Article 1(Purpose) #
The purpose of this Decree is to prescribe the matters mandated by the Special Act on Improvement of Quality of Life of Farmers and Fishers and Facilitation of Development of Agricultural and Fishing Villages and those necessary for the enforcement thereof.

Article 2(Service items in rural service standards and targets for items) #
"Service items prescribed by Presidential Decree ... and the respective targets for such items" in subparagraph 6 of Article 3 of the Special Act on Improvement of Quality of Life of Farmers and Fishers and Facilitation of Development of Agricultural and Fishing Villages (hereinafter referred to as the "Act") shall be as specified in the Appendix.

Article 2-2(Notification of master plan and action plan) #
Upon formulation of a master plan or an action plan for the improvement of quality of life of farmers and fishers and development of agricultural and fishing villages under Article 5(1) or 6(1) of the Act or modification of the relevant master plan under the former part of Article 5(2) of the Act, the Minister of Agriculture, Food and Rural Affairs shall publish such fact on the website of the Ministry of Agriculture, Food and Rural Affairs and notify a Metropolitan City Mayor, a Special Self-Governing City Mayor, a Do Governor, or a Special Self-Governing Province Governor within one month from the date of such formulation or modification.

Article 2-3(Notification of projects subject to prior consultation) #
(1) Where the committee for improvement of quality of life of farmers and fishers and development of agricultural and fishing villages under Article 10(1) of the Act (hereinafter referred to as the "Committee") notifies the heads of relevant central administrative agencies of projects subject to prior consultation under Article 9-2(1) of the Act, the following shall be included in such notification:
1. Title of the project subject to prior consultation;
2. Grounds for the selection of projects subject to prior consultation and matters requiring improvement;
3. Methods for preparing an execution plan under Article 9-2(2) of the Act.
(2) Notification under Article 9-2(1) of the Act shall be made within 10 days from the date projects subject to prior consultation are selected by the Committee.
(3) An execution plan submitted by the head of a relevant central administrative agency to the Committee under Article 9-2(2) of the Act shall include the following:
1. Direction-setting for project improvement and detailed measures therefor;
2. Measures for system improvements, including arrangement of relevant statutes or regulations;
3. Matters regarding budget adjustment for project improvement;
4. Promotion schedule for the execution plan.
(4) Submission of an execution plan under Article 9-2(2) of the Act shall be made within 2 months from the date the head of a relevant central administrative agency is notified of a project subject to prior consultation.
(5) The Committee shall notify the results of its deliberation on the execution plan under Article 9-2(3) of the Act within 10 days from the date of completion of such deliberation.

Article 3(Composition of Committee) #
The chairperson of the Committee may request that the head of a relevant central administrative agency who is not a member appear before the Committee, where deemed necessary in relation to its agenda item. <Amended on Nov. 29, 2022>

Article 4(Operation of Committee) #
(1) The chairperson of the Committee shall convene and preside over its meetings.
(2) Where the chairperson of the Committee intends to convene a meeting, he or she shall notify each member in writing of the time, venue, and agenda for the meeting at least 7 days beforehand; provided, this shall not apply in cases of urgency or unavoidable circumstances.
(3) A majority of the members of the Committee shall constitute a quorum, and any resolution thereof shall require the concurring vote of a majority of those present.
(4) A secretary shall be appointed to assist a secretary member of the Committee in administrative affairs, and shall be nominated by the secretary member from among the public officials of the Ministry of Agriculture, Food and Rural Affairs. <Amended on Mar. 23, 2013>

Article 5(Request for submission of agenda) #
Where consultation and coordination of opinions between competent central administrative agencies are deemed necessary for major policies and projects related to the improvement of welfare of farmers, fishers, etc. and education conditions in agricultural and fishing villages and regional development, the chairperson of the Committee may request that the heads of the relevant central administrative agencies submit such matters to the Committee as agenda items.

