ENFORCEMENT DECREE OF THE FOREIGN NONGOVERNMENTAL AID ORGANIZATIONS ACT

Article 1(Purpose) #

The purpose of this Decree is to prescribe matters delegated by the Foreign Nongovernmental Aid Organizations Act and matters necessary for the enforcement thereof. <Amended by Presidential Decree No. 20871, Jun. 25, 2008>

Article 2(Registration) #

(1) When a foreign nongovernmental aid organization intends to register under Article 4 (1) of the Foreign Nongovernmental Aid Organizations Act (hereinafter referred to as the "Act"), the representative thereof shall submit the application for registration of the foreign nongovernmental aid organization in Annexed Form 1, attaching thereto, a recommendation for registration issued by the foreign official residence in Korea or the government of his/her own country to the Minister of Health and Welfare <Amended by Presidential Decree No. 20679, Feb. 29, 2008; Presidential Decree No. 20871, Jun. 25, 2008; Presidential Decree No. 22075, Mar. 15, 2010; Presidential Decree No. 25857, Dec. 16, 2014>

(2) Where an application is made pursuant to paragraph (1), the Minister of Health and Welfare shall register it within ten days from the date of application, unless it is deficient, and shall issue a certificate of registration of foreign nongovernmental aid organization in Annexed Form 2 to the relevant organization. <Amended by Presidential Decree No. 20871, Jun. 25, 2008; Presidential Decree No. 22075, Mar. 15, 2010>

Article 3(Reporting on Changes) #

Where any of the following registered matters falling under any of the changes, the representative of any foreign nongovernmental aid organization shall submit an application to change a registered matter of foreign nongovernmental aid organization in Annexed Form 3 pursuant to Article 4 (3) and (4) of the Act, to the Minister of Health and Welfare: <Amended by Presidential Decree No. 20679, Feb. 29, 2008; Presidential Decree No. 20871, Jun. 25, 2008; Presidential Decree No. 22075, Mar. 15, 2010>

1. Name;

2. Representative;

3. Location of the office;

4. Purpose business.

Article 4(Scope of Introduced Goods Subject to Exemption from Customs Duties) #

The term “goods prescribed by Presidential Decree” in Article 5 (1) of the Act means any of the following goods: <Amended by Presidential Decree No. 22075, Mar. 15, 2010>

1. Goods for medical purposes in areas with insufficient medical services, and medicines, sanitary aids, medical devices and rescue vehicles used by medical institutions or social welfare organizations, and other goods exclusively for medical institutions;

2. Goods for education in any level of school under the Elementary and Secondary Education Act or Higher Education Act;

3. Goods for relief of any of the following persons:

(a) A recipient of assistance under the National Basic Living Security Act;

(b) Recipient of relief under the Disaster Relief Act;

(c) Other persons deemed as recipients of relief by the Minister of Health and Welfare and the Special Metropolitan City Mayor, Metropolitan City Mayor, Do governor or the Governor of a Special Self-Governing Province (hereinafter referred to as the "Mayor/Do governor");

4. Goods for local welfare projects deemed by the Minister of Health and Welfare and the Mayor/Do governor;

5. Goods for business purposes or goods for operation of a social welfare foundation or social welfare facility established under the Social Welfare Services Act;

6. Goods for business of registered foreign nongovernmental aid organizations.

Article 11(Notification, etc. of Cancellation of Registration) #

(1) When the Minister of Health and Welfare cancels registration of a foreign nongovernmental aid organization pursuant to Article 7 of the Act, he/she shall notify such fact to the representative of the relevant foreign nongovernmental aid organizations without delay. <Amended by Presidential Decree No. 20871, Jun. 25, 2008; Presidential Decree No. 22075, Mar. 15, 2010>
