Article 1(Purpose) #
The purpose of these Rules is to provide for matters concerning tuition and entrance fees collected by national, public, and private schools of various levels, (excluding national high schools, and hereinafter referred to as "schools"), under Article 25 of the Early Childhood Education Act, Article 10 of the Elementary and Secondary Education Act, or Article 11 of the Higher Education Act. <Amended by Rule No. 500, Feb. 26, 1982 Rule No. 730, Jan. 7, 1999; Rule No. 884, Jul. 10, 2006; Rule No. 896, Nov. 22, 2006>
Article 2(Amount of Collection) #

1. Tuition and entrance fees of national schools,(excluding elementary schools and middle schools where compulsory education is carried out under the provisions of Article 23 of the Enforcement Decree of the Elementary and Secondary Education Act), shall be determined by the head of the relevant school, taking into account the actual conditions of each school of various levels and changes in financial circumstances
2. Tuition and entrance fees of public schools,(excluding elementary schools and middle schools where compulsory educationis carried out under the provisions of Article 23 of the Enforcement Decree of the Elementary and Secondary Education Act), and private high schools, (excluding schools falling under the provisions of Subparagraphs 6 through8 of Article 90 (1) of the Enforcement Decree of the Elementary and Secondary Education Act, schools designatedby a superintendent of an office of education among specialized high schools under the provisions of Article 91 of the Enforcement Decree of the same Act, and schools designated by the Minister of Education, Science, and Technologyamong autonomous schools under the provisions of Article 105 of the Enforcement Decree of the same Act), middle schools, (excluding middle schools where compulsory education is carried out under the provisions of Article 23 of the Enforcement Decree of the Elementary and Secondary Education Act), and high citizens'schools shall be determined by a superintendent of an office of education, taking into account the actual conditions of each school of various levels and changesin financial circumstances, provided, however, that in cases of public universities, (including junior colleges), and schools as provided by a superintendent of an office of education among specialized high schools under the provisions of Article 76 of the Enforcement Decree of the Elementary and Secondary Education Act, tuition and entrance fees of such said schools shall be determined by the head of the relevant school; and
3. Tuition and entrance fees of private universities and colleges, industrial colleges, junior colleges, and distance colleges under Subparagraph 5 of Article 2 of the Higher Education Act, (hereinafter referred to as "distance colleges"), technical colleges, high schools, (limited to schools falling under Subparagraphs 6 through 8 of Article 90 (1) of the Enforcement Decree of the Elementary and Secondary Education Act, schools as prescribed by a superintendent of an office of education among specialized high schools under Article 91 of the same Enforcement Decree, and schools as prescribed by the Minister of Education, Science, and Technology among autonomous schools under Article 105 of the same Enforcement Decree), high technical schools, elementary schools, kindergartens, and other various schools shall be determined by the head of the relevant school according to the actual conditions of the relevant school, provided, however, that incases of high technical schools and kindergartens which a superintendent of an office of education deems necessary by considering the actual conditions of each school of various levels and changes in financial circumstances, he/she may have them to determine tuition and fees by obtaining the approval of the superintendent of an office of education.