Article 6(Composition and operation of working committee for improvement of quality of life of farmers and fishers and development of agricultural and fishing villages) #
(1) The working committee for improvement of quality of life of farmers and fishers and development of agricultural and fishing villages under Article 10(8) of the Act (hereinafter referred to as "working committee") shall deliberate on the following: <Amended on Nov. 29, 2022>
1. Matters regarding formulation and adjustment of an action plan for improving the quality of life of farmers and fishers and the development of agricultural and fishing villages under Article 6(1) of the Act (hereinafter referred to as "action plan");
2. Matters regarding inspection and evaluation of an annual action plan;
3. Matters regarding overall control, coordination, inspection, and evaluation of projects financed by special rural development tax revenues under Article 41 of the Act;
4. Other matters deemed by the chairperson of the working committee to be necessary for the improvement of welfare of farmers, fishers, etc. and educational conditions in agricultural and fishing villages and regional development.
(2) The working committee shall be composed of not more than 37 members including one chairperson, taking gender into consideration, and the members shall be persons falling under the following: <Amended on Jan. 25, 2012; Sep. 9, 2013; Nov. 19, 2014; Dec. 10, 2015; Jul. 26, 2017>
1. A vice-ministerial level public official of a central administrative agency to which a member of the Committee belongs;
1-2. The Commissioner of the Statistics Korea, Commissioner General of the Korean National Police Agency, the Administrator of the National Fire Agency, the Administrator of the Rural Development Administration, the Minister of the Korea Forest Service and the Commissioner General of the Korea Coast Guard;
2. A person with extensive knowledge of and experience in welfare and education in agricultural and fishing villages and development thereof, who are commissioned by the chairperson of the working committee.
(3) The term of office of the members under paragraph 2(2) shall be 2 years.
(4) A secretary shall be appointed for the working committee, who shall be nominated by the Minister of Agriculture, Food and Rural Affairs from among the public officials of the Ministry of Agriculture, Food and Rural Affairs. <Amended on Mar. 23, 2013>
(5) The working committee may have subcommittees and special subcommittees for the efficient performance of its duties. <Added on Dec. 10, 2015>

Article 6-2(Dismissal of Committee members) #
(1) The chairperson of the Committee may dismiss a member under Article 10(4)2 of the Act if the member falls under any of the following cases: <Amended on Nov. 29, 2022>
1. Where the member is unable to perform his or her duties due to mental or physical disability;
2. Where the member engages in any misconduct in relation to his or her duties;
3. Where the member is deemed unfit as a member due to neglect of duties, injury to dignity, or other grounds;
4. Where the member admits that it is difficult for him or her to perform his or her duties.
(2) The chairperson of the working committee may dismiss a member under Article 6(2)2 if the member falls under any subparagraph of paragraph (1).

Article 7(Payment of allowances) #
Allowances may be paid to a member present at a meeting of the Committee, working committee, subcommittee or special subcommittee (hereinafter referred to as "Committee, etc.") within budgetary limits; provided, this shall not apply where a member who is a public official attends a meeting in direct connection with his or her duties. <Amended on Dec. 10, 2015>

Article 8(Cooperation from relevant institutions) #
The Committee, etc. may require provision of necessary data from relevant institutions, organizations, etc. and hear from employees of relevant institutions, organizations, etc. or experts where necessary for the performance of their duties. <Amended Dec. 10, 2015>

Article 9(Detailed rules for operation) #
Except as provided in this Decree, matters necessary for the operation of the Committee and the working committee and those necessary for the composition and operation of a subcommittee or a special subcommittee shall be determined by the chairperson of the Committee after resolutions by the Committee and the working committee. <Amended on Dec. 10, 2015>

Article 9-2(Measurement of health hazards for farmers and fishers) #
(1) Measurement of health hazards for farmers and fishers under Article 14(2) of the Act shall be made for the following: <Amended on Mar. 25, 2025>
1. Noise, vibration, hot environment, and other physical factors;
2. Pesticides, toxic gases and other chemical factors;
3. Harmful micro-organisms, products therefrom, and other biological factors;
4. Nature of their work, which is characterized by simple and repetitive tasks or excessive burden on the human body;
5. Other matters determined by the Minister of Agriculture, Food and Rural Affairs or the Minister of Oceans and Fisheries, or prescribed by ordinance of the relevant local governments.
(2) The State and local governments may conduct the following projects for support, within budgetary limits, under Article 14(2) of the Act: <Amended Mar. 25, 2025>
1. Development and distribution of equipment capable of improving working conditions for farmers and fishers;
2. Development and distribution of safety and health technologies for farmers and fishers;
3. Provision of education to prevent diseases or accidents primarily affecting farmers and fishers.
4. Other projects prescribed by the ordinance of the relevant local government in cases where the local government provides support, regarding the prevention and treatment of diseases primarily occurring in farmers and fishers.

