ENFORCEMENT RULES OF EARLY CHILDHOOD EDUCATION ACT

Article 1(Purpose) #

The purpose of this Rule is to define the matters committed by the Early Childhood Education Act and necessary matters regarding the enforcement thereof.

Article 2(Health Examination) #

Necessary matters regarding the time and result handling process of the health examination in accordance with the Article 17 (3) of the Early Childhood Education Act (hereafter referred to as the “Act”) shall be determined separately by the Ordinance of the Ministry of Education, Science and Technology. <Amended by Rule No. 1 on Mar. 4, 2008>

Article 3(Feeding Facility, Equipment Standard, Etc.) #

The standards of facilities and equipment that any kindergarten with a feeding program must have in accordance with Article 17 (3) of the Act shall be provided in the attached Table 1. <Amended by Rule No. 907 on Jun. 21, 2007>

A kindergarten in which more than 100 children are to be fed at once shall have one licensed nutritionist under the provisions of Article 37 of the Food Sanitation Act: provided, however, that, in the event that more than two kindergartens which have the feeding facility and equipment and conduct the feeding are close to each other, not more than five kindergartens under the jurisdiction of the same office of education may share a nutritionist under the Article 21 of the Local Education Autonomy Act.

Article 4(Child Education Fee Supporting Method) #

The range of the fees necessary for child education supported by the Minister of Education, Science and Technology and the Superintendent of Education in Special Metropolitan City, Metropolitan City and Do (hereafter referred to as “City/Do Superintendent of Education”) under the provisions of Articles 24 (3) and 26 (2) of the Act shall be as follows. <Amended by Rule No. 1 on Mar. 4, 2008>

1. Entrance Fee;

2. Tuition;

3. Meal Cost; or

4. Other expenses deemed necessary by the Minister of Education, Science and Technology and the City/Do Superintendent of Education for child education.

The support under Paragraph (1) shall be followed by the standard which is determined by the deliberation between the Minister of Education, Science and Technology and the Minister of Strategy and Finance in consideration of the household’s income level, residential area, etc. <Amended by Rule No. 1 on Mar. 4, 2008>

Article 5(Special Case of Supporting Child Education Fee) #

In the event that any children’s art institution established according to the Act on the Establishment and Operation of Private Teaching Institutes desires to change a kindergarten and satisfies the standards as provided under the provisions of the attached Table and intends to conduct child education, the City/Do Superintendent of Education may determine, through the deliberation of the City/Do child education committee, it as a child education commission institution.

The Minister of Education, Science and Technology and the City/Do Superintendent of Education shall support child education fees in accordance with the Articles 24 and 26 (1) of the Act for the children who attend the child education commission institution as determined under the provisions of Paragraph (1). <Amended by Rule No. 1 on Mar. 4, 2008>

The City/Do Superintendent of Education shall determine the necessary matters regarding the designation procedures and methods of the child education commission institution.

Article 6(Collection Method of Payment) #

Necessary matters regarding the collection method of the education fees in accordance with Article 25 of the Act and other payments shall be determined by the Ordinance of the Ministry of Education, Science and Technology. <Amended by Rule No. 1 on Mar. 4, 2008>
