ACT ON THE PROMOTION OF EDUCATION FOR THE HANDICAPPED

Article 1(Purpose) #

The purpose of this Act is to provide those who need education for the handicapped with an opportunity to receive the education properly selected by the State or local governments and to develop their ability for independent living, by improving educational methods and conditions, so that the education may contribute to their stabilization of livelihood and participation in the society.

Article 2(Definitions) #

The terms used in this Act shall be defined as follows: <Amended by Act No. 5069, Dec. 29, 1995; Act No. 5440, Dec. 13, 1997>

1. The term "education for the handicapped" means to give the handicapped the education by the curriculum, the curative education, and the vocational education, through a curriculum, an educational method, or educational media, etc. suitable for the characteristics of each educational object;

2. The term "object of education for the handicapped" means a person who is considered to need education for the handicapped under the provisions of Article 10;

3. The term "educational institution for the handicapped" means a special school or class for the handicapped which provides the curricula of a kindergarten, an elementary school, a junior high school, or a senior high school (including departments of majors; hereinafter the same shall apply) for the object of education for the handicapped;

4. The term "special class for the handicapped" means a class which is established to give an integrated education to the object of education for the handicapped in every school less advanced than a high school, and which consists of full-time classes, part-time classes, special classes, and a circuit education according to their abilities;

5. The term "circuit education" means the education for the handicapped given to the object of education for the handicapped at home, in a medical institution, a school, or other facilities where teachers who take charge of the education (hereinafter referred to as the "teaching staff for the handicapped") visit him to educate him;

6. The term "integrated education" means the education given to the object of education for the handicapped in a regular school (which is not a special school for the handicapped; hereinafter the same shall apply) or the education temporarily given to the student enrolled in the educational institution for the handicapped who participates in the curricula of the regular school, to develop his normal abilities to adjust himself to society; and
