Article 34(Delegation and entrustment of authority) #
(1) Pursuant to Article 27(1) of the Act, the Minister of Patriots and Veterans Affairs shall delegate the authority over the following matters to the head of a regional or district office of patriots and veterans affairs (referring to the Governor of Jeju Special Self-Governing Province, if the domicile or the location of the relevant school) having jurisdiction over the domicile of a veteran (referring to the location of the relevant school in cases of authority specified in subparagraph 7); provided, if the Governor of Jeju Special Self-Governing Province is delegated, the authority transferred to the Governor pursuant to Article 347 of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City shall be excluded from the authority over the following matters: <Amended on Dec. 21, 2006; Mar. 27, 2007; Dec. 20, 2007; Feb. 29, 2008; Jun. 25; 2008; Apr. 17, 2012; Jan. 14, 2014; Sep. 22, 2020, Oct. 19, 2021, May 23, 2023>
1. The following authority under Article 4 of the Act and Articles 2,2-2, and 2-3 of this Decree:
a. Receipt of applications for benefits and determination of eligibility for application of the Act;
b. Issuance and reissuance of patriots and veterans registration cards and the utilization of the operating system;
c. Receipt of applications for issuance of documents certifying veterans' eligibility for benefits and issuance of such documents;
2. Fact-finding surveys under Article 8 of the Act;
3. Acceptance of applications for education or training, receipt of applications for vocational skills development training, and recommendation of eligible persons for such development training to institutions conducting vocational skills development training under Article 13 of the Act and Article 14 of this Decree;
3-2. Receipt of applications for designated employment and for change of designated employment under Article 14 of the Act and Article 15 of this Decree;
4. Receipt of applications for job seeking and acceptance of applications for counseling, etc. under Article 14 of the Act and Article 17 of this Decree;
5. The following authority under the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State (hereinafter referred to as the "Act applicable mutatis mutandis"), which shall apply mutatis mutandis pursuant to Article 14(2) of the Act:
a. Recommendation of persons entitled to employment support under Article 32 of the Act applicable mutatis mutandis;
b. Receipt of notification of the fixed number and employment of public officials in technical service, etc. by State agencies, etc., verification and inspection of the actual employment status by such agencies, etc., request for correction or supplementation from such agencies, etc., and receipt of notification of the results by such agencies, etc. under Article 33 of the Act applicable mutatis mutandis;
c. Receipt of reports by enterprises, etc., requests by public officials under the relevant jurisdiction for explanations to ascertain the actual conditions of enterprises, etc., and instructions on requests for submission of relevant materials under Article 33-3 of the Act applicable mutatis mutandis;
d. Employment orders and employment notifications under Article 34 of the Act applicable mutatis mutandis;
e. Request for correction of discriminatory treatment and acceptance of notification of the results under Article 36 of the Act applicable mutatis mutandis;

6. Acceptance of applications for business start-up training or for counseling on business start-ups under Article 17 of the Act and Article 20 of this Decree;
6-2. Verification of proactive job-seeking activities under Article 18-2(2) of the Act and Article 20-3(3) of this Decree;
6-3. Acceptance of applications for the payment of incentives for job changes, determination and notification of such payments, and payment of the incentives under Article 18-2(6) of the Act and Article 20-3 of this Decree;
6-4. Prior notification of suspension of payment and notification of determination under Article 18-3(1) of the Act and Article 20-5(1) and (2) of this Decree;
6-5. Recovery of incentives for job changes under Article 18-3(2) of the Act and Article 20-7 of this Decree;
6-6. Disposition of the write-off of incentives for job changes as losses under Article 18-3(3) of the Act;
7. Receipt of applications for subsidies for admission and tuition fees, payment of such subsidies, and issuance of certificates of eligibility for educational benefits under Article 19 of the Act and Article 22 of this Decree;
7-2. Investigations, inquiries, and requests for the provision of financial information, etc. to verify eligibility for educational benefits under Articles 19-2 through 19-4 of the Act and Article 22-3 of this Decree;
8. Receipt of applications for, and provision of, prosthetic devices and receipt of requests for the repair of prosthetic devices under Article 20-2 of the Act and Article 23-2 of this Decree;

10. The following authority under the Act applicable mutatis mutandis pursuant to Article 21(5) of the Act:
a. Acceptance of applications for loans and determination of loans under Article 52 of the Act applicable mutatis mutandis (applicable only to the authority over persons determined by the Financial Services Commission who fail to repay their obligations within the agreed period in commercial transactions, such as financial transactions; hereafter in items b and f, the same shall apply);
b. Delivery of payment guarantee certificates, issuance of certificates of loaned property, acquisition of securities, entry of guarantors, acquisition of other securities, and approval for substitution of secured property under Article 56(1) through (5),(7), and (8) of the Act applicable mutatis mutandis;

f. Acceptance of reports on the succession of loan obligations under Article 62(2) of the Act applicable mutatis mutandis;
11. Request for, and acquisition of, pension security under Article 21(6) of the Act;
12. Determination of the number of households to be preferentially parceled out for housing and the criteria for selecting persons eligible for occupancy under Article 22 of the Act and Article 31 of this Decree;
12-2. Receipt of applications for the issuance of certificates of eligibility for legal aid and issuance of such certificates under Article 23-2 of the Act and Article 32-2 of this Decree;
13. Determination of exclusion from eligibility for application of the Act or of eligibility for such application, and request for verification of criminal records under Article 25 of the Act;
14. Imposition and collection of administrative fines under Article 29 of the Act and Article 35 of this Decree;
15. Receipt of notification of employment, etc. under Article 61-2 of the Enforcement Decree of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State, which shall apply mutatis mutandis pursuant to Article 16;
16. Receipt of a notice of changes in enrollment status under Article 22(5).
(2) The Minister of Patriots and Veterans Affairs may entrust the following business affairs to the Korea Veterans Health Service under the Korea Veterans Health Service Act, schools under Article 2 of the Higher Education Act, and other relevant specialized institutions, pursuant to Article 27(3) of the Act: <Amended on Jan. 14, 2014; Oct. 19, 2021; May 23, 2023>
1. Educational programs for social adaptation and occupational education and training under Article 13(1) of the Act;
2. Education on business start-up under Article 17 of the Act.
(3) The Minister of Patriots and Veterans Affairs shall entrust banks under Article 2(1)2 of the Banking Act with business affairs regarding the provision of loan services under Article 21 of the Act (excluding business affairs regarding the provision of loan services for persons determined by the Financial Services Commission who fail to repay their obligations within the agreed period in commercial transactions, such as financial transactions), pursuant to Article 27(3) of the Act. <Added on Mar. 27, 2007; Feb. 29, 2008; Nov. 15, 2010; Jan. 14, 2014; May 23, 2023>
