ENFORCEMENT DECREE OF THE REGISTRATION OF PUBLISHING COMPANIES AND PRINTING OFFICES ACT

Article 1(Purpose) #

The purpose of this Decree is to provide for the matters delegated by the Registration of Publishing Companies and Printing Offices Act and those necessary for its execution.

Article 1-2(Application for Registration) #

(1) Any person who intends to run a publishing company or a printing office under Article 3 (1) of the Registration of Publishing Companies and Printing Offices Act (hereinafter referred to as the “Act”) shall submit a registration application pursuant to the attached Form No. 1 to be attached by the document specified in the following subparagraphs to the head of Si/Gun/Gu (referring to an autonomous Gu; hereinafter referred to as the “registration authority”):

1. In case a publishing company or a printing office is a juristic person, a certified copy of registration of the juristic person; and

2. In case of a printing office, document certifying one has an ownership or a right for use such as the sales contract or the lease contract, etc.

(2) The term “printing facilities” referred to in Article 2 (2) of the Act means one or more facilities among the lithography, typography, photogravure, screen printing, typesetting, photoengraving, or bookbinding facilities.

Article 2(Application for Change of Registered Matters) #

In case any matter entered in on the registration application referred to in the provisions of Article 1-2 is changed, the registration for change shall be applied to the competent registration authority using the attached Form No. 2 not later than 10 days from the day on which changes have been made. <Amended by Presidential Decree No. 14372, Aug. 31, 1994>

Article 3(Issuance of Registration Certificate) #

(1) The registration authority shall issue a registration certificate with the attached Form No. 3 to those who have completed registration procedures as provided in Article 1-2. <Amended by Presidential Decree No. 6823, Aug. 23, 1973>

(2) The registration authority shall issue a revised certificate where relevant parts are revised when it has completed the registration for change under the provisions of Article 2. <Amended by Presidential Decree No. 6823, Aug. 23, 1973>

Article 4(Report on the State of Registration) #

In case of registration (including the changed registration) of publishing companies or printing offices, the registration authority shall report the state of registration with the attached Form No. 4 to the Minister of Culture and Tourism through the Special Metropolitan City Mayor, Metropolitan City Mayor, or Do governor (hereinafter referred to as “Mayor/ Do governor”) every quarter of the year not later than the 10th day of the month immediately after the relevant quarter. <Amended by Presidential Decree No. 16376, Jun. 8, 1999>

Article 5(Presentation of Publication) #

(1) Two specimen copies of every publication shall be presented to the Minister of Culture and Tourism under the provisions of Article 4 of the Act with the written presentation in the attached Form No. 5 within 15 days after its publication. (2) Minister of Culture and Tourism shall issue a presentation certificate in the attached Form No. 6 to those who have completed the presentation of publication under the provisions of paragraph (1). <Amended by Presidential Decree No. 12895, Jan. 3, 1990; Presidential Decree No. 13869, Mar. 6, 1993; Presidential Decree No. 14372, Aug. 31, 1994; Presidential Decree No. 16376, Jun. 8, 1999>

Article 6(Return of Registration Certificate) #

(1) In case where those who made the registration of a publishing company or a printing office have closed their businesses, they shall return without delay the registration certificates to the competent registration authority as provided in Article 5 (1) of the Act.

(2) On receipt of the return of registration certificate, the registration authority shall report the business closing state pursuant to the attached Form No. 4 as of every quarter of the year to the Minister of Culture and Tourism through Mayor/Do governor by the 10th day of the month immediately after the relevant quarter.
