Article 1(Purpose) #
The purpose of this Decree is to prescribe matters necessary for the publication and operation of the Official Gazette, such as the compilation, production, dissemination, etc. of the Official Gazette under Article 11 of the Act on the Promulgation of Statutes and Regulations.
Article 2(Supervising agency) #
Matters regarding the publication and operation of the Official Gazette shall be supervised by the Minister of the Interior and Safety.
Article 3(Matters to be published) #
(1) The following matters shall be published in the Official Gazette:
1. Matters prescribed by statutes or regulations to be published in the Official Gazette;
2. Matters that the Minister of the Interior and Safety particularly deems it necessary to be published in the Official Gazette.
(2) If the head of an agency proposing a Government Bill under Article 5 (2) of the Regulations on the Management of Legislative Affairs intends to stipulate matters regarding the publication in the Official Gazette in the statutes or regulations under his or her jurisdiction, he or she shall have a prior consultation with the Minister of the Interior and Safety.
Article 4(Request for publication) #
(1) The Minister of Government Legislation shall request the Minister of the Interior and Safety to publish the promulgation of the Constitution, statutes, and Presidential Decrees in the Official Gazette, and the head of the competent agency or organization shall do so for other matters. In such cases, when requesting publication in the Official Gazette to promulgate Ordinances of the Prime Minister or Ministerial Ordinances or to issue Presidential Directives or Prime Ministerial Directives, a certificate of examination issued by the Minister of Government Legislation shall be attached.
(2) The head of an agency or organization that requests publication in the Official Gazette pursuant to paragraph (1) shall comply with the principles of personal information protection under Article 3 of the Personal Information Protection Act and shall ensure that the matters requested to be published do not include any matter infringing on the privacy of an individual. <Amended on Nov. 15, 2022>
(3) The Minister of the Interior and Safety may use personal information inspection software to determine whether the matters requested to be published in the Official Gazette contain any matter that is likely to infringe on a person's privacy, and may request the head of an agency or organization that has requested the publication of such matters in the Official Gazette to make a correction, such as deletion of the relevant matter, if such matters contain any matter likely to infringe on a person's privacy. <Amended on Nov. 15, 2022>
Article 5(Correction of Official Gazette) #
(1) In any of the following cases, the Minister of the Interior and Safety may correct the Official Gazette:
1. Where any misrepresentation or error exists in the matters published in the Official Gazette;
2. Where any infringement of privacy of an individual is likely to occur due to matters published in the Official Gazette.
(2) A correction of an Official Gazette shall be made by publishing the details of correction in the newly published Official Gazette, and in cases of a correction under paragraph (1) 2, it shall be made by taking necessary protective measures for the relevant Official Gazette.
(3) Except as provided in paragraphs (1) and (2), matters regarding the procedures, methods, etc. for correction of the Official Gazette shall be prescribed by Ordinance of the Ministry of the Interior and Safety.

Article 7(Classification and order of compilation of Official Gazette) #
(1) The classification and order of compilation of the Official Gazette shall be as follows:
1. The Constitution section;
2. The statute section;
3. The treaty section;
4. The Presidential Decree section;
5. The Ordinance of Prime Minister section;
6. The Ordinance of the Ministry section;
7. The directive section;
8. The public notice section;
9. The public announcement section;
10. The National Assembly section;
11. The court section;
12. The constitutional court section;
13. The Election Commission section;
14. The Board of Audit and Inspection section;
15. The National Human Rights Commission section;
16. The local government section;
17. The personnel affairs section;
18. The awards and decorations section;
19. Others.
(2) Notwithstanding paragraph (1), the Minister of the Interior and Safety may, if deemed necessary, create a separate section or adjust the order of compilation.
(3) Details regarding the classification and publication of the Official Gazette under paragraph (1) shall be prescribed by Ordinance of the Ministry of the Interior and Safety.
Article 8(Publication of Official Gazette) #
(1) The Minister of the Interior and Safety shall publish printed Official Gazettes and online Official Gazettes under Article 11 (3) of the Act on the Promulgation of Statutes and Regulations.
(2) The Minister of the Interior and Safety shall establish a system to provide online Official Gazettes pursuant to Article 11 (3) of the Act on the Promulgation of Statutes and Regulations (hereinafter referred to as "Online Official Gazette System") and manage and operate such system.
(3) The Minister of the Interior and Safety shall disseminate printed Official Gazettes to agencies prescribed by Ordinance of the Ministry of the Interior and Safety for the perusal, preservation, etc. of the printed Official Gazettes.
(4) Except as provided in paragraphs (1) through (3), details regarding the publication and dissemination of the printed Official Gazettes and the management and operation of the Online Official Gazette System shall be prescribed by Ordinance of the Ministry of the Interior and Safety.
Article 9(Entrustment of dissemination of Official Gazettes) #
(1) The Minister of the Interior and Safety may entrust a person who meets the requirements prescribed by Ordinance of the Ministry of the Interior and Safety with the management of the Online Official Gazette System under Article 8 (2), such as maintenance and repair of the Online Official Gazette system, to facilitate the provision of online Official Gazettes.
(2) The Minister of the Interior and Safety may entrust a person who meets the requirements prescribed by Ordinance of the Ministry of the Interior and Safety with the duties of reproducing and disseminating printed Official Gazettes under Article 8 (3) for the smooth dissemination of printed Official Gazettes.
Article 10(Substitution of official letters with Official Gazettes) #
Matters prescribed by Ordinance of the Ministry of the Interior and Safety, out of matters published in the Official Gazette, shall be deemed to have been implemented by means of official letters.