Article 9-3(Survey on diseases affecting farmers) #
(1) The Administrator of the Rural Development Administration shall conduct an annual survey to ascertain the status of diseases affecting farmers (hereafter in this Article referred to as the "disease status survey") under Article 14(3) of the Act.
(2) A disease status survey shall include the following:
1. Matters regarding general characteristics of survey respondents, such as gender and age;
2. Matters regarding characteristics of health and safety of survey respondents;
3. Matters regarding the pathways and current status of diseases caused by farming;
4. Other matters regarding characteristics of farming environment and work.
(3) A disease status survey shall be conducted, in principle, on-site, and may be conducted concurrently using indirect methods based on statistical data and literature.
(4) The Administrator of the Rural Development Administration shall formulate a survey plan, including the standards for selecting respondents, date and method of survey, before conducting a disease status survey.

Article 9-4(Survey on diseases affecting fishers) #
(1) The Minister of Oceans and Fisheries shall conduct an annual survey to ascertain the status of diseases affecting fishers under Article 14(3) of the Act.
(2) Articles 9-3(2) through (4) shall apply mutatis mutandis to surveys under paragraph (1). In such cases, "Administrator of the Rural Development Administration" shall be construed as "Minister of Oceans and Fisheries" and "farming" as "fishing".

Article 9-5(Subsidization of medical checkup expenses for farmers and fishers) #
(1) The State or local governments may subsidize the expenses incurred in medical checkup of farmers and fishers, within budgetary limits, if it is deemed necessary for the prevention and treatment of diseases primarily affecting farmers and fishers under Article 14(4) of the Act.
(2) Specific methods, procedures and details of support under paragraph (1) shall be prescribed by the Minister of Agriculture, Food and Rural Affairs or the Minister of Oceans and Fisheries.

Article 10(Methods and standards for support for livelihood of elderly farmers and fishers) #
Policy measures for enabling elderly farmers and fishers to lead a stable life under Article 19(1) of the Act shall be governed by the farmland transfer retirement direct payment program under Chapter II of the Enforcement Regulations on Direct Payment Program for Producers of Agricultural Products. <Amended on Mar. 26, 2024>

Article 10-2(Eligibility for support in education) #
"Farmers and fishers falling short of the income standard prescribed by Presidential Decree" in Article 23(2) of the Act means farmers and fishers or their children who fall under any of the following: <Amended on Sep. 26, 2023>
1. Eligible recipients under Articles 12(3) and 12-2 of the National Basic Living Security Act;
2. Persons eligible for support under Articles 5 and 5-2 of the Single-Parent Family Support Act;
3. Persons falling under Article 104-2(2) of the Elementary and Secondary Education Act;
4. Other persons deemed by the heads of local governments to require a subsidy for the expenses and incidental expenses under Article 23 of the Act in consideration of their income levels.

Article 11(Allowances for school teachers and staff in agricultural and fishing villages) #
Allowances shall be paid to teachers and staff working for a school in an agricultural or fishing village under Article 26(3) of the Act, and the amount, scope and method of such payment shall be determined by the Minister of Education after prior consultations with the Minister of Economy and Finance and the Minister of Personnel Management. <Amended on Mar. 23, 2013; Nov. 19, 2014>

Article 12(Policy measures for conservation of natural environment and landscape of agricultural and fishing villages) #
When promoting policy measures for the conservation of the natural environment and landscape of agricultural and fishing villages under Article 30(1) of the Act, the State and local governments shall formulate and implement a natural environment and landscape conservation plan that includes the following:
1. Basic goals and direction-setting for the conservation of the natural environment and landscape of agricultural and fishing villages;
2. Matters regarding policy measures and standards for the conservation of the natural environment and landscape of agricultural and fishing villages;
3. Matters regarding activities for the conservation of the natural environment and landscape of agricultural and fishing villages and relevant support;
4. Matters regarding plans for the analysis, evaluation and management of the natural environment and landscape of agricultural and fishing villages;
5. Other matters necessary for the conservation of the natural environment and landscape of agricultural and fishing villages.

