Article 1(Purpose) #
The purpose of this Act is to provide for such necessary matters as the standards of granting for transferring part of national taxes to local governments pursuant to the provisions of Article 5 (2) of the Act on the Adjustment, etc. of National and Local Taxes.
Article 2(Definition) #
The term “local education grant” used in this Act means the amount of money granted to educational administrative agencies of the Seoul Special Metropolitan City, Metropolitan Cities, and Dos (hereinafter referred to as the “Cities/Dos”) by the state pursuant to the provisions of Article 4. <Amended by Act No. 5454, Dec. 13, 1997>
Article 3(Financial Resources of Local Educational Grant) #
Financial resources of local education grant (hereinafter referred to as the “grant”) shall be the amount of money granted pursuant to the provisions of Article 5 (2) of the Act on Adjustment, etc. of National and Local Taxes.
Article 4(Standards for Granting of Grant) #
The grant shall be transferred in accordance with the population percentage of the Cities/Dos as of November 1 of the year before last of the relevant year.
Article 5(Uses and Purposes of Grant) #
The grant shall be used for the purpose of granting under Article 5 (2) of the Act on the Adjustment, etc. of National and Local Taxes.
Article 6(Correction Measure with respect to Grant Due to Mistakes, etc.) #
If the Minister of Education and Human Resources Development transfers the grant by mistakes, etc., he shall add or subtract the amount transferred wrongly due to the mistakes, etc. at the time of transferring the grant of the following year. <Amended by Act No. 6400, Jan. 29, 2001>
Article 7(Measures Required by Modification of Administrative Districts) #
If the Cities/Dos are abolished or established, or separated or merged or their jurisdictional areas are altered, the Minister of Education and Human Resources Development shall, after adjusting the grants transferred to the relevant Cities/Dos, transfer them. <Amended by Act No. 6400, Jan. 29, 2001>
