Article 1(Purpose) #
The purpose of this Decree is to prescribe matters concerning the organization and operation of the Armed Forces Nursing Academy pursuant to the Act on the Establishment of the Armed Forces Nursing Academy.

Article 2(Location) #
The location of the Korea Armed Forces Nursing Academy (hereinafter referred to as the "Academy") shall be Yuseong-gu, Daejeon Metropolitan City.

Article 3(Cadets) #
(1) Persons who study at the Academy shall be called "cadets."
(2) The treatment of cadets shall be equivalent to that of warrant officers; provided, remuneration shall be governed by the Military Personnel Remuneration Act.

Article 4(Superintendent) #
(1) The school shall have one vice superintendent in addition to the superintendent, and the vice superintendent shall be appointed from among field-grade officers of the nursing department.
(2) The superintendent shall supervise the overall academic affairs of the Academy and direct and supervise its staff.
(3) The vice superintendent shall assist the superintendent, and if the superintendent is unable to perform his or her duties due to unavoidable reasons, the vice superintendent shall act on behalf of the superintendent.

Article 5(Establishment of departments) #
(1) The Academy shall have a Faculty Department, a Cadet Corps, and an Administrative Department, and may also have other necessary departments.
(2) Each department shall have a head. The heads of the Faculty Department, the Cadet Corps, and the Administrative Department shall be appointed from among field grade officers, and the heads of other departments shall be appointed from among either field grade or company grade officers.
(3) The Faculty Department shall be responsible for matters concerning military and general curricula; the Cadet Corps shall be responsible for training and other education matters not under the jurisdiction of the Faculty Department; and the Administrative Department shall be responsible for personnel administration, supply, and other matters not under the jurisdiction of other departments.
(4) Matters concerning the establishment of other necessary departments referred to in paragraph (1) and the allocation of duties shall be determined by the Minister of National Defense.

Article 6(Instructors) #
The Academy shall have instructors in charge of military curricula, and professors, associate professors, and assistant professors (hereinafter referred to as "general faculty members") in charge of general curricula, as well as part-time lecturers and assistants. <Amended on Feb. 29, 2012>

Article 6-2(Appointment of professors and associate professors) #
(1) Pursuant to Article 7 (3) of the Act on Establishment of the Korea Armed Forces Nursing Academy (hereinafter referred to as the "Act"), the superintendent shall delegate to the Minister of National Defense the authority to appoint professors and associate professors in charge of general curricula. <Amended on Oct. 14, 2021>
(2) The Minister of National Defense, who is delegated with the authority to appoint under paragraph (1), shall appoint professors and associate professors in charge of general curricula from among those recommended by the President with the consent of the Education Operation Committee under Article 20 (1). <Amended on Mar. 18, 2013>

Article 7(Quota) #
The Academy shall have military personnel and civilian military employees, and the quota thereof shall be determined by the Minister of National Defense. In such cases, the quota of general faculty members, part-time lecturers, and assistants who are military personnel or civilian military employees shall be determined in accordance with the standards for faculty assignment prescribed for universities under subparagraph 1 of Article 2 of the Higher Education Act.

Article 8(Admission) #
(1) Admission, expulsion, and leave of absence of cadets shall be approved by the superintendent, except as otherwise specially prescribed.
(2) Cadets shall be selected from among applicants for admission through an entrance examination conducted in accordance with the standards prescribed by the Minister of National Defense.
(3) The time of admission of cadets shall be within 30 days from the beginning of the academic year.

Article 8-2(Extension of age limit for admission) #
Pursuant to the proviso of subparagraph 1 Article 3 of the Act, the maximum age for admission of discharged soldiers under Article 16 (1) and (2) of the Support for Veterans Act (hereinafter referred to as “veterans”) shall be extended as follows:
1. Veterans who have completed at least 2 years of service: 3 years;
2. Veterans who have completed at least 1 year but less than 2 years of service: 2 years;
3. Veterans who have completed less than 1 year of service: 1 year.

Article 10(Provisional admission) #
(1) If deemed necessary for preliminary education, the superintendent may provisionally admit prospective students before the date of admission.
(2) The period of provisional admission under paragraph (1) shall not exceed 50 days, and meals and clothing shall be provided to those provisionally admitted.

