Article 1(Purpose) #
The purpose of this Act is to protect publishing and printing businesses in order to promote and develop publication culture.
Article 2(Definition of Terms) #
(1) For the purpose of this Act, publishing company means those who conduct a commercial business in all kinds of publications (hereinafter referred to as “publication”), except periodicals as referred to in Article 2 of the Registration, etc. of Periodicals Act. <Amended by Act No. 1642, Jun. 10, 1964; Act No. 5454, Dec. 13, 1997>
(2) In this Act, a printing office means the office which is equipped with printing facilities and conducts a commercial business in printing all kinds of publications.
Article 3(Registration) #
(1) A person who operates a publishing company or printing office shall register the following matters with the head of Si/Gun/Gu (referring to a head of autonomous Gu; hereinafter referred to as the “registration authority”) having jurisdiction over its location, as prescribed by the Presidential Decree. The same shall also apply where there are changes in registered matters: <Amended by Act No. 2393, Dec. 26, 1972; Act No. 5454, Dec. 13, 1997; Act No. 5659, Jan. 21, 1999>
1. Name and location of a publishing company or printing office;
2. Name and address of officers (the representative in case of a juristic person or association); and

(2) The registration authority shall issue a registration certificate to a person who has made a registration under the provisions of paragraph (1).

Article 4(Presentation of Publications) #
(1) When a publishing company registered under Article 3 publishes comics, photo albums, pictorial magazines, or novels, it shall submit two copies of every printed publication to the Minister of Culture and Tourism via the registration authority as prescribed by the Presidential Decree. <Amended by Act No. 5659, Jan. 21, 1999>
(2) The Minister of Culture and Tourism shall issue a presentation certificate to a person who has submitted publications under the provisions of paragraph (1). <Amended by Act No. 2393, Dec. 26, 1972; Act No. 4183, Dec. 30, 1989; Act No. 4541, Mar. 6, 1993; Act No. 5659, Jan. 21, 1999>
(3) In the case as referred to in paragraph (1), the person who has presented copies requests compensation, the State shall, if deemed so requested, make reasonable compensation. <Newly Inserted by Act No. 1642, Jun. 10, 1964>
Article 5(Return of Registration Certificate) #
(1) When those who have made registration under the provisions of Article 3 intends to close the business, they shall return a registration certificate to the registration authority, as prescribed by the Presidential Decree.
(2) When the registration authority is returned a registration certificate, it shall report to the Minister of Culture and Tourism as prescribed by the Presidential Decree.

Article 5-2(Revocation of Registration) #
The registration authority may revoke the registration in case where a publishing company or printing office registered under Article 3 (1) falls under any of the following subparagraphs: <Amended by Act No. 5454, Dec. 13, 1997; Act No. 5659, Jan. 21, 1999>
1. When registration is made by a false or other illegal way;
2. When it has not reported changes in the registered matters in violation of the latter part of Article 3 (1);
3. Where the publishing company or printing office is not found at the reported location or the location of the business is not identified;
4. Where it has published periodicals without having a registration certificate set forth in Article 7 (1) of the Registration, etc. of Periodicals Act; and
5. Where it is proved that they have published pornographic materials or comics harmful to children and have impaired public customs or social ethics.

Article 5-3(Hearing) #
Where the registration authority desires to revoke the registration of a publishing company or a printing office under Article 5-2, it shall hold a hearing.

Article 6(Penal Provisions) #
All those who have run a publishing company or printing office in violation of Article 3 (1) and falsely entered registered matters shall be liable to a fine not exceeding 5 million won. <Amended by Act No. 2393, Dec. 26, 1972; Act No. 5659, Jan. 21, 1999>
Article 7(Fine for Negligence) #
All those who have violated Article 4 (1) or 5 (1) shall be liable to a fine for negligence not exceeding two hundred thousand won. <Amended by Act No. 2393, Dec. 26, 1972; Act No. 5659, Jan. 21, 1999>
Article 8(Joint Penal Provisions) #
When a representative of a juristic person, or an agent, servant, or other employee of an individual or juristic person violates Articles 6 and 7, the related juristic person or individual shall be liable to a fine or fine for negligence in addition to the offender.
