ENFORCEMENT DECREE OF THE PROMOTION OF DISTRIBUTION INDUSTRY RATIONALIZATION ACT

Article 1(Purpose) #

The purpose of this Decree is to provide the matters necessary for the execution of Promotion of Distribution Industry Rationalization Act (hereinafter referred to as the “Act”). <Amended by Presidential Decree No. 14945, Mar. 14, 1996>

Article 2(Project Subject) #

The term “project as prescribed by the Presidential Decree” as referred to in the subparagraph 8 of Article 3 in the Act means the project as stipulated in the following subparagraphs: <Amended by Presidential Decree No. 14945, Mar. 14, 1996>

1. Joint shipping project operated by the association and the central organization by the Agricultural Cooperatives Act, and the Fisheries Cooperative and a fishing village fraternity by the Fisheries Cooperatives Act;

2. Project concerning systematization of distribution information between a producing center and consumers;

3. Education and training of persons who are engaged in distribution industry, and investigation and research project for distribution industry rationalization; and

4. Joint purchasing project by consumers.

Article 3(Establishment of Enforcement Plan, etc.) #

(1) As stipulated under the provisions of the Article 5 (2) of the Act, the heads of the authorities concerned shall establish an annual enforcement plan for promotion of distribution industry rationalization (hereinafter referred to as the “enforcement plan”) every year and present the enforcement plan to the Minister of Trade, Industry and Energy by the end of May of the previous year. <Amended by Presidential Decree No. 14438, Dec. 23, 1994: Presidential Decree No. 14945, Mar. 14, 1996>.

(2) The following matters shall be included in the enforcement plan in paragraph (1): <Amended by Presidential Decree No. 14945, Mar. 14, 1996>

1. A fundamental direction of the measures for distribution industry rationalization by jurisdiction;

2. A detailed project plan (this shall include the contents of the project, the principal body of the project, the funds required, a plan to raise the funds and a method to enforce the project);

3. A preparation measure for the funds and administrative support, etc.; and

4. The necessary matters to promote the enforcement other than subparagraphs 1 through 3.

(3) The heads of the authorities concerned shall present a current execution record of the enforcement plan as of the date at the end of the year to the Minister of Trade, Industry and Energy by the end of March of the next year. <Amended by Presidential Decree No. 14438, Dec. 23, 1994: Presidential Decree No. 14945, Mar. 14, 1996>

Article 4(Public Organizations) #

As stipulated in Article 8 of the Act, public organizations are as follows:

1. The Rural Development Corporation under the Rural Development Corporation Act;

2. Cooperatives and their Federation under the Agricultural Cooperatives Act;

3. The fisheries cooperatives under the Fisheries Cooperatives Act;

4. The Small and Medium Enterprise Cooperatives under the Small and Medium Enterprise Cooperatives Act;

5. The chambers of commerce and industry and the Korea Chamber of Commerce and Industry under the Chambers of Commerce and Industry Act; and

6. The Livestock Promotion Federation under the Livestock Industry Act.

Article 9(Composition of Committee on Promotion of Distribution Rationalization) #

(1) As stipulated in Article 17 of the Act, the Committee on Distribution Rationalization (hereinafter referred to as the “Committee”) shall be composed of not more than fifteen members, including a chairman. <Amended by Presidential Decree No. 14945, Mar. 14, 1996>

(2) The chairman shall be the Minister of Trade, Industry and Energy, and the members shall be the person under the following subparagraphs: <Amended by Presidential Decree No. 14945, Mar. 14, 1996: Presidential Decree No. 15135, Aug. 8, 1966>

1. The Vice Minister of Trade, Industry and Energy;

2. The Vice Minister of Home Affairs;

3. The Vice Minister of Agriculture and Forestry;

4. The Vice Minister of Health and Welfare;

5. The Vice Minister of Construction and Transportation;

5-2. The Vice Minister of Maritime Affairs and Fisheries;

6. The Industry and Information Secretary of the Presidential Secretariat;

7. The Second Administrative Coordinator of the Administrative Coordination Office for the Prime Minister;

8. The Vice Chairman of Fair Trade Commission; and

9. Four persons who are entrusted by the Minister of Trade, Industry and Energy among persons of learning and experience in distribution industry.

Article 10(Duty of Chairperson) #

(1) The chairman shall represent the Committee, and exercise the overall control of the Committee.

(2) When the chairman is unable to perform his duties due to an accident, a committee member nominated by the chairman in advance shall act an his behalf.

Article 11(Meetings) #

(1) The chairman shall convene a meeting of the Committee (hereinafter referred to as the “meeting”), and preside over it.

(2) A meeting of the committee shall be held with attendance of a majority of the members including the chairman, and a decision shall be taken by an affirmative vote of a majority of the members present.

(3) The chairman shall have a right to vote, and in the event of an equality of votes, he shall have a casting vote.

Article 12(Secretary, etc.) #

(1) There shall be one secretary and one clerk, respectively, in the committee.

(2) The Minister of Trade, Industry and Energy shall nominate the secretary and the clerk from among public officials affiliated with the Ministry. <Amended by Presidential Decree No. 14438, Dec. 23, 1994: Presidential Decree No. 14945, Mar. 14, 1996>

(3) The secretary shall manage the affairs of the committee under the order of the chairman, and the clerk shall assist the secretary.

Article 13(Minutes) #

The committee shall prepare and keep a minutes.

Article 14(Allowance) #

Allowance may be paid to the members present who are not public officials within the limit of the budget.

Article 15(Detailed Regulations for Management) #

Matters necessary to manage the committee other than those stipulated in this Decree shall be determined by the chairman through a resolution of the committee.

Article 16(Establishment of Committee on Promotion of Local Distribution Rationalization) #

(1) The Committee on Promotion of Local Distribution Rationalization (hereinafter referred to as the “Local Committee”) shall be constituted in the Seoul Special Metropolitan City, Metropolitan Cities and Dos (hereinafter referred to as the “City/ Do”) in order to deliberate matters necessary for the enforcement of distribution industry rationalization business by local governments as stipulated in the Article 7 (1) of the Act. <Amended by Presidential Decree No. 14945, Mar. 14, 1996>

(2) Matters necessary for the organization and management of the local committee shall be determined by the Municipal Ordinance of City/Do concerned.