(2) In cases falling under Subparagraph 1 of Paragraph (1), tuition and entrance fees of national kindergartens and middle schools shall be the same amount of tuition and entrance fees of public kindergartens, middle schools, and high schools in the same area, (referring to Gu for the Special Metropolitan City and the Metropolitan City, and City or Eup/Myeonfor other areas, and referring to neighboring Eup/Myeonwhere public kindergartens, middle schools, or high schools exist where no public kindergarten, middle school, or high school exists in the same Eup/Myeon), where the relevant school is located. <Amended by Rule No. 630, Mar. 15, 1993 Rule No. 686, Aug. 30, 1996; Rule No. 799, Feb. 9, 2002; Rule No. 896, Nov. 22, 2006>

Article 3(Exemption and Reduction of Tuition and Entrance Fees) #
(1) The head of a school may exempt or reduce tuition and entrance fees under the following conditions, provided, that in the event the head of a public middle school or high school intends to exempt or reduce tuition and entrance fees, he/she shall obtain approval from a superintendent of an office of education: <Amended by Rule No. 440, Feb. 28, 1979 Rule No. 456, Dec. 8, 1979 Rule No. 500, Feb. 26, 1982; Rule No. 551, Dec. 22, 1986 Rule No. 582, Feb. 13, 1990; Rule No. 594, Mar. 16, 1991; Rule No. 686, Aug. 30, 1996; Rule No. 754, Oct. 7, 1999; Rule No. 799, Feb. 9, 2002; Rule No. 884, Jul. 10, 2006; Rule No. 896, Nov. 22, 2006 Rule No. 153, Nov. 13, 2008>
1. Tuition and entrance fees may be exempted or reduced for all or any part of students under the actual conditions of the relevant school, provided, that in cases of national and public schools, entrance fees may be reduced only for high citizens' schools and various schools;
2. The head of a school may exempt or reduce tuition and entrance fees for a student having financial difficulties and a student for whom it is deemed necessary for the extension of his/her athletic specialty, such as sports,or the encouragement of his/her learning;
3. Tuition and entrance fees may be exempted or reduced for students of national and public athletic middle schools and public athletic high schools;
4. Tuition and entrance fees may be exempted or reduced for students attending schools designated as special purpose high schools among schools under Subparagraph 1 of Article 90 (1) of the Enforcement Decree of the Elementary and Secondary Education Act, schools falling under Subparagraphs 2 through 4 of Article 90 (1) of the Enforcement Decree of the same Act, and high schools under the provisions of Article 91-2 of the Enforcement Decree of the same Act;
5. Tuition and entrance fees may be exempted or reduced for special classes under the provisions of Article 52 (1) of the Elementary and Secondary Education Act and students attending middle and high schools attached to enterprisesestablished under the provisions of Article 52 (2) of the same Act;
6. Where the payment of tuition and entrance fees is deemed difficult due to a natural disaster/calamity, tuition and entrance fees may be exempted or reduced; and
7. For a student enrolled in the department of early childhood education of the Korea National Open University who is currently a teacher of elementary schools, tuition and entrance fees may be exempted.

(4) Private universities and colleges shall exempt tuition and entrance fees for students corresponding to ten percent of the total number of enrolled students, and persons subject to exemption due to difficulties in financial conditions, which shall be no less than thirty percent of the total persons subject to exemption. <Amended by Rule No. 569, Dec. 9, 1988 Rule No. 730, Jan. 7, 1999; Rule No. 884, Jul. 10, 2006>
(5) The total number of persons subject to exemption under Subparagraph 2 of Paragraph (1) of the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State and other laws and regulations, (excluding any person subject to the exemption of tuition and entrance fees under the Decree of the Establishment of National Schools and the Decree of the Establishment of Seoul National University), shall not exceed twenty percent of the total number of enrolled students, (in cases of universities and colleges, thirty percent of the total number of enrolled students), for national schools, and fifteen percent of the total number of enrolled students for public schools, (in the case of universities and colleges, vocational high schools, Eup/Myeon area and schools located in areas as provided in the annexed Table of Enforcement Rules of the Act on the Promotion of Education in Islands and Remote Areas, thirty percent of the number of enrolled students), respectively, provided, that in cases of middle schools and high schools, persons subject to exemption of tuition and entrance fees under the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State or other laws and regulations shall not be included in the total number of persons subject to exemption. <Amended by Rule No. 582, Feb. 13, 1990; Rule No. 654, Aug. 30, 1994; Rule No. 730, Jan. 7, 1999; Rule No. 754, Oct. 7, 1999 Rule No. 802, Mar. 21, 2002 Rule No. 884, Jul. 10, 2006>
(6) For a person who has left a school temporarily, tuition during the period of temporary absence after the following term or month shall be exempted.
(7) Where classes of school have been suspended until the preceding term or preceding month, tuition for the relevant term or month shall be exempted except during vacation periods.
(8) Tuition shall not be reduced or exempted for absence or the suspension of attendance.
