Article 1(Purpose) #
The purpose of this Decree is to prescribe matters necessary for the scope of, and standards for, the suspension or reduction of subsidies to political parties, if the subsidies are suspended or partially reduced under Article 20 of the Political Fund Act (hereinafter referred to as the "Act").
Article 2(Reduction of subsidies) #
(1) If any political party that has received a subsidy falls under subparagraph 1 of Article 20 of the Act, the National Election Commission shall deduct an amount corresponding to one of the following, from any future subsidies to be paid to the relevant political party: <Amended on Dec. 31, 1997>
1. Where the subsidy is used for purposes other than those under Article 19 (1) of the Act, an amount equivalent to twice the amount of subsidy used;
2. Where the amount used for the purpose under Article 19 (1) 5 of the Act in violation of Article 19 (2) of the Act is less than 20/100 of the total subsidy amount, an amount equivalent to twice the shortfall amount.
(2) If any political party that has received a subsidy falls under subparagraph 2 of Article 20 of the Act, the National Election Commission shall deduct an amount corresponding to one of the following, from any future subsidies to be paid to the relevant political party: <Amended on Nov. 14, 2001>
1. Where a report under Article 24 of the Act is not submitted without good cause, an amount equivalent to the following:
a. Where the Central Party fails to submit the report: 25/100 of the total subsidy paid to the relevant political party in the relevant year;
b. Where a City/Do party branch or a local party chapter fails to submit the report: Twice the amount of the subsidy (excluding the subsidies transferred to the Central Party and other City/Do party branches or local party chapters) received by the relevant City/Do branch or local party chapter in the relevant year;
2. Where false information is given in report under Article 24 of the Act, twice the amount equivalent to the difference between the reported and actual figures.
Article 3(Suspension of Payment of Subsidies) #
The National Election Commission shall suspend the payment of subsidies to a political party for the following year, if a fact arises that falls under any subparagraph of Article 20 of the Act within 1 year after the political party that has received a subsidy has been subject to reduction measures under Article 2 on at least 2 occasions within the preceding 3 years.