Article 12-2(Targets for establishment of comprehensive information system for agricultural and rural spatial information) #
"Agricultural and rural spatial information prescribed by Presidential Decree" in Article 32-2(1) of the Act means the following information, including locational data such as the latitude, longitude, address of the objects related to agriculture and agricultural villages, which are collected, generated or processed by a relevant agency under paragraph (2) of that Article: <Amended on Apr. 28, 2020>
1. Electronic map information of farmland that utilizes high-resolution satellite and aerial images to build area and attribute information (referring to paddies, fields, orchards, facilities, etc.) of farmland;
2. Video information of farmland from unmanned aircraft, etc.;
3. Information related to automated production, distribution, and processing facilities for agricultural, forestry or livestock products, in terms of environment, growth, control, and business management;
4. Animal disease control information, such as livestock vehicle information from the national integrated information system for animal disease control under Article 3-3(1) of the Act on the Prevention of Contagious Animal Diseases;
5. Information related to the agricultural food industry, such as business information on agriculture or fisheries under Article 4(1) of the Act on Fostering and Supporting Agricultural and Fisheries Business Entities, the public direct payment program under Article 5 of the Act on Operation of Direct Payment Program for Promoting Public Functions of Agriculture and Rural Communities, and the direct payment program under Article 3 of the Enforcement Regulations on Direct Payment Program for Producers of Agricultural Products;
6. Land-related information, such as a parcels-register for sites under Article 71 of the Act on the Establishment and Management of Spatial Data and a building register under Article 38 of the Building Act;
7. Changes in farmland, such as fertility under Article 11(1)1 of the Act on the Promotion of Environment-Friendly Agriculture and Fisheries and the Management of and Support for Organic Foods, and soil environment-related information such as soil maps;
8. Farming-related information, such as seeds under subparagraph 1 of Article 2 of the Seed Industry Act, residue limit standards of pesticide under Article 7-3 of the Food Sanitation Act, pests under subparagraph 2 of Article 2 of the Plant Protection Act, tax-exempt petroleum products under Article 15 of the Regulations on Special Cases concerning Application of Zero Rate of, or Exemption from, Value Added Tax on Materials and Petroleum Products for Agriculture, Livestock Industry, Forestry, and Fisheries;
9. Information related to disasters that occur to agricultural crops, forestry products, livestock, or agricultural facilities under subparagraph 1 of Article 2 of the Agricultural and Fishery Disaster Insurance Act and agricultural and fishery disaster insurance under subparagraph 2 of that Article;
10. Information related to distribution of agricultural or fishery products, such as prices and distribution volume of agricultural or fishery products included in a comprehensive information system on the distribution of agricultural or fishery products under Article 5-3 of the Act on Distribution and Price Stabilization of Agricultural and Fishery Products;
11. Traceability information under subparagraph 7 of Article 2 of the Agricultural and Fishery Products Quality Control Act and information related to safety of agricultural or livestock products, such as traceability information for agricultural or livestock products under subparagraph 3 of Article 2 of the Act on Livestock and Livestock Products Traceability Act;
12. Other information deemed by the Minister of Agriculture, Food and Rural Affairs to be necessary for the establishment, operation, and management of the comprehensive information system for agricultural and rural spatial information under Article 32-2(1) of the Act (hereinafter referred to as "comprehensive information system").

Article 12-3(Methods for provision of data) #
(1) The heads of relevant agencies requested to submit relevant information under Article 32-2(2) of the Act may do so by electronic means based on the linkage of inter-agency information systems.
(2) The Minister of Agriculture, Food and Rural Affairs may subsidize expenses necessary for the linkage of information systems under paragraph (1) for local governments and public institutions.

Article 12-4(Entrustment of business affairs regarding establishment, operation and management of comprehensive information system) #
(1) "Institution prescribed by Presidential Decree" in Article 32-2(4) of the Act means the Korea Agency of Education, Promotion and Information Service in Food, Agriculture, Forestry and Fisheries under Article 11-2 of the Framework Act on Agriculture, Rural Community and Food Industry.
(2) Where business affairs are entrusted under Article 32-2(4) of the Act, the Minister of Agriculture, Food and Rural Affairs may subsidize expenses necessary for the entrusted institution to perform such business affairs.

Article 13(Eligibility for support in infrastructure) #
"Grouped facilities of at least the size prescribed by Presidential Decree" in Article 36(2) of the Act means facilities whose total floor area of buildings used for the relevant purposes of facilities invested in agricultural and fishing villages is at least 1,000 square meters or whose total site area is at least 5,000 square meters.

Article 14(Assistance for quasi-agricultural and fishing villages) #
With respect to any of the following projects implemented in agricultural promotion areas and development restriction zones under Article 43 of the Act, the State and local governments may determine detailed project content and support conditions and provide necessary support, within budgetary limits:
1. Projects for improving welfare of farmers, fishers, etc.;
2. Projects for improving educational conditions;
3. Projects for regional development.

