ENFORCEMENT DECREE OF TRADITIONAL BULLFIGHTING MATCH ACT

Article 1(Purpose) #

The purpose of this Decree is to prescribe matters delegated by the Traditional Bullfighting Match Act and matters necessary for its enforcement.

Article 2(Public announcement of permission to hold bullfighting matches) #

When the Minister of Agriculture, Food and Rural Affairs grants permission for the holding of a bullfighting match pursuant to Article 6(1) of the Traditional Bullfighting Match Act (hereinafter referred to as the "Act"), he or she shall publicly announce the following matters in the Official Gazette: <Amended on Feb. 29, 2008; Mar. 23, 2013>

1. Name, representative, and location of the main office of the bullfighting match organizer;

2. Location of the bullfighting arena;

3. Permit number and permit date.

Article 3(Plan for hosting bullfighting matches) #

(1) Where a person who has obtained permission to hold bullfighting matches pursuant to Article 6(1) of the Act (hereinafter referred to as the "match organizer") intends to obtain approval of a plan for holding bullfighting matches pursuant to Article 6(2) of the Act, he or she shall submit a plan for holding bullfighting matches, together with documents prescribed by Decree of the Ministry of Agriculture, Food and Rural Affairs, to the Minister of Agriculture, Food and Rural Affairs no later than 60 days before the date of the first bullfighting match to be held in each year. <Amended on Feb. 29, 2008; Mar. 23, 2013>

(2) The plan for holding bullfighting matches under paragraph (1) shall include the following matters:

1. The date of the first bullfighting match;

2. The annual number of days for holding bullfighting matches;

3. The types of bullfighting matches and the annual number of matches;

4. Matters concerning the management of prize money for bullfighting matches;

5. Matters concerning the budget, etc. required for holding bullfighting matches.

Article 4(Unit betting amount and sales method of bullfighting betting tickets) #

(1) The unit betting amount of bullfighting betting tickets under Article 7 of the Act (hereinafter referred to as "betting tickets") shall be 100 won.

(2) Betting tickets shall be issued in units of the unit betting amount prescribed in paragraph (1); provided, they may be sold as combined betting tickets indicating two or more unit betting tickets on a single betting ticket.

(3) Betting tickets shall be sold after the fighting bulls to participate in the relevant bullfighting match are confirmed, and the sale thereof shall be closed before the relevant bullfighting match begins.

Article 5(Correction of the contents of betting tickets) #

(1) Where the contents of a betting ticket purchased by a purchaser differ from those applied for at the time of purchase, a request for correction may be made only where the purchaser has not left the sales counter of the betting ticket and the sale of betting tickets for the relevant bullfighting match has not yet been closed.

(2) Where a request for correction is made pursuant to paragraph (1), the match organizer shall immediately replace the relevant betting ticket with a corrected betting ticket, or, if replacement is not possible, refund the betting amount therefor.

Article 6(Posting of payout rates) #

When a match organizer closes the sale of betting tickets for each bullfighting match, the organizer shall, without delay, post the total sales amount and the payout rate per unit betting ticket for each method of betting on bullfighting matches at a designated place within the bullfighting arena.

Article 7(Requirements for permitting the installation of bullfighting arena) #

The requirements for permission to install a bullfighting arena under the former part of Article 9 (1) of the Act shall be as follows:

1. The site for the bullfighting arena shall be secured and its location shall be appropriate;

2. It shall be feasible to secure the financial resources necessary for the installation of a bullfighting arena;

3. The facility installation plan for the bullfighting arena shall comply with the standards set forth in Appendix 1.

Article 8(Restrictions on registration of fighting bulls) #

The owner of a fighting bull shall not register a fighting bull that falls under any of the following subparagraphs and is deemed unsuitable for participation in a bullfighting match:

1. A female bull;

2. A bull that falls short of the weight prescribed by the match organizer;

3. A bull determined to show signs of a contagious livestock disease or to have a disability, such as blindness.

Article 9(Registration of modifications of fighting bulls and owners of fighting bulls) #

Where any registered particulars of fighting bulls or the owners of fighting bulls, as provided for in Article 10(1) and (2) of the Act, are changed, such modifications shall be registered with the match organizer as prescribed by Decree the Ministry of Agriculture, Food and Rural Affairs. <Amended on Feb. 29, 2008; Mar. 23, 2013>

Article 10(Qualifications of referees and trainers) #

(1) Any person who intends to obtain a license as a referee or trainer pursuant to Article 10(6) of the Act shall pass a qualification examination administered by the match organizer (where a local public corporation or a local government-invested public corporation is the match organizer, referring to the head of the relevant local government; hereinafter the same shall apply in paragraph (2)).

(2) The match organizer shall determine the standards, methods, and other necessary matters concerning the qualification examination under paragraph (1) and obtain approval therefor from the Minister of Agriculture, Food and Rural Affairs. <Amended on Feb. 29, 2008; Mar. 23, 2013>

Article 11(Training of referees and trainers) #

The match organizer shall provide education and training for referees and trainers to enhance their qualifications and ensure fair operation of bullfighting matches pursuant to Article 10(7) of the Act.

