Article 1(Purpose) #
The purpose of this Act is to contribute to the social participation and welfare promotion of women by establishing the Korean Women’s Development Institute (hereinafter referred to as the “Development Institute”) to carry out efficiently services, such as research and study on problems pertaining to women, education and training for developing the ability of women, support of women’s activities, and the like.
Article 2(Juristic Person) #
The Development Institute shall be a juristic person.
Article 3(Registration of Establishment) #
(1) The Development Institute shall come into existence by making an establishment registration at the seat of its principal office.
(2) Matters necessary for the establishment registration as referred to in paragraph (1) and other registration shall be determined by the Presidential Decree.
Article 4(Articles of Association) #
(1) The articles of association of the Development Institute shall include the following matters:
1. Objective;
2. Title;
3. Seat of the office;

5. Matters concerning officers and staff;
6. Matters concerning the board of directors;
7. Matters concerning the internal organization;
8. Matters concerning the property and accounting;
9. Matters concerning the services and execution thereof;
10. Matters concerning the method of public notice;
11. Matters concerning the advisory committee; and
12. Matters concerning the alteration of the articles of association.
(2) If the Development Institute desires to alter the articles of association, it shall obtain the approval of the Minister of Health and Welfare.
Article 5(Officers) #
(1) The Development Institute shall have nine or less directors including a president and a vice-president and an auditor.
(2) Officers as referred to in paragraph (1) excluding the president and vice-president shall be non-permanent.
Article 6(Appointment of Officers) #
(1) The president shall be appointed by the president upon the proposition of the Minister of Health and Welfare, and the vice-president, by the Minister of Health and Welfare upon the proposition of the president.
(2) Matters concerning the election of directors excluding the president and vice-president shall be determined by the articles of association.
(3) The auditor shall be appointed by the Minister of Health and Welfare.
Article 7(Term of Officers) #
The term of the president, vice-president and directors shall be three years and that of the auditor, two years, but it is renewable respectively.
Article 8(Duties of President and Vice-President) #
(1) The president shall represent the Development Institute, exercise a general control over its affairs, and direct and control the staff under his jurisdiction.
(2) The vice-president shall assist the president, and if the president is unable to perform his duties by accident, the vice-president shall act for him.
Article 9(Appointment and Dismissal of Staff) #
The staff of the Development Institute shall be appointed and dismissed by the president under the conditions as prescribed by the articles of association.
Article 10(Board of Directors) #
(1) In order to decide important matters on affairs of the Development Institute, the board of directors composed of directors shall be organized in the Development Institute.
(2) One of directors shall be the chairman of the board of directors: Provided, That the directors who are the president and vice-president, shall not hold concurrently the position of the chairman.
(3) The chairman shall convoke and preside over the board of directors.
(4) The auditor may attend the board of directors and state his opinion.
(5) Matters necessary for the operation of the board of directors shall be determined by the articles of association.
Article 11(Advisory Committee) #
(1) In order to provide the president with advice about affairs of the Development Institute, the advisory committee composed of those of rich learning and experience on the women’s problems shall be established.
(2) Matters necessary for the composition and operation of the advisory committee shall be determined by the articles of association.
Article 12(Projects) #
In order to accomplish the purpose as prescribed in Article 1, the Development Institute shall carry out the following projects:
1. Research and study on problems related to women;
2. Education and training for those who are engaged in the service fields the object of which is members of women’s organizations and women;
3. Project to develop occupational categories suitable for women and any welfare demonstration project;
4. Assistance and support of women’s activities;
5. International cooperative projects pertaining to women’s fields;
6. Information exchange between, and joint research with, domestic and foreign institutes, and support thereof;
7. Publication and public announcement of the results of research;
8. Projects entrusted by the Minister of Health and Welfare or the head of other central administrative agency with respect to problems related to women; and
9. Other projects incidental to subparagraphs 1 through 8.
Article 13(Approval of Operational Plan, etc.) #
The yearly operational plan, budget and settlement of accounts of the Development Institute and other matters as prescribed by the Presidential Decree shall be approved by the Minister of Health and Welfare.
Article 14(Assistance, Coordination, etc.) #
The Minister of Health and Social shall assist and support the Development Institute, and coordinate and supervise its affairs.

Article 16(Contributions) #
(1) The Government may grant contributions necessary for applying to the expenses to be needed for the establishment and operation of the Development Institute to it within the limit of the budget. <Amended by Act No. 4980, Dec. 6, 1995>
(2) Matters necessary for the grant, etc. of contributions under paragraph (1) shall be determined by the Presidential Decree. <Amended by Act No. 4980, Dec. 6, 1995>
Article 17(Reduction, Exemption, etc. of Taxes) #
(1) The Government shall reduce and exempt taxes for the Development Institute under the conditions as prescribed by the Regulation of Tax Reduction and Exemption Act.
(2) With respect to any property contributed to the Development Institute by any person other than the Government under Article 15 (2), the exception to the calculation of income shall be applicable under the conditions as prescribed by the Regulation of Tax Reduction and Exemption Act.
Article 18(Gratuitous Concession, etc. of State Property) #
(1) If it is deemed necessary for the establishment and operation of the Development Institute, the Government may concede or lend gratuitously any state property to the Development Institute.
(2) Matters necessary for details, conditions and terms, and procedure of the concession and loan as referred to in paragraph (1) shall be determined by the Presidential Decree except for those as prescribed by the State Properties Act.
Article 19(Assistance) #
The Government may assist the whole or part of the expenses needed for projects of the Development Institute in the limit of the budget.
Article 20(Supply of Materials) #
The Development Institute may request the State, local governments, public organizations, government-invested institutions, research or educational institutions, etc. to furnish materials necessary for carrying out projects.
Article 21(Joint Research, etc. on Specific Subject) #
If it is deemed necessary for a joint research as prescribed in subparagraph 6 of Article 12 on a specific subject concerning problems related to women, the Minister of Health and Welfare may take any proper an necessary measure, or recommend the president to take any necessary measure.
Article 22(Prohibition of Use of Similar Title) #
No person other than the Development Institute as prescribed by this Act shall use the title of the Korean Women’s Development Institute or similar one.
Article 23(Mutatis Mutandis application of Civil Act) #
Except for those as prescribed by this Act, the provisions of the Civil Act concerning the incorporated foundation shall apply mutatis mutandis to the Development Institute.
Article 24(Fine for Negligence) #
Any person who violates the provisions of Article 22 shall be punished by a fine for negligence not exceeding fifty hundred thousand won.
Article 25(Enforcement Decree) #
Matters necessary for the enforcement of this Act shall be determined by the Presidential Decree.