(9) Where national and public universities and colleges exempt tuition and entrance fees under the provisions of Paragraph (5), persons subject to exemption due to difficulties in financial conditions shall be no less than thirty percent of the total persons subject to exemption. <Newly Inserted by Rule No. 884, Jul. 10, 2006>

Article 4(Method of Collection) #
(1) Tuition of universities and colleges, teachers' colleges, junior colleges, distance colleges, and technical colleges may be collected by credit, semester, or month as prescribed by the school regulations. <Amended by Rule No. 730, Jan. 7, 1999 Rule No. 16, Sep. 29, 2008>
(2) Tuition of high schools, middle schools, high technical schools, high citizens' schools, private elementary schools, and kindergartens shall be divided evenly and collected over four terms, (two terms for Air and Correspondence High schools), provided, that in the event the head of a school deems it inevitable when a student has filed a request of payment by month signed jointly with his/her custodian, he/she may collect said fees monthly. <Amended by Rule No. 403, Feb. 28, 1977 Rule No. 440, Feb. 28, 1979; Rule No. 500, Feb. 26, 1982 Rule No. 686, Aug. 30, 1996; Rule No. 730, Jan. 7, 1999; Rule No. 754, Oct. 7, 1999>
(3) Tuition of industrial colleges shall be collected by applied credit hour and, if necessary, it may be collected by term or month, provided, that where having a preliminary class on every course, tuition thereof shall be collected by applied subject. <Newly Inserted by Rule No. 500, Feb. 26, 1982 Rule No. 515, May 6, 1983 Rule No. 730, Jan. 7, 1999>
(4) Tuition of various schools shall be collected in accordance with the degree thereof under the provisions of Paragraphs (1) and (2). <Amended by Rule No. 582, Feb. 13, 1990>
(5) The total amount of entrance fees shall be collected at the time of entrance of students into a school.
(6) Universities and colleges, industrial colleges, teachers' colleges, junior colleges, distancecolleges, technical colleges,and other corresponding schools shall not collect tuition from a person who intends to leave school voluntarily before the beginning of a semester, (where there exists an un-enrolled period of temporary absence as otherwise determined by the head of universities and colleges after starting a semester, referring to that period). <Newly Inserted by Rule No. 827, Feb. 10, 2004 Rule No. 16, Sep. 29, 2008>
(7) When a student is transferred, tuition and entrance fees shall be collected as per any of thefollowing subparagraphs: <Newly Inserted by Rule No. 352, Jan. 6, 1975 Rule No. 440, Feb. 28, 1979; Rule No. 545, Jan. 28, 1986; Rule No. 578, Nov. 23, 1989 Rule No. 730, Jan. 7, 1999; Rule No. 16, Sep. 29, 2008>
1. Where he/she is transferred to a school of the same level with the same founder and the school from which he/she has transferred has collected tuition and entrance fees, the school to which he/she is transferred shall exempt tuition and fees thereof; and
2. Where he/she is transferred to a school of the same level, (excluding universities and colleges, industrial colleges, teachers' colleges, junior colleges, distance colleges, technical colleges, and other corresponding schools), with a different founder, the school from which he/she has transferred shall collect entrance fees and tuition up to the month of the date of transfer, and the school to which he/she has transferred shall collect only tuition from the month following the date of transfer.
(8) Tuition of students enrolled by credit hour under Article 53 of the Enforcement Decree of the Higher Education Act shall be collected by applied credit hour, and if necessary, may be collected by term or by month. <Newly Inserted by Rule No. 699, Aug. 14, 1997 Rule No. 730, Jan. 7, 1999; Rule No. 884, Jul. 10, 2006>
(9) For students who have registered without obtaining the necessary required credits for graduation after the years required for completing his/her course of study, notwithstanding the provisions of Paragraphs (1), (3), and (4), tuition of universities and colleges, industrial colleges, teachers' colleges, junior colleges, distance colleges, technical colleges, and other corresponding schools shall be collected under the standards of the following subparagraphs: <Newly Inserted by Rule No. 827, Feb. 10, 2004 Rule No. 16, Sep. 29, 2008>
1. Courses not higher than a bachelor's degree:
(a) Amount equivalent to 1/6 of the tuition for the relevant semester for one through three credits;
(b) Amount equivalent to 1/3 of the tuition for the relevant semester for four through six credits;
(c) Amount equivalent to 1/2 of the tuition for the relevant semester for seven through nine credits; and
(d) Whole amount of the tuition for the relevant semester for over ten credits.
