Article 1(Purpose) #
The purpose of this Act is to achieve smoothness in the public transportation routes and contribute to the development of the national economy by means of promoting the land transport business.
Article 2(Definition) #
The term “automobile transport business proprietor” in this Act means any such person falling under any of the following subparagraphs: <Amended by Act No. 4190, Dec. 30, 1989>
1. A person who conducts an automobile transport business pursuant to the provisions of subparagraph 2 of Article 2 of the Automobile Transport Business Act;
2. A person who conducts an automobile transport agency business pursuant to the provisions of subparagraph 3 of Article 2 of the Automobile Transport Business Act; or
3. A person who conducts an automobile lease business pursuant to the provisions of subparagraph 4 of Article 2 of the Automobile Transport Business Act.
Article 3(Basic Plan for Promotion of Land Transportation) #
The Government shall establish a basic plan for the promotion of land transportation (hereinafter referred to as the “basic plan”) every year with respect to each of the following subparagraphs and give a public notice of it:
1. Matters with respect to the demand and supply of automobiles;
2. Matters with respect to the opening and expansion of bus and truck routes;
3. Matters with respect to common facilities of automobile transport business;
4. Matters with respect to distribution and storage facilities of land transportation freight;
5. Matters with respect to the inspection, repair and the safe operation of automobiles;
6. Matters with respect to upgrading the quality of those who are engaged in the automobile transport business;
7. Matters with respect to realizing the rationalization of management of the automobile transport business; and
8. Other matters necessary for the promotion of land transportation business.
Article 4(Support of Government) #
Within the scope of the basic plan the Government may finance part of the necessary funds to automobile transport business proprietors according to the provisions of the Presidential Decree in case where it is deemed that financial support is necessary for the conduct of any such business falling under any of the following subparagraphs:
1. Improvements of automobile structure;
2. Substitution of superannuated automobiles;
3. Expansion and improvement of common facilities; or
4. Expansion and improvement of distribution facilities.
Article 5(Order to Open Bus Route, etc.) #
(1) The Minister of Construction and Transportation may order the automobile transport business proprietor to open a bus route where deemed necessary for public well-being.
(2) According to the provisions of the Presidential Decree, the Minister of Construction and Transportation shall compensate a person who suffered loss owing to the conduct of transportation business on such route opened pursuant to the provisions of paragraph (1) of this Article.
Article 6(Order to Improve Management) #
The Minister of Construction and Transportation may issue the following orders to the automobile transport business proprietor for the purpose of realizing the rationalization of management of automobile transport business and increasing the convenience of national transportation:
1. Improvement of management structure;
2. Improvement of the welfare and well-being of the employees and the facilities for them; or
3. Other matters as prescribed by the Presidential Decree for the rationalization of management.
Article 7(Tax Reduction and Exemption) #
The Government shall reduce and exempt the tax according to the Regulation of Tax Reduction and Exemption Act for the promotion of the automobile transport business.
Article 8(Mutual Aid Business etc.) #
(1) The Automobile Transport Business Partnership and Automobile Transport Business Federation (hereinafter referred to as the “Partnership” and “Federation”) established under the Automobile Transport Business Act may conduct mutual aid business by respective Partnership and Federation under approval of the Minister of Construction and Transportation according to the provisions of the Presidential Decree.
(2) Partners shall bear contributions necessary for the conduct of mutual aid business.
(3) With respect to the shares of contributions pursuant to the provisions of paragraph (2) the approval of the Minister of Construction and Transportation shall be obtained.
(4) Necessary matters with respect to the content and operation of mutual aid business pursuant to the provisions of paragraph (1) shall be prescribed by the Presidential Decree.
Article 9(Nurture of Partnership and Federation) #
The Government shall nurture the Partnership and Federation with purpose of raising the economic and social status of automobile transport business proprietors.
Article 10(Supervision) #
(1) A person who obtained a loan pursuant to this Act shall not make use of the funds other than for the purpose of such loan.
(2) The Minister of Construction and Transportation shall supervise a person who obtained a loan according to this Act to ensure the proper use of the funds.
Article 11(Recovery of Loan, etc.) #
Where an automobile transport business proprietor obtained a loan or compensation pursuant to the provisions of Articles 4 and 5 (2) through a false application or other illegal means, such a loan or compensation shall be recovered.
Article 12(Delegation of Authority) #
The Minister of Construction and Transportation may delegate to Seoul Special Metropolitan City Mayor, Busan Metropolitan City Mayor or Do governor part of the authority according to this Act pursuant to the provisions of the Presidential Decree.
Article 13(Decree) #
Necessary matters with respect to the enforcement of this Act shall be prescribed by the Presidential Decree.
