CHAPTER I GENERAL PROVISIONS
Article 1(Purpose) #
The purpose of this Decree is to prescribe matters delegated by the Act on the Collection and Compilation of Historical Materials and Dissemination of Korean History and matters necessary for the enforcement thereof.
CHAPTER Ⅱ NATIONAL INSTITUTE OF KOREAN HISTORY
Article 2(Commissioning of members) #
(1) Members of the National Institute Korean History (hereinafter referred to as the "Institute") established under Article 4 of the Act on the Collection and Compilation of Historical Materials and Dissemination of Korean History (hereinafter referred to as the "Act") shall be commissioned from among persons with abundant research experience and knowledge in history and high moral reputation.
(2) The term of office of a member filling a vacancy shall be the remainder of his or her predecessor's term of office.
Article 2-2(Dismissal of members) #
Where a member of the Institute under Article 2 (1) falls under any of the following subparagraphs, the Minister of Education may dismiss the relevant member:
1. If the member is unable to perform his or her duties due to a mental or physical disorder;
2. Where the person is found to have committed misconduct related to his or her duties;
3. If the member is found incompetent for the office due to dereliction of duty, indecent conduct, or any other ground;
4. If the member voluntarily manifests that he or she has difficulty in performing his or her duties.

Article 3(Meetings of National Institute of Korean History) #
(1) Meetings of the Committee shall hold regular meetings every half year and may hold extraordinary meetings, if deemed necessary by the President of the Institute.
(2) Other matters necessary for the operation of the Institute shall be determined by the President of the Institute following a resolution by the Institute.
Article 4(Commissioning of historical material research members) #
(1) Research members of historical materials under Article 10 (2) of the Act shall be commissioned by the President of the Institute from among the following persons (hereinafter referred to as "research member of historical materials"):
1. A person who has majored in the field of Korean history at a school falling under any subparagraph of Article 2 of the Higher Education Act and has at least ten years of research experience in the relevant field or has a doctorate degree in the relevant field;
2. A person who has at least 5 years of research experience in the relevant field, who is capable of deciphering an advisory document and organizing it into historical materials;
3. A person who has at least 5 years of research experience in the relevant field, who is capable of deciphering historical materials in a foreign language and organizing them into historical materials;
4. A person who is capable of conducting the informatization of historical materials and has at least 5 years' work experience in research and practice in the relevant field.
(2) The commissioning period of a research member of historical materials shall be 1 year, and they may be reappointed.
Article 5(Commissioning of research members of historical materials) #
(1) The research member of historical materials under Article 10 (3) of the Act (hereinafter referred to as "research member of historical materials") shall be commissioned by the President of the Institute according to the following classifications:
1. A research member of historical materials at home:
(a) A research member of regional historical materials: Persons who reside in the Gu of the relevant Special Metropolitan City or Metropolitan City or Si/Gun of the relevant Do or Special Self-Governing Province where the research of historical materials is conducted and who have extensive knowledge of Korean history and experience in the research of historical materials;
(b) A research member of historical materials of agencies: Employees of State agencies, corporations, or organizations who have abundant knowledge about Korean history and experience in the research of historical materials;
2. A research member of overseas historical materials: Persons residing overseas (including foreigners) who have extensive knowledge of Korean history and experience in the research of historical materials.
(2) Expenses and allowances incurred in investigating and collecting historical materials may be paid to research members of historical materials within budgetary limits.
CHAPTER III SURVEY, COLLECTION, AND PRESERVATION OF HISTORIC
Article 6(Research of historical materials) #
(1) The Institution may hold an advisory meeting in which experts in the field of history attend to investigate domestic and overseas historical materials.
(2) The Institution may organize a research committee for the basic investigation of historical materials at home and abroad.
(3) Experts who attend an advisory meeting under paragraph (1) and members of a research group under paragraph (2) may be paid expenses and allowances incurred in attending meetings or investigating historical materials within budgetary limits.
Article 7(Collection of historical materials) #
(1) The Institution shall collect historical materials by means of reproduction, purchase, rental, donation, entrustment, etc. <Amended on Sep. 14, 2021>
(2) The Institution may collect historical materials through oral records that record oral interviews or testimonies on an individual's life-sustaining history, events, and cases or testimonies using handwritten, typewritten, recorded, or taped methods.
(3) Where a provider of historical materials requests non-disclosure or partial disclosure of historical materials, the Institution shall comply with such request.
Article 8(Consignment of historical materials) #
(1) A person who intends to request the entrustment of feed pursuant to Article 14 (1) of the Act shall submit an application determined by the President of the Institution.
(2) The Institution shall determine whether to accept the entrustment after examining the value, preservation status, and conditions of entrustment of historical materials for which an application for entrustment is filed.
(3) The Institution shall receive and examine the feed for which the entrustment has become final and conclusive, and issue a certificate of entrustment specifying the terms and conditions of entrustment after verifying the details thereof.
(4) The President of the Institution may separately determine the standards and procedures for installing entrusted historical materials in a documentary storage.
Article 9(Management of historical materials) #
(1) The Institution shall prepare business procedures and systems for the arrangement of historical materials it possesses, and prepare guidelines for the management of historical materials.
(2) Where the head of a local government requests the Institution to take measures necessary for the evaluation, arrangement, preservation, and utilization of historical materials possessed by the relevant local government, the Institution shall comply with such request, except in extenuating circumstances.
(3) The Institution shall actively disclose the historical materials it holds to the public so that the historical materials can be widely utilized.