Article 12(Payouts) #

(1) The payouts under Article 11(1) of the Act shall be calculated as the amount determined in accordance with the formula set forth in Appendix 2, equally divided among the relevant unit betting tickets held by persons who have correctly predicted the result of the bullfighting match; provided, however, that where such payouts are subject to taxation, the amount shall be the amount remaining after deduction of the tax calculated in accordance with the formula set forth in Appendix 3. <Amended on Jul. 2, 2019>

(2) Where there is no person who has correctly predicted the result of a bullfighting match pursuant to Article 11(3) of the Act, the payouts to be paid shall be the amount calculated in accordance with the formula set forth in Appendix 2, equally divided among each unit betting ticket. <Amended on Jul. 2, 2019>

Article 13(Public notice of sales commission rate for betting tickets) #

Where the Minister of Agriculture, Food and Rural Affairs determines, pursuant to Article 13 of the Act, the rate applicable to the sales amount of betting tickets that may be appropriated for operating expenses, etc. incurred in holding bullfighting matches, he or she shall give public notice thereof in the Official Gazette. <Amended on Feb. 29, 2008; Mar. 23, 2013>

Article 14(Disbursement of gains) #

The distribution ratios of gains under Article 15(1) of the Act shall be as follows: <Amended on Feb. 29, 2008; Mar. 23, 2013>

1. Contribution to the Livestock Development Fund under Article 36 of the Livestock Industry Act: 60/100 of the gains;

2. Investment reserves for the maintenance and expansion of the bullfighting matches: 10/100 of the gains;

3. Other regional development projects designated by the Minister of Agriculture, Food and Rural Affairs: 30/100 of the gains.

Article 15(Entrusted operation expenses) #

The expenses that a match organizer may pay to a person entrusted with the operation of bullfighting matches pursuant to Article 16(1) of the Act (hereinafter referred to as the "trustee") shall be determined through consultation with the trustee within the limit not exceeding 10/100 of the sales amount of betting tickets.

Article 16(Issuance of identification) #

A match organizer shall issue identification indicating the status of persons engaged in bullfighting matches, owners of fighting bulls, referees, and trainers, and shall require them to wear such identification within the bullfighting arena.

Article 17(Maintenance of order in bullfighting arenas) #

(1) Pursuant to Article 18(1) of the Act, a match organizer shall take the following measures to ensure the fair operation of bullfighting matches and to maintain order and other necessary matters in the bullfighting arena:

1. Suspension of unfit fighting bulls from participation;

2. Education and sanctions for the owners of fighting bulls, referees, and trainers;

3. Refusal of admission to, and issuance of orders to leave against, persons likely to disturb order in the bullfighting arena;

4. Other measures necessary to ensure the fairness of bullfighting matches.

(2) Detailed matters necessary for the measures under each subparagraph of paragraph (1) shall be determined by the match organizer.

Article 18(Provision of information on fighting bulls) #

Information and materials on fighting bulls that shall be provided for use by the general public pursuant to Article 18(2) of the Act are as follows:

1. Name, breed, weight, weight class, place of birth, match record, age, and special skills of fighting bulls;

2. Name of the owners of fighting bulls;

3. Name of the trainer, training experience, and the period of rearing fighting bulls;

4. For the purpose of Article 19(1) of the Act, a match organizer shall establish and implement plans for the welfare and safety of referees, trainers, and other persons engaged in bullfighting matches.

Article 19(Welfare of referees and trainers) #

(1) For the purpose of Article 19(1) of the Act, a match organizer shall establish and implement plans for the welfare and safety of referees, trainers, and other persons engaged in bullfighting matches.

(2) The plans for welfare and safety under paragraph (1) shall include the payment of prizes, allowances, etc. and measures for compensation for safety accidents.

Article 20(Scope of persons prohibited from purchasing betting tickets) #

The scope of persons who are prohibited from purchasing, arranging the purchase of, or receiving by transfer any betting tickets pursuant to Article 23(3) of the Act shall be as follows:

1. A person falling under Article 23(2)2 of the Act: Public officials belonging to the supervisory authority for the conduct of bullfighting matches who are engaged in duties related to the conduct of such matches;

2. A person falling under Article 23(2)5 of the Act: Trustees, match organizers, and persons who engage in affairs related to bullfighting matches under contracts or other agreements with trustees or match organizers.

Article 20-2(Processing of personally identifiable information) #

Where it is unavoidable for the performance of any of the following affairs, the match organizer may process materials containing resident registration numbers or passport numbers pursuant to Article 19 of the Enforcement Decree of the Personal Information Protection Act:

1. Affairs concerning the registration of the owners of fighting bulls pursuant to Article 10(2) of the Act;

2. Affairs concerning licenses for trainers or referees pursuant to Article 10(6) of the Act.

Article 21(Criteria for imposition of administrative fines) #

The criteria for imposing administrative fines under Article 32(1) of the Act shall be as specified in Appendix 4.