Article 11(Curricula) #
The curricula of the Academy shall be prescribed by the school regulations, and general curricula shall be determined in accordance with those of universities.

Article 12(Unit of completion of courses) #
The unit for completing the Academy’s courses shall be an academic year, and the division of semesters shall be in accordance with that of universities.

Article 13(Class days) #
The number of class days at the Academy shall be prescribed by the school regulations, and the number of class days for general curricula shall be determined in accordance with those of universities.

Article 14(Beginning and end of class) #
The beginning and end times of classes shall be determined by the superintendent.

Article 15(Holidays) #
(1) The Academy’s holidays shall be as follows:
1. Official holidays of government offices;
2. Summer and winter vacations and the foundation anniversary prescribed by the school regulations;
3. Military event days determined by the Minister of National Defense.
(2) In case of unavoidable circumstances such as emergency disasters or other urgent situations, the superintendent may declare temporary holidays. When temporary holidays are declared, the superintendent shall report promptly to the Minister of National Defense.

Article 16(Transfer admission) #
Transfer and admission by transfer of cadets shall not be permitted.

Article 17(Completion of school year courses) #
To recognize completion of an academic year and graduation of cadets, their academic performance for the year shall be evaluated.

Article 18(Grounds for expulsion) #
(1) The superintendent may expel a cadet who falls under any of the following:
1. A cadet with extremely poor conduct;
2. A cadet who disrupts military discipline or fails to comply with regulations;
3. A cadet who is unlikely to graduate due to poor academic performance;
4. A cadet who is unable to complete the prescribed courses due to illness or other physical or mental disabilities.
(2) A cadet expelled under paragraph (1) shall be removed from the military register on the date of expulsion.

Article 19(School regulations) #
(1) The superintendent shall establish the school regulations with the approval of the Minister of National Defense.
(2) When approving the school regulations under paragraph (1), the Minister of National Defense shall consult with the Minister of Education, and the same shall apply when amending them. <Amended on Mar. 23, 2013>
(3) The school regulations shall provide for the following matters:
1. Matters concerning academic years, semesters, and holidays;
2. Matters concerning class organization and the quota of cadets;
3. Matters concerning curricula and class days;
4. Matters concerning evaluation and recognition of completion of academic years;
5. Matters concerning admission, expulsion, leave of absence, graduation, and rewards and punishments;
6. Matters concerning qualifications for graduation;
7. Matters concerning the operation of the Education Operation Committee under Article 20;
8. Other matters concerning the operation of the Academy.

Article 20(Education Operation Committee) #
(1) The Academy shall establish an Education Operation Committee (hereinafter referred to as the “Committee”) to advise the superintendent on important matters concerning the operation of education.
(2) The Committee shall be composed of the vice superintendent, the heads of the Faculty Department, the Cadet Corps, and the Administrative Department, and not less than 5 nor more than 15 instructors designated by the superintendent.
(3) The vice superintendent shall be the chairperson of the Committee; provided, if the vice superintendent is unable to perform his or her duties due to unavoidable reasons, the senior member among the Committee members shall act as the chairperson.
(4) The chairperson shall supervise the meetings of the Committee, convene the meetings, and preside over them.
(5) Matters necessary for the operation of the Committee shall be prescribed by the school regulations.

Article 21(Recruitment of male cadets) #
The recruitment of male cadets of the Armed Forces Nursing Academy under subparagraph 1 of Article 3 of the Act and paragraph (2) of the Addenda to the amended Act on the Establishment of the Armed Forces Nursing Academy (Act No. 7084) shall begin in 2012. <Amended on Oct. 14, 2021>

Article 22(Management of personally identifiable information) #
The superintendent may handle data containing personally identifiable information referred to in subparagraph 1 of Article 19 of the Enforcement Decree of the Personal Information Protection Act where it is inevitable for conducting of the following affairs:
1. Affairs concerning verification of admission qualifications under Article 3 of the Act;
2. Affairs concerning conferment of degrees under Article 9 of the Act.