CHAPTER IV RESEARCH, COMPREHENSIVE, COLLECTION, TRAINING, AN
Article 12(Research on Korean history) #
Where the Institution formulates a plan for the research of Korean history, it shall include the following matters in the plan:
1. Research of historical materials related to Korean history;
2. Research in fields in which research is insufficient or the arrangement of related historical materials is not performed;
3. Investigation and research of Korean history related to formulation and implementation of national policies;
4. Research of trends and contents of textbooks of Korean history;
5. Support for basic investigation and research of Korean history;
6. Holding scientific conferences on Korean history.
Article 13(Compilation of Korean history) #
Where the Institution formulates a plan for the compilation of Korean history, it shall include the following matters in the plan: <Amended on Jul. 2, 2019>
1. Collection of basic historical sources of Korean history and compilation of traditional history;
2. Collection of historical sources of Korean history by period and compilation of collection of historical sources;
3. Collection of historical sources of Korean history by subject and compilation of Korean history;
4. Collection of historical materials of the Republic of Korea and compilation of history of the Republic of Korea;
5. Collection of oral historical sources and compilation of oral history according to oral records under article 7 (2);
6. Collection of historical materials related to North Korea and compilation of North Korean history;
7. Collection of historical materials related to overseas Koreans and compilation of overseas Koreans;
8. Compilation of reference materials, such as terminology dictionary for Korean history, history guide, and annexes.
Article 14(Education and training of Korean history) #
(1) Where the Institution formulates a plan for the training of Korean history and the fostering of human resources specialized in the management of historical materials, it shall include the following matters in the plan:
1. Plans for education on Korean history for public officials;
2. Training plans for elementary and secondary school teachers majoring in history;
3. Plans for exchange lectures on Korean history with universities, etc.
(2) The training courses shall be divided into domestic and foreign historical material courses, and each course shall be subdivided and implemented for each specialized field.
(3) In principle, the training period for each course shall be 1 year, and shall not exceed 2 years.
(4) Other matters necessary for the operation of training courses shall be determined by the President.
Article 15(Dissemination of Korean history) #
Where the Institution formulates a plan for the dissemination of Korean history, it shall include the following matters in the plan:
1. The plan for institution of Korean history teaching materials in Korean language or foreign language;
2. The action plan for disseminating Korean history through mass media;
3. Measures for education, such as operation of cultural liberal courses to improve Korean history of Korean people's knowledge;
4. Plans for holding and operating various events to raise people's awareness of history.
Article 15-2(Verification of competence in Korean history) #
(1) The Institution shall conduct examinations of competence in Korean history under Article 18 (1) of the Act (hereinafter referred to as "Korean history examination") at least four times at home and abroad for Korean nationals, overseas Koreans, and foreigners at least 4 times a year.
(2) The Institution shall publicly announce an annual implementation plan for the Korean history examination by the end of December of the previous year.
(3) The Institution may postpone or cancel the Korean history examination where it is deemed impracticable to conduct the Korean history examination due to a natural disaster or an epidemic of an infectious disease.
(4) Any person who intends to apply for the Korean history examination shall pay an examination fee determined by the President of the Institution.
(5) In any of the following cases, the Institution shall fully or partially refund the examination fees paid, as prescribed in the following subparagraphs:
1. Where an application is withdrawn within the period for receiving applications: The whole amount;
2. Where an application is canceled within the designated cancellation period after the period for receiving applications: Part of the amount;
3. Where an applicant fails to take an examination due to reasons attributable to the Institution: The whole amount;
4. Where an application fee is overpaid or erroneously paid: The amount overpaid or erroneously paid;
5. Where the President of the Institution deems it impossible to take the Korean history examination due to other unavoidable reasons: The whole or part of the amount.
(6) After administering the Korean history examination, the Institution shall notify applicants of the results thereof.
(7) The Institution may request the heads of central administrative agencies, local governments, and the heads of relevant agencies, etc. to provide cooperation necessary for the questioning, grading, and management of examinations.
(8) Except as otherwise expressly provided for in paragraphs (1) through (7), matters necessary for administering the Korean history examination shall be determined by the President of the Institution, subject to resolution by the Institution.

