Article 83-5(Scope of Workers) #
"Person ... who engages in a type of work prescribed by Presidential Decree" in subparagraph 1, with the exception of the items, of Article 91-15 of the Act means the following persons: <Amended on Dec. 31, 2024; Oct. 1, 2025>
1. An insurance solicitor falling under any of the following:
a. An insurance solicitor under Article 83(1)1 of the Insurance Business Act;
b. A person who engages in soliciting mutual aid under the Community Credit Cooperatives Act and the Credit Unions Act, on a full-time basis;
c. A person who engages in soliciting postal insurance policies under the Postal Savings and Insurance Act, on a full-time basis;
2. An operator of construction machinery registered under Article 3(1) of the Construction Machinery Management Act;
3. A person who, according to the sub-grouping in the Korean Standard Classification of Occupations publicly notified by the Minister of Data and Statistics under Article 22 of the Statistics Act (hereinafter referred to as the "Korean Standard Classification of Occupations"), directly visits the homes or other places of members to teach children or students, such as a visiting instructor for learning materials or teaching aids;
4. A golf course caddy who assists with golf games at a golf course, installed as a workplace sports facilities pursuant to Article 7 of the Installation and Utilization of Sports Facilities Act, or registered as a sports facility business pursuant to Article 19 of the same Act;
5. A person who is a courier under the sub-grouping in the Korean Standard Classification of Occupations or any other delivery person under the sub-sub grouping therein, who falls under any of the following subparagraphs;
a. A package delivery service provider under subparagraph 6a of Article 2 of the Last-Mile Logistics Industry Development Act, who engages in collection or delivery (including delivery accompanying installation);
b. A person who performs collection or delivery services in package delivery business (referring to the business of delivering parcels after collecting and transporting them), other than those referred to in item a;
6. A quick service courier under the sub-grouping in the Korean Standard Classification of Occupations who performs delivery services upon receiving a request from a quick service business owner; provided, persons falling under subparagraph 5 or 14 shall be excluded;
7. A loan solicitor under the proviso of Article 3(1) of the Act on Registration of Credit Business and Protection of Finance Users;
8. A solicitor of credit card holders provided in Article 14-2(1)2 of the Specialized Credit Finance Business Act;
9. A person who drives a motor vehicle upon receipt of a request from any of the following business entities:
a. A replacement driver service provider (referring to an owner of a business of delivering motor vehicle users to their desired destinations at their request);
b. A consignment service provider (referring to an owner of a business of driving motor vehicles to the destination without accompanying motor vehicle users at their request);
c. A valet parking business entity (referring to an owner of a business of parking motor vehicles on behalf of the users at their request);
10. A door-to-door salesperson under subparagraph 2 of Article 2 of the Act on Door-to-Door Sales or a door-to-door salesperson under sponsorship under subparagraph 8 of that Article who conducts door-to-door sales business; provided, any of the following cases shall be excluded herefrom:
a. Where he or she fails to conduct sales and only engages in self-consumption;
b. In cases falling under subparagraph 3 or 11;
11. A rental equipment inspector who conducts door-to-door visits, under the sub-grouping in the Korean Standard Classification of Occupations;
12. A person who installs and repairs home appliances as specified in the sub-grouping of the Korean Standard Classification of Occupations, who mainly performs delivery services for the sale of home appliances and verifies the working conditions through the installation, trial operation, etc. thereof;
13. A person who drives motor vehicles prescribed by Ministerial Decree of the Employment and Labor among trucks defined in subparagraph 1 of Article 2 of the Trucking Transport Business Act;
14. A person who, as a truck owner-operator defined in Article 2 subparagraph 11 of the Trucking Transport Business Act, drives any of the following vehicles; and any other person who drives any of the following vehicles for the purpose of transporting cargo; provided, persons falling under subparagraphs 5, 12, or 13 shall be excluded:
a. Trucks under Article 3(1)3 of the Motor Vehicle Management Act;
b. Among special motor vehicles under Article 3(1)4 of the Motor Vehicle Management Act, towing vehicles or ladder trucks for special work (referring to motor vehicles for raising objects necessary for tall buildings for moving, etc.);
15. A software engineer defined in subparagraph 10 of Article 2 of the Software Promotion Act who provides labor services for software projects defined in subparagraph 3 of the same Article;
16. Any of the following instructors:
a. An instructor in charge of after-school classes operated by a school under Article 2 of the Elementary and Secondary Education Act;
b. An instructor in charge of after-school programs defined in subparagraph 6 of Article 2 of the Early Childhood Education Act, which is operated by a kindergarten defined in subparagraph 2 of Article 2 of that Act;
c. An instructor in charge of extracurricular activity programs under Article 29(4) of the Child Care Act, which is operated by a child care center defined in subparagraph 3 of Article 2 of that Act;
17. A person who has qualifications for interpretation and guide of tourists under the proviso of Article 38(1) of the Tourism Promotion Act and engages in guiding foreign tourists;
18. A person who drives a school bus for children defined in subparagraph 23 of Article 2 of the Road Traffic Act.
