ENFORCEMENT DECREE OF THE ACT ON THE ESTABLISHMENT AND MANAGEMENT OF THE NORTHEAST ASIAN HISTORY FOUNDATION

Article 1(Purpose) #

The purpose of this Decree is to prescribe matters delegated by the Act on the Establishment and Management of the Northeast Asian History Foundation and matters necessary for its enforcement.

Article 2(Ex officio directors) #

Ex officio directors of the Northeast Asian History Foundation (hereinafter referred to as the "Foundation") under Article 7(4) of the Act on the Establishment and Management of the Northeast Asian History Foundation (hereinafter referred to as the "Act") shall be as follows: <Amended on Feb. 29, 2008; Jul. 3, 2008; Mar. 23, 2013; Nov. 19, 2014; Jul. 26, 2017; Dec. 30, 2025>

1. The Vice Minister of Strategy and Finance, the Vice Minister of Education, the Vice Minister of Foreign Affairs, the Vice Minister of Unification, the Vice Minister of Justice, the Vice Minister of the Interior and Safety, the Vice Minister of Culture, Sports and Tourism, and the Vice Minister of Oceans and Fisheries (where a Ministry has 2 or more Vice Ministers, the one designated by the Minister);

2. The President of the National Institute of Korean History;

3. The President of the Academy of Korean Studies.

Article 3(Government contributions) #

(1) Where the Minister of Education contributes or subsidizes the Foundation under Article 14 of the Act each year, he or she shall review the budget request of the Foundation for contributions or subsidies under paragraph (3) and reflect it in the budget. <Amended on Feb. 29, 2008; Mar. 23, 2013>

(2) Where the budget for contributions or subsidies under paragraph (1) has been finalized, the Minister of Education shall notify the Foundation thereof. <Amended on Feb. 29, 2008; Mar. 23, 2013>

(3) The Foundation shall, by April 30 each year, submit to the Minister of Education its budget request for contributions or subsidies for the following year, accompanied by the following documents: <Amended on Feb. 29, 2008; Mar. 23, 2013; Jul. 2, 2019>

1. Project plan and cash-flow plan for the following year;

2. Estimated balance sheet and estimated statement of income and expenditure for the following year;

3. Other documents necessary to clarify the contents of the budget request for contributions or subsidies.

Article 4(Grant of government contributions) #

(1) Where the Foundation intends to receive government contributions or subsidies, it shall, by 15 days prior to the beginning of each quarter, submit to the Minister of Education an application for contributions or subsidies, accompanied by the quarterly project plan and budget execution plan. <Amended on Feb. 29, 2008; Mar. 23, 2013>

(2) Upon receipt of an application under paragraph (1), where the quarterly project plan and budget execution plan are deemed appropriate, the Minister of Education shall grant contributions or subsidies accordingly. <Amended on Feb. 29, 2008; Mar. 23, 2013>

(3) The Foundation shall, by the 15th day of the month following the end of each quarter, report to the Minister of Education the performance of projects and the results of budget execution for the quarter. <Amended on Feb. 29, 2008; Mar. 23, 2013>

Article 5(Submission of project plans and budget bills) #

The Foundation shall, pursuant to Article 17 of the Act, submit its annual project plan and budget bill to the Minister of Education by December 31 each year and obtain approval. <Amended on Feb. 29, 2008; Mar. 23, 2013>

Article 6(Reporting of settlement of accounts) #

When the Foundation submits the statement of accounts of revenue and expenditure for each fiscal year to the Minister of Education pursuant to Article 17 of the Act, it shall, by the end of February of the following fiscal year, submit the following documents: <Amended on Feb. 29, 2008; Mar. 23, 2013; Jul. 2, 2019>

1. A statement comparing the project plan for the fiscal year and the performance thereof;

2. Balance sheet and statement of income and expenditure for the fiscal year;

3. Opinion of a certified public accountant or accounting firm designated by the Minister of Education, and opinion of the auditor of the Foundation;

4. Other documents necessary to clarify the contents of the settlement of accounts.

Article 7(Request for secondment of public officials) #

(1) Where the Foundation requests the secondment of public officials, etc. pursuant to Article 18(1) of the Act, it shall submit to the Minister of Education a request for secondment stating the reasons for secondment, number of personnel, and areas of expertise and qualifications of such personnel. <Amended on Feb. 29, 2008; Mar. 23, 2013>

(2) Any person seconded to the Foundation shall perform duties during the period of secondment as determined by the Foundation.

Article 8(Corrective orders) #

Where the Minister of Education issues an order for correction or takes other necessary measures pursuant to Article 21(4) of the Act, he or she shall notify the Foundation thereof in writing, stating the details of the violation, matters to be corrected, and the deadline for correction. <Amended on Feb. 29, 2008; Mar. 23, 2013>

Article 9(Standards for imposition of administrative fines) #

The standards for imposing administrative fines under Article 26(1) of the Act shall be as prescribed in the Appendix.
