Article 1(Purpose) #
The purpose of this Decree is to provide for such matters as are entrusted from the Early Childhood Education Promotion Act and for matters needed for the enforcement thereof.
Article 2(Comprehensive Plan for Early Childhood Education) #
(1) In accordance with the provisions of Article 3 of the Early Childhood Education Promotion Act (hereinafter referred to as the “Act”), the Minister of Education and Human Resources Development shall establish a mid-term and long-term comprehensive plan for early childhood education, and then, synthesize, adjust, and manage such tasks as are required by the comprehensive plan. <Amended by Presidential Decree No. 17115, Jan. 29, 2001>
(2) Pursuant to the provisions of Article 3 of the Act, the Superintendent of the Office of Education shall establish and execute a comprehensive plan for early childhood education for the Special Metropolitan City, Metropolitan City and Do (hereinafter referred to as the “City/ Do”), in accordance with the mid-term and long-term comprehensive plan for early childhood education under paragraph (1).
(3) The comprehensive plan for early childhood education for the “City/ Do”, under paragraph (2), shall include the following subject matters:
1. Matters concerning the new establishment, or enlargement, of public kindergartens;
2. Matters concerning financial support for private kindergartens;
3. Matters concerning the in-service training of kindergarten teachers;
4. Matters concerning the catering of food, etc. for kindergarten students;
5. Matters concerning support for the class operation of longer-hours class system or all-day-long class system;
6. Matters concerning the designation and operation of priority regions for investment in early childhood education; and
7. Matters concerning task cooperation with day-care facilities.
Article 3(Execution Plan) #
(1) For the purpose of executing the mid-term and long-term comprehensive plan for early childhood education under Article 2 (1), the Minister of Education and Human Resources Development shall establish, no later than the last day of October, every year, the execution plan for the next year, and shall notify it to the Superintendent of the Office of Education. <Amended by Presidential Decree No. 17115, Jan. 29, 2001>
(2) Based upon the comprehensive plan for early childhood education for the “City/ Do” under Article 2 (2) and the execution plan under paragraph (1), the Superintendent of the Office of Education shall establish the execution plan for the “City/ Do” and shall carry out such tasks as required by the execution plan.
Article 4(Free Education) #
(1) The free education for one year right before the beginning of the elementary school education under Article 4 (1) of the Act, shall be governed by the provisions of Article 65 of the Enforcement Decree of the Elementary and Secondary Education Act.
(2) The free education under paragraph (1) shall be carried out in the following ways: <Amended by Presidential Decree No. 17115, Jan. 29, 2001>
1. Exemption of the total amount of the entrance fee and tuition for all the children on the list of the free education who attend a public kindergarten;
2. In case of private kindergartens, quarterly grant of the amount derived from the multiplication of the subsidy per kindergarten student as given a public notice of every year by the Superintendent of the Office of Education, by the number of the kindergarten students who are on the list of the free education and who attend the private kindergarten concerned; and
3. As for the budget needed for the free education, quarterly grant of it from the Minister of Education and Human Resources Development to the Superintendent of the Office of Education.
Article 5(Function of Early Childhood Education Promotion Committee) #
The early childhood education promotion committee that is to be installed at the “City/ Do” under Article 5 of the Act (hereinafter referred to as the “Promotion Committee”), shall deliberate on the following subject matters:
1. The comprehensive plan for early childhood education for the “City/ Do” and its execution plan;
2. Necessary matters for the execution of the free education; and
3. Other necessary matters for the promotion of early childhood education.
Article 6(Composition of Promotion Committee) #
(1) The Promotion Committee shall consist of 9 to 15 members including the chairman of the Promotion Committee.