Article 15-3(Commissioning members of preparing and grading korean history examinations) #
(1) The Institution may commission or designate members of the Institution who prepare and grade Korean history examinations from among experts in the field of Korean history; and members of the Institution who prepare and grade Korean history examinations from among employees of the Institution, educational administrative agencies, and educational research institutes, respectively.
(2) Allowances may be paid within budgetary limits to the members who prepare, grade, and manage the Korean history examination referred to in paragraph (1).

Article 15-4(Measures against cheaters) #
(1) The Institution shall suspend or nullify the examination of a person who has performed any of the following acts in the Korean history examination, and shall suspend his or her eligibility to take three consecutive Korean history examinations after the relevant examination:
1. Showing another examinee's answer sheet or showing his or her answer sheet;
2. Taking a proxy examination or having another person take such examination;
3. Taking an application by forging or falsifying an identification card;
4. Exchanging signals with other examinees with mutual signals by making movements, sounds, etc.;
5. Act of viewing unlawful carry-ons, such as message notes;
6. Fabricating or using telecommunications devices, electronic computers, etc.;
7. Other acts similar to those prescribed in subparagraphs 1 through 6, which are determined and publicly announced by the President of the Institution as those affecting the results of an examination of the principal or other persons by improper means.
(2) The Institution shall suspend or nullify a person who engages in any of the following acts in the Korean history examination from participating in the Korean history examination:
1. Perusing examination questions before commencing examination;
2. Continuously writing an answer sheet after the completion of the examination;
3. Taking out an answer sheet;
4. Taking an examination on a seat which is not a designated seat;
5. Producing electronic notification sound or vibration of telecommunications devices or electronic calculators, etc.;
6. Other acts determined and publicly announced by the President of the Institution as those similar to those prescribed in subparagraphs 1 through 5, which affect the fair administration of examinations.

Article 17(Informatization of Korean history) #
The Institution shall formulate and implement a plan including the following matters for the informatization of Korean history:
1. Plans to establish and manage database of historical materials;
2. Plans for development and operation of contents related to Korean history;
3. Measures to develop and operate history education contents;
4. Plans to develop and operate an information system that provides history information according to the age and educational background of citizens.
Article 18(Operation of comprehensive history information center) #
(1) The head of the comprehensive information center in the area of history under Article 19 (2) of the Act (hereinafter referred to as the " history information center") shall be appointed by the President of the Institution from among standing members of the Institution.
(2) The history information center shall promote the following matters to promote the informatization of Korean history:
1. Development of policies and strategies for management of knowledge and information resources in the historical fields;
2. Sharing knowledge and information resources in the historical field and management of distribution services;
3. Management of list and database of knowledge and information resources in the historical field;
4. Standardization and dissemination of database in the history field;
5. Operation of information system for knowledge and information in the history field;
6. Interconnection between information systems of institutions related to Korean history;
7. Consultation and coordination among institutions related to history informatization.
Article 19(Management of personally identifiable information) #
The Institution may manage data containing resident registration numbers or alien registration numbers under subparagraph 1 or 4 of Article 19 of the Enforcement Decree of the Personal Information Protection Act, if it is inevitable to perform the following affairs:
1. Administrative affairs concerning the administration of Korean history examinations under Article 15-2;
2. Affairs concerning the commission and designation of members of the Korean history examination Institution under Article 15-3 (1) and the questioning and grading of Korean history examinations;
3. Affairs concerning the payment of allowances under Article 15-3 (2);
4. Affairs concerning measures against persons who have committed cheating under Article 15-4;
