Article 1(Purpose) #
The purpose of this Decree is to prescribe matters delegated by the Act on the Act on the Support of the Academy of Korean Studies and matters necessary for the enforcement thereof. <Amended on Jul. 15, 2005; Feb. 4, 2020>
Article 2(Submission of requests for contributions) #
(1) Where the Academy of Korean Studies (hereinafter referred to as the "Academy") intends to receive contributions from the Government pursuant to Article 2(1) of the Act on the Act on the Support of the Academy of Korean Studies (hereinafter referred to as the "Act"), it shall submit a request for contributions for the following year to the Minister of Education by April 30 each year, accompanied by the following documents: <Amended on Feb. 1, 1991; Jan. 29, 2001; Jul. 15, 2005; Feb. 29, 2008; Mar. 23, 2013; Feb. 4, 2020>
1. The project plan for the following year;
2. An estimated income statement and an estimated financial position statement for the following year;
3. Other documents necessary to clarify the details of the request for contributions.
(2) In the request for contributions under paragraph (1), contributions for the creation of funds and contributions for basic facilities, equipment, and operating expenses of the Academy shall be separately specified.

Article 3(Notice of confirmation of budget) #
The Minister of Education shall, when the government's contribution budget for the Academy is confirmed, notify the Academy thereof. <Amended on Feb. 1, 1991; Jan. 29, 2001; Feb. 29, 2008; Mar. 23, 2013>
Article 4(Grant of contributions) #
When the Academy intends to receive a grant of contributions, it shall submit an application for the grant of contributions, categorized into contributions for the creation of funds and contributions for basic facilities, equipment, and operating expenses of the Academy, to the Minister of Education, accompanied by a quarterly project plan and a quarterly budget execution plan. <Amended on Feb. 1, 1991; Jan. 29, 2001; Feb. 29, 2008; Mar. 23, 2013>
Article 5(Management of funds) #
(1) The funds of the Academy shall be managed by establishing a separate account from other expenses.
(2) Where the Academy intends to reduce the principal of the funds, it shall obtain approval from the Minister of Education. <Amended on Feb. 1, 1991; Jan. 29, 2001; Feb. 29, 2008; Mar. 23, 2013>
Article 6(Disposal of surplus) #
The surplus for each fiscal year shall be used to cover carried-over losses, and any remainder shall be carried forward to the following year or transferred to the funds.
Article 7(Loan of State-owned and public property) #
(1) The details, conditions, and period of the gratuitous loan and transfer of State-owned or public property under Article 3 of the Act shall be governed by a contract between the management agency of the property concerned and the Academy.
(2) Where the Academy uses property, which has been lent or permitted to be used or profited from without consideration under Article 3 of the Act, for purposes other than its original purposes, the management agency may cancel the contract or permission. The same shall also apply where the Academy uses property transferred to it for purposes other than its original purposes within 10 years.
(3) Where the management agency intends to grant a gratuitous loan, or permission for gratuitous use or profiting, or a transfer under Article 3 of the Act, it shall consult with the authority in general charge of the property concerned.
Article 8(Mutatis mutandis application of the State Property Act) #
Except as otherwise provided for in this Decree, the relevant provisions of the State Property Act or the Local Finance Act shall apply mutatis mutandis to the gratuitous loan, transfer, or gratuitous use of and profiting from State-owned or public property under Article 3 of the Act. <Amended on Jul. 15, 2005>

Article 9(Requests for secondment of research personnel) #
(1) When the Academy requests the secondment of research personnel, etc. pursuant to Article 4(1) of the Act, it shall submit a request for secondment, specifying the affiliation, position, name, and other personal information of the person to be seconded, to the head of the relevant institution or organization via the Minister of Education. <Amended on Feb. 1, 1991; Jan. 29, 2001; Feb. 29, 2008; Mar. 23, 2013>
(2) Upon receipt of a request for secondment under paragraph (1), the Minister of Education shall forward it to the head of the relevant institution or organization, accompanied by his or her opinion thereon. <Amended on Feb. 1, 1991; Jan. 29, 2001; Feb. 29, 2008; Mar. 23, 2013>
Article 10(Secondment of research personnel) #
The period of secondment, remuneration, etc. for a person seconded to the Academy pursuant to Article 4 of the Act shall be determined by consultation between the institution or organization seconding the research personnel and the Academy; provided, if other provisions exist in relevant statutes concerning the secondment of a public official, such provisions shall apply to the secondment of the relevant public official.
Article 11(Service of seconded persons) #
A person seconded to the Academy shall serve as determined by the Academy during the period of secondment and shall be subject to the direction and supervision of the President of the Academy.
Article 12(Submission of project plans) #
(1) The Academy shall prepare a project plan and a budget for each fiscal year pursuant to Article 7 of the Act and submit them to the Minister of Education by the beginning of the relevant fiscal year. <Amended on Feb. 1, 1991; Jan. 29, 2001; Feb. 29, 2008; Mar. 23, 2013>
(2) In the project plan under paragraph (1), objectives, policies, major projects, and the required budget shall be separately indicated.
(3) Where the Academy intends to change the details of major projects in a project plan, it shall report the reasons for and details of such change to the Minister of Education. <Amended on Feb. 1, 1991; Jan. 29, 2001; Feb. 29, 2008; Mar. 23, 2013>
Article 13(Settlement reports) #
The statement of accounts for revenues and expenditures under Article 8 of the Act shall be accompanied by the following documents: <Amended on Feb. 4, 2020>
1. A table of project execution performance;
2. An income statement and a financial position statement for the relevant year;
3. Other materials capable of clarifying the details of the settlement.
Article 14(Mutatis mutandis provisions) #
Where the Academy receives contributions from the head of a central government agency (referring to the head of a central government agency under Article 6(2) of the National Finance Act) other than the Minister of Education or from the head of a local government, the provisions of Articles 2 through 4, 12, and 13 shall apply mutatis mutandis. In such cases, "Minister of Education" shall be deemed "head of the relevant central government agency or head of the relevant local government." <Amended on Feb. 1, 1991; Jan. 29, 2001; Jul. 15, 2005; Dec. 29, 2006; Feb. 29, 2008; Mar. 23, 2013>
Article 15(Criteria for imposing administrative fines) #
The criteria for imposing administrative fines under Article 11(1) of the Act shall be as set forth in the Appendix.