(2) The chairmanship of the Promotion Committee shall be filled in by the vice Superintendent of the Office of Education, and the members of it shall be appointed or commissioned by the Superintendent of the Office of Education out of such people as fall under one of the following subparagraphs:
1. Local public officials of not lower than Grade Ⅳ, or supervisory officials, who are in charge of administrative affairs for early childhood education at the district office of education of the “City/ Do”;
2. Local public officials of not lower than Grade Ⅳwho are in charge of infants and preschool-children day-care affairs at the “City/ Do”;
3. Assistant professors or professors of higher rank of a junior college, a college, or a university who majored in early childhood education or other subjects related to early childhood education;
4. Those who have founded and then run a kindergarten;
5. Those who have opened and then run day-care facilities;
6. Kindergarten teachers;
7. Parents or other official guardians of those children who attend a kindergarten; and
8. Such other people as are equipped with knowledge and experience in early childhood education.
(3) The term of office for the members of the Promotion Committee shall be two years, and they may be reappointed: the term of office for such members under paragraph (2) 1 and 2 shall be the period of their holding their office.
Article 7(Meetings, etc. of Promotion Committee) #
(1) The chairman of the Promotion Committee shall convene meetings for the Committee and shall act as chairman at those meetings.
(2) Attendance of a majority of the whole Promotion Committee members shall constitute a quorum for a valid meeting of the Promotion Committee, and decisions shall be made by a concurrent vote of a majority of members present.
(3) Necessary matters, except for those as are prescribed in this Decree, for the operation of the Promotion Committee, shall be determined by the chairman of the Promotion Committee via the resolution of the Promotion Committee.
Article 8(Support for Educational Expenses of Welfare Recipients, etc.) #
(1) Those for whom the State or local governments shall pay their early childhood educational expenses pursuant to the provisions of Article 9 of the Act, are as follows: <Amended by Presidential Decree No. 17115, Jan. 29, 2001>
1. Such welfare recipients as prescribed in the Protection of Minimum Living Standards Act; and
2. The children who do not fall under the provisions of subparagraph 1 but are of such household whose monthly income falls below the amount determined through consultation between the Minister of Education and Human Resources Development and the Minister of Planning and Budget.
(2) As for the children that fall under the provisions of paragraph (1) 1, the total amount of their tuition and entrance fee shall be exempted, and as for the children who fall under the provisions of paragraph (1) 2, as much of their tuition and entrance fee as the budget allows shall be exempted at the time they are to be paid off.
(3) The Superintendent of the Office of Education shall make quarterly subsidies, to private kindergartens, of the equivalent amount of money exempted off of the tuition and entrance fee pursuant to the provisions of paragraph (2).
(4) Every year, the Minister of Education and Human Resources Development shall make a quarterly grant, to the Superintendent of the Office of Education, of the budget needed for the support for the educational expenses of the welfare recipients, etc. <Amended by Presidential Decree No. 17115, Jan. 29, 2001>
Article 9(Grant to Private Kindergartens) #
(1) Pursuant to the provisions of Article 10 of the Act, the Minister of Education and Human Resources Development may give to the Superintendent of the Office of Education a grant of which the purpose is to cover part of the expenses needed for the foundation and operation of private kindergartens. <Amended by Presidential Decree No. 17115, Jan. 29, 2001>
(2) Under the conditions as prescribed by the Municiple Ordinance, the Mayor/Do governor may give to private kindergartens subsidies of which the purpose is to cover part of the expenses needed for the foundation and operation of private kindergartens.
(3) Under the conditions as prescribed by the Municiple Rule of the Si/ Gun/autonomous Gu concerning the support for educational expenses, the head of Si/Gun/autonomous Gu may give to private kindergartens subsidies of which the purpose is to cover part of the expenses needed for the foundation and operation of private kindergartens.
Article 10(Equal Opportunities for Education and In-Service Training) #
In establishing or executing educational or in-service training plans for teachers, the Minister of Education and Human Resources Development or the Superintendent of the Office of Education shall treat kindergarten teachers and teachers of higher-level schools in an equal manner, leaving no doubt about discriminatory practices against kindergarten teachers. <Amended by Presidential Decree No. 17115, Jan. 29, 2001>