Article 15(Establishment and operation method of rural service standards) #
When establishing or modifying rural service standards under Article 44(1) and (2) of the Act, the Government shall take into consideration the demand of farmers, fishers, etc. for public services, financial conditions, and other factors.

Article 16(Methods and procedures for policy analysis and evaluation) #
(1) The heads of central administrative agencies and heads of local governments shall fully hear and reflect opinions of farmers, fishers, etc. and relevant experts when analyzing and evaluating the impact of mid-to long-term plans at the national level and relevant major policies under Article 45(1) of the Act (hereinafter referred to as "policies, etc.") on agricultural and fishing villages.
(2) When formulating guidelines for analyzing and evaluating policies, etc. under Article 45(2) of the Act, the Minister of Agriculture, Food and Rural Affairs shall include matters regarding the subject, direction, procedures, target policies and detailed standards of such analysis and evaluation. <Amended on Mar. 23, 2013>
(3) The heads of central administrative agencies and the heads of local governments shall comply with the guidelines under paragraph (2) when analyzing and evaluating the impact of policies, etc. on agricultural and fishing villages under Article 45(1) of the Act.
(4) When analyzing and evaluating the impact of policies, etc. on agricultural and fishing villages under Article 45(1) of the Act, the heads of central administrative agencies and local governments may entrust relevant experts, research institutes and organizations with research, such as questionnaire survey or opinion poll, for opinion gathering under paragraph (1) or with analysis and evaluation under paragraph (3).

Article 17(Projects subject to provision of data and scope of data) #
(1) "Projects prescribed by Presidential Decree" in the main clause of Article 47(1) of the Act means the following:
1. Projects to provide support for farmers and fishers in national insurance premium payment under Article 13 of the Act;
2. Projects to provide support for farmers and fishers in national pension payment under Article 16 of the Act;
3. Projects to provide support for farmers and fishers in childcare expenses under Article 17 of the Act;
4. Projects to extend student loans to university students from agricultural and fishing villages, among policy measures for educational environment improvement and development under Article 20 of the Act.
(2) "Data prescribed by Presidential Decree" in the main clause of Article 47(1) of the Act means the following: <Amended on Jan. 17, 2014>
1. A family relation certificate;
2. A national tax payment certificate;
3. A local tax payment certificate;
4. A certified transcript of land register and building register;
5. A certificate of payment of health insurance premiums;
6. A certificate of acquisition and loss of eligibility for health insurance;
7. A certificate of payment of national pension premiums;
8. A certified copy or abstract of a resident registration card;
9. A certificate of a land utilization plan or a comprehensive certificate of real estate;
10. A certificate of national basic livelihood recipients;
11. A certificate of co-payment reduction for persons in second-lowest income bracket;
12. A certificate of disability;
13. A certificate of a single-parent family;
14. Other data that can verify the history of benefits received from the projects implemented by the State and local governments to improve welfare of the people under statutes or regulations.

Article 18(Processing of personally identifiable information) #
(1) The Minister of Agriculture, Food and Rural Affairs (including a person entrusted to perform the business affairs of the Minister of Agriculture, Food and Rural Affairs under Article 13(4) of the Act) or the Minister of Oceans and Fisheries may process data containing resident registration numbers or alien registration numbers under subparagraph 1 or 4 of Article 19 of the Enforcement Decree of the Personal Information Protection Act, if inevitable for performing the following administrative affairs: <Amended on Mar. 23, 2013; Aug. 6, 2014; Jun. 25, 2019>
1. Administrative affairs regarding a project to send helpers to the underprivileged, among the administrative affairs related to the welfare promotion for farmers, fishers, etc. under Article 12 of the Act;
2. Administrative affairs to provide support for farmers and fishers in national insurance premium payment under Article 13 of the Act;
3. Administrative affairs regarding manpower support projects, among administrative affairs to support farmers and fishers involved in occupational accidents under Article 15 of the Act;
4. Administrative affairs to provide support for farmers and fishers in national pension payment under Article 16 of the Act;

(2) The head of a local government (including a person to whom his or her authority is delegated or entrusted if the relevant authority is delegated or entrusted) may process data including resident registration numbers or alien registration numbers under subparagraph 1 or 4 of Article 19 the Enforcement Decree of the Personal Information Protection Act, if inevitable for performing administrative affairs such as eligibility examinations for the administrative affairs listed in the subparagraphs of paragraph (1). <Amended on Aug. 6, 2014>
