prescribed by Presidential Decree, including in terms of ethics" in Article 21-2 (1) 3 of the Act means the following:
1. He or she shall have basic knowledge of professional ethics as a person in the field of Taekwondo as a worker in the field of Taekwondo, such as not committing sports corruption under subparagraph 11-2 of Article 2 of the National Sports Promotion Act;
2. He or she shall serve as an exemplary best practice in local communities, such as actively participating in volunteer service activities.
(2) Details of the requirements under the subparagraphs of paragraph (1) shall be prescribed by Decree of the Ministry of Culture, Sports and Tourism.

Article 7-3(Procedures for designation of Taekwondo grandmasters) #
(1) The Minister of Culture, Sports and Tourism may designate a person who has applied for the designation of Taekwondo grandmasters or a person recommended by the head of an institution or organization prescribed by Decree of the Ministry of Culture, Sports and Tourism as a Taekwondo grandmaster pursuant to Article 21-2 (1) of the Act.
(2) A person who intends to apply for the designation or recommendation of Taekwondo grandmasters under paragraph (1) shall submit an application or a written recommendation prescribed by Ordinance of the Ministry of Culture, Sports and Tourism to the Minister of Culture, Sports and Tourism.
(3) Where the Minister of Culture, Sports and Tourism designates Taekwondo grandmasters pursuant to Article 21-2 (1) of the Act, he or she shall publicly announce such fact on the website of the Ministry of Culture, Sports and Tourism or the Official Gazette, etc.
(4) Except as provided in paragraphs (1) through (3), matters necessary for the procedures for designating Taekwondo grandmasters shall be prescribed by Ordinance of the Ministry of Culture, Sports and Tourism.

Article 7-4(Designation of dedicated institutions) #
(1) The Minister of Culture, Sports and Tourism may designate any of the following institutions or corporations as a dedicated institution of designating Taekwondo grandmasters under Article 21-2 (8) of the Act (hereinafter referred to as "dedicated institution"):
1. Kukkiwon;
2. Taekwondo Promotion Foundation;
3. A corporation that professionally performs the duties of promoting Taekwondo among public institutions under Article 4 of the Act on the Management of Public Institutions or non-profit corporations established under Article 32 of the Civil Act.
(2) A dedicated institution shall perform the following duties:
1. Administrative support related to designation of Taekwondo grandmaster;
2. Projects for elevating honor of Taekwondo grandmasters;
3. Compilation and management of statistics related to designation of Taekwondo grandmasters;
4. Other affairs necessary for performing affairs related to designation of Taekwondo grandmasters.
(3) Where the Minister of Culture, Sports and Tourism has designated a dedicated institution pursuant to paragraph (1), he or she shall publicly announce such fact on the website of the Ministry of Culture, Sports and Tourism or the Official Gazette, etc.

Article 8(Imposition of administrative fines) #
In determining the amount of an administrative fine, the Minister of Culture, Sports and Tourism shall take into account the motive, consequences, etc. of the relevant violation, and the criteria for imposition thereof shall be as specified in the Appendix.