2. Courses not lower than a master's degree:
(a) Amount equivalent to 1/2 of the tuition for the relevant semester for one through three credits; and
(b) Whole amount of the tuition for the relevant semester for over four credits.
Article 5(Date of Collection) #
(1) Date of tuition collection shall be determined by the head of a school, and it shall not be in excess of ten days prior to the beginning of the relevant term or month, provided, that the head of private universities and colleges, (including industrial colleges, teachers' colleges, junior colleges, distance colleges, technical colleges, and other corresponding schools; hereinafter the same shall apply),and the head of Korea National Open University may determine the date of collection separately as prescribed in the school regulations. <Amended by Rule No. 545, Jan. 28, 1986 Rule No. 562, Dec. 30, 1987 Rule No. 608, Dec. 17, 1991 Rule No. 636, Aug. 3, 1993 Rule No. 730, Jan. 7, 1999; Rule No. 16, Sep. 29, 2008>
(2) The head of a school may, notwithstanding the provisions of Paragraph (1), determine the date of the first tuition and entrance fee collection for the first year within fifty days, (sixty days for universities and colleges), prior to the beginning of the semester. <Newly Inserted by Rule No. 562, Dec. 30, 1987 Rule No. 578, Nov. 23, 1989 Rule No. 730, Jan. 7, 1999>
(3) Where a student has filed a request for the deferment of tuition payment signed jointly with his/her custodian, the head of a school may, where deemed inevitable, extend the fixed date of payment for two months for the amount corresponding to more than 1/3 and less than 2/3 of the tuition to be paid at the relevant term. <Newly Inserted by Rule No. 545, Jan. 28, 1986; Rule No. 578, Nov. 23, 1989 Rule No. 730, Jan. 7, 1999>
(4) Notwithstanding the provisions of Paragraph (1), with respect to middle school or high school students who pay tuition by receiving a scholarship of the State or a Local government or school expense subsidies, etc., the head of a school shall not determine the collection date of tuition prior to the delivery date of said scholarship or school expense subsidies, etc. <Amended by Rule No. 444, May 26, 1979 Rule No. 754, Oct. 7, 1999>
Article 6(Refund of Tuition, etc.) #
(1) Where tuition or entrance fees have been overpaid or erroneously paid, the whole amount concerned shall be refunded.
(2) Where a student has transferred to a school of the same level with a different founder, (excluding universities and colleges), the balance of tuition, exclusive of tuition paid up to the month of the dateof transfer, shall be refunded. <Amended by Rule No. 730, Jan. 7, 1999>
(3) In cases falling under any of the following subparagraphs, (hereinafter referred to as "grounds for refund"), previously paid tuition or entrance fees shall be refunded under the standards in the annexed Table:
1. Where a student is unable to enter, (including readmission and transfer; hereinafter the same shall apply), under laws and regulations or to continue his/her studies;
2. Where a person who has received the permission of admission has indicated his/her intention for withdrawal from admission;
3. Where an enrolled person has indicated his/her intention to leave the school voluntarily; and
4. Where a student is unable to enter the relevant school or to continue his/her studies due to disease, death, or natural disaster or other unavoidable reasons.

Article 7(Disciplinary Punishment) #
(1) The head of a school may, with respect to a person who, not less than two months after the collectiondate of tuition, is in arrears for tuition and fees, take a disposition of attendance suspension, provided, that the sameshall not apply to any case of universities and colleges as otherwise prescribed by the regulations of the relevant school. <Amended by Rule No. 699, Aug. 14, 1997 Rule No. 730, Jan. 7, 1999; Rule No. 754, Oct. 7, 1999>
(2) In the eventthat a student who must pay an entrance fee has failed to make payment thereof within the prescribed period, the head of the relevant school may revoke thepermission of admission for the relevant student.
Article 8(Additional Charge, etc.) #

Article 10(Notification, etc.) #
